A meaningful police drone privacy policy should set clear limits on what is collected, why it is collected, how long it is kept, who can access it, when it can be shared, and how the program is reviewed. A drone program may also be described as a UAS (unmanned aircraft system) program. Use the checklist below to see whether a policy gives concrete answers—or leaves important decisions open.
Start with the limits on collection
A policy should identify what the agency’s drones can collect, where and from whom collection may occur, and how collection must relate to an authorized purpose. Look for boundaries on the kinds and scale of data gathered, not just a general statement that officers will act lawfully.

- Data: Does it address video, photographs, sensor information, and associated metadata?
- Place and people: Does it describe where collection may take place and who may be affected?
- Purpose: Does it require a lawful, authorized mission and limit collection to that purpose?
The U.S. Department of Justice (DOJ) says UAS sensor information may be collected, used, retained, or disseminated only for a properly authorized purpose. DOJ COPS Office guidance recommends spelling out where, what, how much, and from whom data is collected. Those are useful standards for reviewing a local policy, but DOJ’s federal policy does not bind every local department. DOJ Justice Manual, § 9-95.000; DOJ COPS Office guidance.
Check whether retention has a clock
A policy should state the ordinary retention period for routine drone footage and other sensor data, explain when the clock starts, and describe how deletion is carried out and documented. It should distinguish routine, non-evidentiary data from material preserved for a case, an authorized mission, a complaint, or a records obligation.

- No Registration Needed - Under 249 g, FAA Registration, and Remote ID are not required if you fly for recreational purposes.
- 4K UHD Stunning Imagery- Film in 4K HDR Video for crystal clear aerial shots. With Dual Native ISO Fusion, Mini 3 enables the capture of details in highlights and shadows, both day and night. [3]
- Striking Vertical Videos are Ready to Share - With True Vertical Shooting, you can easily capture tall landmarks like skyscrapers and waterfalls.
- Extended Battery Life - Its flight time can be extended up to 51 minutes with the Intelligent Flight Battery Plus (sold separately), but the aircraft will weigh more than 249 g. Fly More combo offers up to 114 minutes of total flight time.[2]
- 38kph (Level 5) Wind Resistant and 3-Axis Gimbal for Stable - With its Level 5 wind resistant and 3-axis mechanical gimbal, Mini 3 can capture consistently smooth 4K imagery. Brushless motors enhance power and allow takeoff at altitudes up to 4,000 meters.
Read exceptions closely. They should identify who may authorize extended retention, the reason it is allowed, how the decision is reviewed, and which records schedule applies. Also look for safeguards while information is retained.
DOJ’s federal policy says information collected using UAS that may contain personally identifiable information (PII) generally will not be retained for more than 180 days, unless retention is necessary for an authorized purpose or the information is maintained in a Privacy Act system of records. DOJ also says agencies need appropriate Federal Records Act schedules. This is a federal DOJ rule with stated exceptions, not a universal deadline for local police. DOJ Justice Manual, § 9-95.000; DOJ 2019 policy announcement.
Find out who can access footage
“Authorized personnel” is not very informative unless the policy defines the roles and purposes involved. Check who may view, copy, export, or delete footage and metadata, and whether access is limited to tasks such as an authorized investigation or emergency response.

- All-Around Safety & Flexible Flight - Fly confidently with omnidirectional obstacle sensing [8] and enjoy versatile flight [13] for safer, more dynamic aerial adventures.
- Does the policy describe authentication and safeguards for stored data?
- Are access events logged, monitored, and audited?
- Can staff outside the drone-operating unit retrieve information, and who approves that access?
- Does it cover vendor access, credentials, and cybersecurity protections?
COPS guidance specifically recommends stating who may access retained data and for what purposes. DOJ says retained information must be safeguarded and notes that department information systems may be monitored, recorded, and audited under department policy. DOJ’s 2019 announcement also says UAS acquisitions are evaluated for cybersecurity risks. DOJ COPS Office guidance; DOJ Justice Manual, § 9-95.000; DOJ 2019 policy announcement.
Read the sharing and secondary-use rules
A policy should say when footage or related data may be disclosed, to whom, for what purpose, and under what approval or agreement. It should also address record management and prevent data collected for one mission from becoming available for unrelated uses without a stated basis.
COPS guidance says data should be used and disclosed exclusively for law-enforcement purposes unless exigent circumstances warrant otherwise. DOJ’s federal policy requires a properly authorized purpose and applicable records controls. When assessing a local policy, look for similarly clear limits rather than assuming those federal rules apply to it. DOJ COPS Office guidance; DOJ Justice Manual, § 9-95.000.

Look for oversight that leaves a record
Oversight is more than a promise to supervise. A useful policy explains who approves flights, what mission information is recorded, how operators are trained, and how compliance is checked. It should make it possible to review what the program did, not just what it was intended to do.

- Are operators and supervisors trained on the policy and relevant law?
- Are privacy assessments conducted before adoption or a material change in use?
- Are there annual reviews, audits, and a process for receiving and investigating complaints?
- Is the policy public, periodically reviewed, and open to public comment?
DOJ policy sets minimum areas for component rules, including approvals, mission tracking and reporting, privacy assessments, and annual reviews. COPS guidance recommends a privacy impact assessment, public comment, and public guidance about what happens to collected information. FAA materials point to voluntary privacy, transparency, and accountability best practices. The 2018 FAA Reauthorization Act says a privacy policy for covered UAS activities should address collection, use, retention, dissemination, and deletion, be periodically reviewed, and be public. DOJ Justice Manual, § 9-95.000; DOJ COPS Office guidance; FAA UAS community engagement resources; FAA Reauthorization Act of 2018.

| Access | Roles permitted to retrieve data, allowed purposes, and logging or audits |

| Operations | Who approves missions and what records are kept |
| Oversight | Review frequency, audit arrangements, and public visibility |
These comparison points reflect DOJ policy and COPS Office guidance; they are a way to assess policy clarity, not a substitute for checking the rules that govern a specific agency. DOJ Justice Manual, § 9-95.000; DOJ COPS Office guidance.
Check the rules that apply where you live
Federal DOJ policy and national guidance can provide useful examples, but they do not determine every city’s or state’s legal requirements. Local retention schedules, public-records obligations, warrant rules, and controlling court decisions may affect how a particular department must handle drone data. Check the agency’s policy alongside the applicable state and local rules before drawing a legal conclusion.

The DOJ COPS Office captures the transparency principle directly: “police departments should implement a standardized policy related to the collection, retention, and use of UAS-gathered data that is fully disclosed to the public.” DOJ COPS Office guidance.
