Then clear the separate rights in your footage, music, script and other inputs, disclose synthetic content where the platform or law requires it, and check rules for intimate, political, commercial and deceptive uses. Consent, copyright, privacy, publicity rights and AI-labeling duties are different questions; satisfying one does not automatically satisfy the others.
No single “AI consent” rule applies everywhere. The result depends on the person’s location, your location, the audience, the context, what the video makes the person appear to say or do, and the current rules of the service where you publish it. For consequential work, have a lawyer qualified in the relevant jurisdiction review the release and distribution plan.

What rights are involved in an AI video of a real person?
A realistic synthetic video can trigger several legal and platform issues at once. Treat these as a checklist of separate permissions and obligations, not as one test called “AI consent.”
| Question | What it covers | Why a “yes” does not settle the others |
|---|---|---|
| Did the person authorize the likeness use? | Use of their name, image, face, body, voice, performance or recognizable mannerisms, including synthetic alteration. | A likeness release does not automatically give you copyright in the camera footage, music, script or photographs used in the project. |
| Who owns the source material and final work? | Copyright in recordings, photographs, music, text, logos and human creative contributions to the finished video. | Copyright ownership does not by itself authorize use of a person’s identity or make a prohibited depiction acceptable. |
| Does privacy or data-protection law apply? | Collection, storage, training or processing of identifiable images, voices and other personal data. | A signed release may not answer every biometric, privacy, employment, minor or cross-border requirement. |
| Must the synthetic nature be disclosed? | Platform labels, captions, watermarks and transparency duties for realistic AI-generated or altered media. | Labeling tells viewers what they are seeing; it does not grant permission or cure harassment, sexual exploitation or deception. |
| Is the depiction intimate or otherwise specially regulated? | Nonconsensual intimate imagery, digital forgeries, election material, defamation and other context-specific rules. | Special statutes can impose criminal, civil or removal consequences even when a creator claims artistic or expressive intent. |
The same face-swap can therefore be lawful in one setting and prohibited in another. A private individual shown endorsing a product, a journalist reconstructing an event, a parody of a public figure and an intimate fake raise different questions.

Do I need consent before making the video?
As a practical risk-reduction rule, ask for permission before you generate anything that makes an identifiable person appear in a synthetic scene. This is especially important when the person is a private figure, when the video is commercial, or when it makes them say or do something that never happened. Laws do not impose an identical consent requirement for every depiction in every country, but platforms can set stricter rules than a statute.
Permission should cover the actual use you intend, rather than a vague statement that you may use the person’s likeness “in any media.” Explain the synthetic technique and the audience in plain language before the person signs. Keep the signed document, the version of the script or prompt approved, and records of any later changes.
What to explain before asking for a signature
- Whether the project will clone or synthesize a voice, replace a face, generate a new body or combine several recordings.
- Whether the person may be shown saying words, expressing opinions or performing actions they never said, believed or performed.
- Where the video will appear, including advertising, social platforms, websites, internal training and paid media.
- Which countries or territories are targeted and how long the permission lasts.
- Whether original recordings, voice models, face embeddings or other derived files will be retained, reused or used to train a model.
- What approval, takedown, correction or revocation process applies if the project changes.
What should an AI video release discuss?
There is no universally sufficient form. A conventional model release may or may not describe a synthetic double, voice clone, face replacement or future model training clearly enough for a particular jurisdiction. Treat the following as drafting topics to discuss with counsel, not as a guaranteed legal checklist.

Purpose, audience and distribution
Specify commercial, promotional, editorial, educational, entertainment, political, satirical or other purposes. Name intended platforms and channels, territories, term and whether the work may be edited into later versions.
Retention, reuse and model training
State what happens to source recordings and derived assets after delivery. If a vendor or creator may retain a voice model, face data or training material, say so directly. A person may agree to one campaign without agreeing to indefinite reuse or model development.

Minors, representatives and revocation
For a minor or someone represented by another person, confirm who has authority to consent and what additional safeguards apply. Explain whether permission can be withdrawn, what costs or deadlines apply, and which uses continue after withdrawal. Local law may limit the effect of a revocation clause.
Digital model-release toolkits and AI or digital-replica addenda demonstrate the kinds of language parties use, but a template from another country or project is not proof that your release is valid. Have a qualified lawyer adapt it to the people, places and uses involved.
Why a likeness release is not a copyright clearance
The person on screen may not own the camera footage. A photographer, videographer, employer, production company or commissioning client may hold copyright. Music, photographs, scripts, logos, costumes, locations and stock assets can each have different rightsholders. Obtain permission for every protected input you plan to copy, transform or distribute.

The reverse is also true: owning footage does not automatically authorize a synthetic use of the person depicted. A contract that permits ordinary editing may not clearly address a voice clone or a new scene in which the person appears to endorse a product. Check the wording instead of assuming that a broad “all media” clause answers a new technology.

What the U.S. TAKE IT DOWN Act covers
Public Law 119-12, enacted May 19, 2025, addresses intentional disclosure of specified nonconsensual intimate visual depictions, including certain digitally forged material. Its definition of consent is specific to that statutory context: affirmative, conscious and voluntary authorization made free from force, fraud, duress, misrepresentation or coercion.
The Act’s “digital forgery” definition concerns an intimate visual depiction of an identifiable individual created or altered with software, machine learning, AI or another technology that is indistinguishable from an authentic depiction to a reasonable person viewing it as a whole. That definition should not be treated as a general rule governing every AI video or every use of a likeness.
Removal process and the 48-hour figure
Federal Trade Commission guidance published in 2026 says covered user-generated-content services—including social, messaging, image and video sharing, and gaming services—must provide a notice and removal process for covered nonconsensual intimate imagery. The FTC says platforms must make reasonable efforts to identify and remove known identical copies within 48 hours after a valid request. This is a remedy for covered intimate imagery, not permission to create or upload it, and it is not a deadline for every takedown request or every platform dispute.
Does copyright protect an AI-generated video?
Consent and copyright remain separate. In its January 29, 2025 guidance, the U.S. Copyright Office said a generative-AI output may receive copyright protection when a human author determines sufficient expressive elements. Merely entering a prompt is not enough. Human-authored material perceptible in the output, or human creative arrangement and modification, may qualify. Including AI-generated material in a larger human-created work does not by itself prevent protection.

As Register of Copyrights and Director Shira Perlmutter put it: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” Keep records of the human decisions that shaped the script, performances, edits, sequencing and final composition if ownership matters. Copyright in those contributions still does not grant permission to exploit the depicted person’s identity.
When must you label an AI video?
Platform rules can be more specific than general law and can change. TikTok’s Community Guidelines define likeness broadly to include a recognizable visual or audio representation, including face, body, voice and gestures. The service requires its AIGC label or a clear caption, watermark or sticker for realistic-looking people or scenes that are AI-generated or significantly edited, including audio that mimics a real person’s voice.
TikTok says disclosure is generally not needed for minor changes such as color correction or cropping, artistic styles such as anime, or generic text-to-speech that is not a recognizable known individual’s voice. The exact treatment depends on the current wording of the guidelines and the content you upload.
Why a label is not a legal shield
TikTok also says labeled content can be prohibited. Examples include using a private figure’s likeness without consent; sexualized, fetishized or victimizing depictions; AI likenesses made to bully or harass; and specified misleading content about matters of public importance. A label identifies synthetic media but does not cure an unauthorized or harmful use.
How the EU and UK approaches differ
The European Commission describes its Code of Practice on Transparency of AI-Generated Content as a multi-stakeholder code developed by independent experts with the AI Office. It is intended to help providers and deployers meet AI Act transparency obligations for labeling and marking generated content. Its description includes deepfakes: artificially generated or manipulated image, audio or video resembling existing people or other subjects that would falsely appear authentic or truthful.

That transparency framework does not answer every private-law question about likeness, privacy or consent. You still need to examine the law where the person, creator and audience are located.
UK Government copyright-and-AI consultation material describes digital replicas as digitally created images, videos or audio that realistically replicate an individual’s voice or appearance. It identifies copyright, data protection, personal-data use in training and outputs, and possible personality-rights proposals as complex policy matters. The consultation did not itself create a general UK personality right.
Use this decision framework before you generate
| Risk factor | Lower-risk direction | Higher-risk direction |
|---|---|---|
| Identifiability | Fully fictional actor with no distinctive resemblance. | Recognizable face, voice, body, name or mannerisms. |
| Conduct shown | Approved performance of provided script. | Unapproved speech, conduct, endorsement or apparent confession. |
| Consent record | Specific written permission describing synthetic uses. | Informal message, ambiguous old release or no permission. |
| Context | Private test shared only with authorized collaborators. | Commercial, intimate, political, defamatory, deceptive or harassment-related publication. |
| Audience and location | Known audience in one jurisdiction after local review. | Global distribution across countries with different rules. |
| Source rights | Original or fully licensed footage, music, script and imagery. | Unclear ownership, scraped media or third-party logos and recordings. |
| Future use | Deletion and reuse limits documented. | Indefinite retention, vendor reuse or model training not explained. |
If several factors fall in the higher-risk column, pause generation and obtain legal review. Consider using a fictional character, a consenting performer, a stock avatar or a clearly non-identifying treatment instead of trying to justify the original concept after the fact.

1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIf a video is already online without permission
- Preserve evidence privately: save the URL, timestamps, screenshots, the file and messages showing how it was made or distributed.
- Report the content through the platform’s current intimate-image, impersonation, privacy or harassment channel, selecting the most specific category available.
- If intimate imagery is involved, use the platform’s notice-and-removal process and identify known identical copies. The federal 48-hour guidance applies only within the TAKE IT DOWN Act’s covered scope.
- Ask search engines, hosts, advertisers or downstream accounts to remove copies under their applicable procedures; each service may require separate proof.
- For threats, extortion, minors, physical danger or suspected criminal conduct, contact local law enforcement and a lawyer promptly. Do not circulate the file further while seeking help.
Limits and updates to check
This overview does not exhaust state, national or local rules on publicity, privacy, biometric data, defamation, election manipulation, employment, minors or rights after death. Laws, court decisions and platform terms change. Before publication, confirm the current rules for the person, creator, audience and platform, and obtain jurisdiction-specific advice when the project has meaningful legal, financial or reputational consequences.
