If your phone repair is stalled because a replacement part is unavailable, do not agree to an open-ended wait. Ask the repairer for the exact part status and a written completion estimate, identify whether the seller, manufacturer, carrier, insurer or repair contract is responsible, and request practical alternatives such as a loaner, another authorized location, a different approved repair method, or return of the phone. Your right to a refund, replacement, outside repair or reimbursement depends on the country, warranty and type of transaction.
Keep every document and message. A clear paper trail lets you challenge an unreasonable delay without accidentally giving up warranty or statutory rights.

What to do in the next 24 hours
- Get the part information in writing. Ask for the exact part name or number, why it is unavailable, whether it has been ordered, the supplier or manufacturer’s latest estimate, and whether an equivalent part or another authorized repair route exists.
- Demand a specific revised date. A statement such as “we are waiting for stock” is not a usable plan. Ask for the date the repair is expected to be completed and when you will receive the next update.
- Ask whether you can have the phone back. Find out if the device can be returned while the part is pending, whether removing it from the repair queue changes your place in line, and whether reinspection or a new fee would apply later.
- Ask for alternatives before authorizing more work. Options may include a loaner, a different authorized service center, an approved substitute component, a replacement device, or cancellation and refund where your contract or local law allows.
- Preserve your records. Save the repair order, intake photos, proof of purchase, warranty or service-plan terms, payment receipt, diagnostic report, and every email, text and call summary.
When speaking by phone, send a short follow-up message: “As discussed today, you are waiting for [part], with an estimated completion of [date]. Please confirm whether the phone can be returned and what alternatives are available.” That message turns a verbal promise into evidence.
Identify who must solve the problem
Several businesses can appear on a repair transaction, but they do not all owe the same remedy. Check which arrangement you used:

- Retail seller: The store that sold the phone may have statutory obligations even when a manufacturer’s warranty is involved.
- Manufacturer warranty: The manufacturer’s written terms control warranty procedures, exclusions and approved service channels, subject to consumer law.
- Carrier or insurance plan: A carrier protection plan or insurer may set its own authorization, deductible, replacement and turnaround rules.
- Paid repair shop: A shop you hired directly is responsible for the service it promised, its estimate and any workmanship warranty in the agreement.
In Victoria, Australia, Consumer Affairs Victoria says a valid consumer claim is generally handled by the store, not pushed back to the customer to pursue the manufacturer. That is Victoria-specific guidance; other regions can allocate responsibility differently. Read the paperwork and send your request to every party that may be responsible, while clearly asking one party to take ownership of the case.
Can you get your phone back while waiting for parts?
Often the answer is a matter of the repair agreement and the device’s condition, not an automatic legal entitlement. Ask the provider to explain whether the phone is safe to use, whether it has been disassembled, and whether returning it could affect the warranty or diagnostic findings. Request a written inventory of removed components and a confirmation that screws, shields, seals and your SIM or memory card will be returned.
If the phone contains sensitive information, ask what data has been accessed, copied or erased. A repairer may need to test the device, but you should not assume that data will survive a board replacement or factory reset. Before handing it back, sign out of accounts if possible, remove payment cards from the device, and keep a backup. If the phone is already with the shop, ask for confirmation that it remains locked and that no data will be deleted without your authorization, except where the service terms clearly permit necessary procedures.

How long should a phone repair take?
There is no worldwide number of days that makes a repair “reasonable.” Timing depends on the fault, part availability, shipping, authorization, local law and the promise made when you paid. A repairer should nevertheless be able to tell you what is known, what is uncertain and when it will reassess the estimate.

Compare the new estimate with the original promise and with the purpose of the phone. A short delay for a documented shipment can be different from repeated missed dates with no confirmed order. Ask for an escalation date even if the final completion date is uncertain: for example, “If the component has not shipped by Friday, what remedy will you offer?”
What remedies may apply in different places?
Victoria, Australia
Consumer Affairs Victoria says that if a store cannot arrange a repair—for example, because the manufacturer does not have the necessary part—or cannot do so within a reasonable time, the consumer can have the product repaired elsewhere and claim reasonable costs from the selling store, or ask for a refund or replacement. The page was last updated 13 October 2023. It is state guidance, not a rule for every Australian state or territory.
Before using another repairer, give the store a written chance to resolve the issue and ask whether it will authorize the alternative. Keep the original diagnosis, the reason the part is unavailable, the quote from the replacement shop and proof of payment. “Reasonable costs” are not a blank cheque: an expensive upgrade, unrelated work or a repair outside the original fault may not be recoverable.

Québec, Canada
Québec’s Office de la protection du consommateur describes an availability warranty for cell phones. Merchants and manufacturers must make replacement parts, repair services and repair information available for a reasonable period after purchase, subject to notice rules. If a party does not intend to guarantee availability of an element, the Office says it must provide clear written notice before purchase. Without that notice, a consumer may ask the responsible merchant or manufacturer to perform the necessary repair at its expense when the availability obligation is not met.

The Office’s current guidance, accessed in 2026, describes a specific process: the merchant or manufacturer has 10 days to notify you in writing of the timeframe it proposes for the repair. If you accept that timeframe and it is missed, you may demand reimbursement or replacement as described by the Office. If the proposed timeframe is unacceptable, you may refuse it and have another party perform the repair at the merchant’s or manufacturer’s expense. If no satisfactory response follows, the Office says you may demand replacement or reimbursement and return the broken item. This is Québec-specific plain-language guidance and does not replace the legislation, so keep the written notices and check how the rules apply to your purchase.
United States
Federal warranty protection does not mean every independent repair is covered. The Federal Trade Commission’s consumer guidance says that when an earlier independent repair was unrelated to a later problem, and the later repair is covered by an unexpired warranty, the manufacturer cannot refuse that later covered repair solely because of the earlier independent work. The protection is tied to the facts: an independent repair that caused or is related to the claimed defect can lead to a different analysis.
The FTC encourages consumers who are told that a warranty was voided because of independent repair to report the issue. In a July 2024 release, FTC Bureau of Consumer Protection Director Samuel Levine said, “These warning letters put companies on notice that restricting consumers’ right to repair violates the law.” The release concerned staff warning letters to named companies in other product categories. It was not a court judgment deciding every phone dispute, so use it as enforcement context rather than a guarantee that a particular claim will be approved.

European Union
Directive (EU) 2024/1799 was adopted on 13 June 2024. The European Commission says Member States had to transpose and apply it from 31 July 2026. It creates repair obligations for manufacturers of goods subject to EU repairability requirements and listed in Annex II. Covered repairs must be completed within a reasonable time and for a reasonable price, and manufacturers supplying spare parts must charge reasonable prices. A manufacturer may provide a replacement good for the repair period.

The directive does not automatically cover every phone, every component or every fault. Check the national implementing law and whether your model and failure fall within the product-specific scope. The Commission foresees an EU online repair platform becoming operational in January 2028; it should not be treated as an already available complaint or booking service.
Should you use another repair shop?
An independent shop can be sensible when the original provider has no credible supply date, but authorize it only after checking the consequences. Ask for:
- the exact part to be installed and whether it is new, refurbished, reclaimed or a compatible substitute;
- a total written price, including diagnostics, shipping, taxes and any cancellation or inspection charge;
- the repairer’s workmanship warranty and what it excludes;
- confirmation of whether the original provider will release the phone and its diagnostic information;
- a data-handling explanation, including possible erasure, board replacement and access to your passcode;
- the effect on any manufacturer, seller, carrier or insurance coverage.
Do not let a shop tell you that opening a phone always voids every warranty. Coverage usually turns on the terms, the cause of the failure and applicable law. Conversely, do not assume an independent repair is harmless: a low-quality part or unrelated damage can complicate a later claim. Get the risk allocation in writing before paying.

Ask the seller, repair provider, carrier or insurer first for a loaner or temporary replacement. Confirm whether there is a fee or deposit, the return deadline, damage liability, SIM or eSIM transfer procedure, and whether you can access two-factor authentication and your backed-up data. A borrowed handset may meet your needs without committing you to a purchase.

If no loan is available and the delay is substantial, an unlocked smartphone can be an optional temporary device. Verify the network bands and carrier compatibility in your country, the phone’s condition and battery health, the return policy, warranty, total cost and whether it supports your SIM or eSIM. Borrowing or buying a basic compatible phone may be cheaper than buying a replacement that duplicates features you do not need. No particular model, price, retailer stock or program should be assumed without checking current local listings.
Compare your options before choosing

Use six decision tests: expected time until completion, total out-of-pocket cost and possible reimbursement, preservation of warranty or statutory coverage, part quality and repair warranty, data and security risk, and whether the temporary handset supports your calls, messages, authentication and work apps.
Escalate when the date keeps moving
Send a dated written escalation to the seller or responsible warranty provider. Include:
- the purchase and repair dates, device model and repair-order number;
- the original promised completion date;
- the exact part said to be unavailable and the latest status;
- the revised date you are requesting or the information you need;
- the remedy you want, such as completion, return of the phone, a loaner, an authorized alternative, replacement or reimbursement;
- a reasonable response date and the consumer agency you may contact if there is no satisfactory reply.
Keep the tone factual. Do not threaten a remedy you have not checked, and do not authorize a second repair merely because the first provider is slow. If the business does not respond, contact the consumer-protection agency for your location and provide the complete timeline. The available complaint route and remedies differ by jurisdiction.
Common mistakes that make delays harder to resolve
- Accepting “no stock” without a date: Ask when the part was ordered and when the estimate will be updated.
- Dealing only with the manufacturer: In some places, including Victoria, the seller generally handles a valid claim.
- Authorizing another shop immediately: First document the failure to repair and check who may reimburse the cost.
- Assuming every independent repair voids coverage: U.S. FTC guidance limits that claim; the connection between the earlier work and the later fault matters.
- Buying a temporary phone without checking compatibility: An unlocked device still may not support your carrier, bands, eSIM or authentication apps.
- Leaving data protection until the end: Back up what you can, remove payment credentials and obtain written assurances about erasure and access.
The practical goal is a documented decision: wait with a credible date, transfer the repair under written terms, seek a remedy available where you live, or arrange temporary connectivity at a controlled cost. No single deadline or automatic refund rule applies everywhere, so base the next step on your paperwork, location and the provider’s written response.
