What to Look for in a Senior Housing Contract and Fee Schedule

Before choosing senior housing, obtain the complete contract and an itemized fee schedule, then verify exactly what the base charge covers, which services cost extra, how care needs can change the bill, how rates can rise, and what happens if the resident transfers or leaves. The right questions depend on whether the agreement is for assisted living, a nursing home, or a continuing care retirement community (CCRC).

Start by identifying the type of senior housing

There is no single national senior-housing contract or fee schedule. A contract for an apartment-style assisted-living community can be very different from a nursing-home admission agreement or a CCRC agreement that covers several levels of care. Identify the setting before comparing prices or relying on a legal protection.

Assisted living

Assisted living generally combines housing with help with personal and everyday activities. The agreement may use a base rent plus charges tied to a care level, individual services, medication help, transportation, meals, or other amenities. Ask how the community decides that a resident has moved into a higher care level and whether a new assessment can change the monthly amount.

Nursing homes

Nursing homes provide around-the-clock support and have a different regulatory framework from other senior housing. The federal admission and payment rule discussed below applies to qualifying nursing facilities participating in Medicare or Medicaid; it is not a blanket rule for every assisted-living or retirement community.

Continuing care retirement communities

CCRCs offer increasing levels of assistance, often under one broader agreement. The Administration for Community Living says CCRC fee arrangements generally include both a monthly fee and an entrance fee, but refundability and other terms vary by contract. The exact agreement, not the marketing description, controls what you pay and what you receive.

Get the complete documents before you make a commitment

Request the current contract and the complete fee schedule before paying a deposit or signing an application. The National Institute on Aging advises consumers to obtain detailed information about costs and included services and to read the agreement carefully. Its guidance states: “Once you select a facility, read the contract carefully.” See the National Institute on Aging guidance.

Ask for any attachment that changes the financial or care obligations, such as a service-level chart, additional-care price list, transfer policy, refund policy, or list of recurring and one-time charges. If staff explain a term verbally, ask them to add the explanation to the contract or provide it in a dated written response. Keep the version you reviewed, including attachments and fee sheets, so a later revision can be identified.

Build an itemized map of every charge

Do not compare communities using only the advertised monthly rate. Use the written documents to sort each amount into a category and record whether it is recurring, one-time, optional, usage-based, or triggered by a change in care.

Contract item Questions to answer in writing
Base monthly fee What housing, meals, utilities, housekeeping, activities, transportation, and routine support are included? Is the amount for one resident or more than one?
Entrance or admission fee Is there a one-time payment? Is it refundable, partly refundable, or nonrefundable under this agreement? What deductions and timing apply?
Care-level charges What assessment moves a resident to another care tier? What is the charge at each tier, and how often can the assessment occur?
Add-on services Which services are billed separately, such as medication assistance, bathing, incontinence care, transportation, therapy, or special meals? Are rates per visit, hour, day, or month?
Ancillary costs Are there charges for supplies, urgent services, personal laundry, guests, room changes, or other items not in the base fee?
Rate changes When may the provider increase the monthly fee or a service charge? How much notice is promised, and does the contract identify a formula, cap, or reason?
Late or failed payment What notice, interest, administrative charge, or other consequence follows a missed payment?
Insurance and public benefits Which payment sources does the provider accept, and which amounts remain the resident’s responsibility?

If a cell cannot be answered from the documents, mark it as an unresolved question rather than assuming the charge is included. Ask the provider to state the amount or formula and when it can change.

Examine how care needs can change the bill

Many agreements separate housing from care. Ask for the written assessment criteria, the person who performs the assessment, and the notice given before a new charge starts. Find out whether a temporary illness, rehabilitation stay, nighttime supervision, two-person assistance, or increased medication support creates a different rate.

Ask whether services must be purchased from the community or may be arranged through an outside provider. Confirm whether a resident continues paying the full housing charge during a hospital stay, rehabilitation stay, or temporary absence. These are contract questions, not universal rules, so rely on the language in the agreement.

Read rate-change, transfer, discharge, and termination clauses

Rate increases

Locate every clause allowing the provider to change rent, care charges, meals, or other fees. Record the required notice period and the method of delivery. Ask whether an increase can apply immediately after an assessment, at renewal, or whenever operating costs change. If the contract contains a stated limit or formula, ask how it is calculated and whether it applies to all charges or only one component.

Transfers within the community

Determine when the provider can require a move to another room, a memory-care area, or a higher-care setting. Ask who pays moving costs, whether the new room has a different base fee, and whether the resident keeps any previously negotiated rate. Request the criteria and appeal or review process, if one exists.

Discharge and termination

Identify the conditions under which the resident, the provider, or either party may end the agreement. Ask about nonpayment, behavior, medical needs beyond the community’s capacity, prolonged absence, and a resident’s death. Confirm the required notice, the date charges stop, responsibility for removing belongings, and any termination or administrative fee. Do not assume that a general statement such as “care needs may change” explains the actual process.

Give special scrutiny to a CCRC entrance fee

CCRC entrance fees can represent a substantial portion of a household’s assets, and the refund language may be complicated. The Administration for Community Living explains that refundability varies by contract. Its CCRC information was last modified on February 18, 2020, so use it to understand the general structure and verify current state law and the provider’s present agreement at ACL’s CCRC guidance.

Ask the provider to show the refund calculation with a written example using the proposed entrance fee. Clarify:

  • Whether the fee is refundable, partly refundable, or nonrefundable.
  • Whether the refund is a fixed amount, a percentage, or a declining balance.
  • What event starts the refund clock: notice, move-out, death, resale, or another event.
  • How long payment can take and whether the provider may delay it until a replacement resident is found.
  • Which deductions apply, including unpaid charges, damage, fees, or other listed amounts.
  • Whether the resident can transfer the fee or contract rights to another unit or level of care.

ACL also notes that a refundable entrance fee may count as an available asset for Medicaid even when the resident cannot access it. Ask the state Medicaid agency or a qualified local adviser how the specific contract could affect eligibility; do not assume that a refund promise is ignored for benefit purposes.

Check who is signing and who is financially liable

Separate three roles: the resident who owes the charges, a representative who is authorized to manage the resident’s resources, and a person who promises to pay from personal funds. Read the signature block and any guarantor, indemnity, or payment-assurance language carefully.

For nursing facilities covered by the federal rule, the Consumer Financial Protection Bureau says that “a nursing facility may not condition a resident’s admission or continued stay on receiving a guarantee of payment from a third party, such as a relative or friend.” The rule concerns qualifying nursing facilities participating in Medicare or Medicaid; it should not be applied wholesale to assisted living, CCRCs, or other housing arrangements. Read the CFPB Consumer Financial Protection Circular 2022-05 for the federal guidance and its scope.

A representative may be asked to arrange payment from the resident’s resources without becoming personally liable, but the exact wording matters. Before signing for someone else, ask the facility to identify which promises use only the resident’s assets and which, if any, make the signer personally responsible. If the language is unclear, pause and obtain local legal advice rather than relying on an admission coordinator’s oral explanation.

Compare services, staffing, and safety—not just fees

A lower base rate is not a bargain if the setting cannot safely meet current or likely needs. Visit each community, observe how staff interact with residents, and ask who is available during evenings, weekends, and emergencies. Discuss mobility assistance, falls, continence, medication management, dementia-related supervision, dietary needs, and access to licensed clinical care.

Ask which services are provided by employees and which are contracted out. Confirm whether the advertised care is available every day, whether there are minimum staffing or scheduling conditions in the contract, and what happens when a resident needs care beyond the community’s license or capacity. CFPB recommends visiting facilities, learning about offered services and costs, and discussing affordability and safety with professionals.

Verify payment sources and your likely out-of-pocket cost

Ask the provider and the relevant insurer or benefit program to identify exactly which service and setting are covered. The National Institute on Aging recommends checking whether Medicare, Medicaid, or long-term-care insurance may pay for any costs. Coverage can depend on the service, eligibility, authorization, and location, so do not treat a general statement that a program is accepted as a promise that the monthly bill will be paid.

Prepare a monthly estimate using the base fee, the resident’s present care level, recurring add-ons, likely personal expenses, and a reasonable range for possible care changes. Then identify who pays each amount and what happens if benefits stop, are delayed, or cover less than expected.

Use one comparison sheet for every community

Fill out the same fields for each provider so that different contract structures are visible. The official guidance supports comparing cost, services, and agreements, but it does not establish a national score or standard fee schedule.

Comparison field Community A Community B
Base monthly fee and what it includes Record from current contract Record from current contract
Entrance or admission fee Amount, refund formula, timing, deductions Amount, refund formula, timing, deductions
Add-on and care-level charges List each trigger and rate List each trigger and rate

Care capacity and staffing fit Present and anticipated needs Present and anticipated needs
Accepted payment sources Benefits, insurance, private pay Benefits, insurance, private pay

Resolve unclear terms before signing

Treat unexplained blanks, conflicting attachments, handwritten changes, and promises that appear only in marketing material as issues to resolve. Ask for a clean final copy with every negotiated term included. Have the provider identify the controlling document if the contract, fee sheet, and resident handbook use different wording.

For questions that depend on state law or the resident’s benefits, contact the Area Agency on Aging through the Eldercare Locator, a legal-aid program, or an elder-law attorney. CFPB also identifies state nursing-home survey agencies as a resource for potential nursing-home admission violations. Local professionals can assess provisions that national guidance cannot settle, including refund rights, notice requirements, and signer liability.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Final pre-signing checklist

  1. Obtain the current contract, itemized fee schedule, care-level chart, refund policy, and all attachments.
  2. Mark every recurring fee, one-time fee, optional service, care trigger, and rate-change clause.
  3. Write down what is included and what is billed separately, including during temporary absences.
  4. Calculate the likely monthly total at the resident’s present care level and identify charges that could be added later.
  5. For a CCRC, document the entrance-fee refund formula, deductions, timing, and possible Medicaid effect.
  6. Read transfer, discharge, termination, notice, and move-out provisions word for word.
  7. Confirm whether every signer acts only as the resident’s representative or assumes personal payment responsibility.
  8. Ask the provider to answer unresolved questions in writing and keep the signed version with its attachments.
  9. Seek local aging-services or legal advice before signing any term you cannot explain in plain language.
