An announcement is not necessarily your individual notice. Ask whether your role is affected, when your meeting will occur, your last working day, and where the official FAQ and benefits documents will be posted.
Work through the response in this order: preserve facts, clarify your status with HR or your manager, understand access and offboarding timing, secure health coverage and unemployment deadlines, then begin a documented job search. Treat unconfirmed names and numbers as rumors, and use only the communication channel designated by the company.

Your first hour
- Read the official message once, then save only what policy permits. Keep an authorized personal record of the announcement or FAQ if company policy allows it. Do not forward confidential layoff lists, internal dashboards, customer data, source code, credentials or screenshots to personal accounts.
- Find out whether you are personally affected. Ask your manager or the named HR channel whether your role is in scope, when individual meetings will occur, and where the written FAQ will live. A broad team announcement does not answer those individual questions.
- Write an accomplishment inventory from memory or approved records. Note your title, dates, projects, technologies, reliability improvements, launches, incident responses, cost reductions and measurable outcomes. Do this before access changes, but do not copy proprietary documents or customer information.
- Record the next confirmed update. Note who is responsible for answers, the time of the next briefing and the questions still unresolved. Avoid repeating speculation about names, performance or selection criteria.
- Prepare for rapid access changes. Technology employers may disable credentials, VPN, repository, cloud-console, device and email access during offboarding. Keep personal material only where you are authorized to retain it, and do not attempt to defeat a security control.
What to request the same day
Ask for a written summary rather than relying on a meeting impression. Request the documents and dates below, and keep a private list of what you received.
- Your individual status, proposed last working day and whether you will work through that date, leave immediately or remain available for transition.
- Severance amount, payment timing, continuation of benefits, eligibility conditions and any release, confidentiality or non-disparagement language.
- Equity treatment: what happens to vested and unvested awards, whether any acceleration applies, and the deadline or process for exercising options if applicable to your plan.
- Bonus treatment, unused paid time off, retirement-plan handling and any repayment or clawback terms.
- Health-plan end date, how and when the COBRA election notice will arrive, and where to compare Marketplace, Medicaid, CHIP or Medicare coverage.
- The exact time systems, VPN, repositories, cloud consoles, email and devices may change, plus the approved method for retrieving personal files and returning equipment.
- Whether the employer provides outplacement, an employee-assistance program, references or a neutral employment-verification process.
If an answer is not available, ask when it will be available and who owns it. Do not treat a verbal estimate as a final benefit or legal determination.

Health coverage, income and legal deadlines
Federal WARN notice
The federal Worker Adjustment and Retraining Notification (WARN) Act generally requires at least 60 calendar days of written notice for a covered plant closing or mass layoff. Department of Labor guidance describes coverage for employers with 100 or more employees and qualifying events affecting at least 50 employees at one site, subject to statutory exceptions.
For a qualifying mass layoff at one site, the DOL describes either 50–499 affected employees when the required workforce-percentage and duration tests are met, or 500 or more affected employees. Counting rules, temporary-work exceptions and other details can change the analysis, so a company announcement alone does not establish that WARN applies to you. State laws may provide additional or different protections.
Ask which entity employed you, which worksite and headcount were used, whether the company is relying on a WARN exception, and whether a state notice was issued. Contact your state Dislocated Worker Unit for a case-specific explanation; the applicable state office can tell you how to verify a notice or challenge missing information.
Unemployment insurance
There is no single federal unemployment program. USAGov’s 2025 guidance explains that each state administers its own program, with different eligibility rules, filing procedures and waiting-period requirements. File with the appropriate state office as soon as you are eligible, even if you are waiting for severance paperwork, and report severance or other payments as the state instructs.
Remote workers can have a more complicated filing location. Ask the state office which state should receive the claim, based on where you performed the work and the employer’s reporting history. Keep your termination notice, wage records, dates of employment and job-search records available.
Health insurance
COBRA generally applies to most private-sector businesses with 20 or more employees when a qualifying event occurs, including termination or reduced hours. For those events, coverage can last 18 months. The plan’s election notice generally gives you 60 days to elect coverage. The election date, premium, deductible, provider network and prescription rules matter more than the word “continuation”: COBRA can preserve your existing plan but may require you to pay the full permitted premium.
Compare COBRA with Marketplace plans, Medicaid, CHIP and Medicare where relevant to your household. Write down the coverage end date, election deadline, first payment date, monthly premium, deductible, out-of-pocket maximum, doctors, hospitals and prescriptions. Ask whether a spouse’s plan has a special-enrollment window. Do not let an unanswered HR email run past an election deadline; contact the plan administrator or the relevant government office directly.

Read the severance agreement before signing. Check the payment schedule, benefit continuation, release scope, confidentiality and non-disparagement clauses, cooperation obligations, intellectual-property language and any restrictions that could affect future work. If the agreement waives age-discrimination claims in a group termination, EEOC guidance says some waivers covered by the Older Workers Benefit Protection Act require written disclosures and at least 45 days to consider the waiver. Individual agreements can have different deadlines. An employment lawyer or worker-support agency can explain terms you do not understand.
Rank #3
Equity plans are contract-specific. Ask for the plan and award documents, the final vesting date, treatment of unvested awards, any acceleration, the post-termination exercise period and the tax paperwork you will receive. Do not assume that a severance promise changes an equity deadline unless the written plan or agreement says so.
Discrimination protections
A layoff decision still cannot lawfully be based on protected characteristics. The EEOC lists race, color, religion, sex, national origin, age 40 or older, disability and genetic information among protected categories. The Age Discrimination in Employment Act prohibits age discrimination in layoffs for covered workers age 40 or older; the EEOC has specifically stated that employers may not choose the oldest workers because of age.
Keep factual records of selection explanations, dates, comparable roles and any comments that concern you. Do not accuse colleagues publicly or post confidential material. If you believe protected status, retaliation or accommodation issues affected the decision, seek advice promptly from the EEOC, a state civil-rights agency or an employment lawyer because filing deadlines vary.
Access, devices and personal information on a technology team
Assume that access can change without advance warning. CISA’s offboarding control example calls for termination of access to systems, networks and accounts. That can include identity providers, VPN, source repositories, cloud consoles, ticketing systems, production dashboards, email, laptops and physical badges.
Before the stated cutoff, use approved procedures to separate personal material from company material. Remove personal browser profiles or contacts only if policy permits, export personal tax or benefits records through an authorized process, and ask IT how to recover personal files. Never email proprietary code to yourself, copy customer data, take credentials, clone a private repository or use a former token after access is revoked. Returning a device does not authorize you to retain its contents.
Managers should coordinate HR, IT, security and facilities before each offboarding event. A written runbook should identify the cutoff time, account and device actions, data-retention requirements, equipment return and the person who can answer an affected worker’s access questions.
A practical first-week plan
Day one: stabilize the facts
- Collect the written severance, last-day, equity, bonus, PTO, retirement and benefits summaries.
- Confirm health-plan end and COBRA or Marketplace notice dates.
- Identify your state unemployment office and Dislocated Worker Unit, then note filing instructions.
- Ask about Rapid Response sessions, outplacement, employee assistance, references and employment verification.
- Record the approved way to return equipment and retrieve personal files.
Days two through seven: build a clean job-search record
- Turn your accomplishment inventory into a resume and professional profile without reproducing confidential artifacts.
- Contact trusted former colleagues individually. Share your availability and the type of work you seek, not internal layoff details.
- Set a weekly cadence for applications, networking, skills refresh, benefits administration and rest.
- Keep a log of applications and required unemployment activities so you can meet state certification rules.
- Use any employer-funded coaching, interview practice or training before its access period expires.
Help available through Rapid Response and American Job Centers
The Department of Labor describes layoff as one of the most traumatic events a person can experience and says Rapid Response teams can provide information about unemployment insurance, health-insurance options, skills upgrading and training. Depending on the state and situation, services can also include career counseling, resume preparation, interview workshops, job-search assistance, financial planning and stress-management workshops.
Attend offered Rapid Response sessions and contact your state Dislocated Worker Unit even if you expect to find another job quickly. American Job Centers can connect eligible workers with resume and interview help, training and local hiring resources. Services and eligibility vary by state, so verify the details with the office serving your location.

How managers should communicate the announcement
A useful team message separates facts from unknowns. State what has been decided, which groups or functions are affected, when individual conversations occur, where benefits information is located and when the next update will arrive. Do not publish names before individual notifications, or disclose medical information, immigration details, accommodations or performance claims to the wider team.
Route individual selection questions, accommodation requests and legal questions to HR or counsel. Give affected people a private channel for questions, an approved method to retrieve personal files and clear equipment-return instructions. Offer references and introductions where company policy allows, and point departing colleagues toward unemployment, benefits, Rapid Response and outplacement resources.
Supporting the team that remains
After departures, retained staff need operational clarity rather than reassurance that hides the workload. Reconfirm priorities, owners, on-call coverage, production risks and projects that are paused. Document ownership gaps and schedule a follow-up about workload, psychological safety and further changes.
Recommended Free Tools
Do not ask employees to speculate about who is next. Encourage one-to-one conversations for personal concerns, publish only confirmed information and correct rumors with a factual update. If a critical service lacks an owner, escalate that risk immediately instead of quietly assigning unlimited additional work.
Compare choices using the facts that affect you
| Decision | Compare |
|---|---|
| Health coverage | Monthly cost, deductible and out-of-pocket exposure, provider network, prescription continuity and election deadline. |
| Severance | Cash amount, payment timing, continued benefits, equity treatment, release scope, confidentiality and non-disparagement terms. |
| Job-search support | One-to-one coaching, resume and interview help, training budget, employer network, duration and geographic availability. |
| Communication approach | Speed, factual accuracy, privacy protection, support for affected people and continuity for the remaining team. |
Common mistakes and how to avoid them
- Assuming the announcement is your notice: obtain the individual written terms and dates.
- Waiting for benefits paperwork before acting: mark COBRA, Marketplace and unemployment deadlines as soon as you learn the coverage end date.
- Taking work home “for your portfolio”: create achievement notes from memory or approved records; never copy source code, customer data or credentials.
- Signing severance immediately: read the release and restrictions, check the deadline and obtain qualified advice when necessary.
- Posting rumors or confidential lists: use the named HR or manager channel and share only confirmed, non-confidential information.
- Ignoring emotional strain: use employee-assistance, Rapid Response, counseling and stress-management resources where available, and build rest into your weekly plan.
Bottom line
Move from rumor to written facts, then protect the deadlines that affect your health coverage and income. Expect technology access to change quickly, retain no company data, document your achievements lawfully, and use state unemployment offices, Dislocated Worker Units, Rapid Response teams and American Job Centers. If the selection or agreement raises discrimination or legal concerns, preserve the facts and obtain qualified advice promptly.
