For a HUD-assisted project, the review may proceed under Part 58 through a responsible entity or under Part 50 through HUD, depending on the program and circumstances.
First, confirm which review process governs the award
Check the award documents and ask the federal program officer or administering agency which environmental-review procedure applies. HUD’s regulations guidance explains that, for eligible HUD programs, states, tribes, and units of general local government may act as responsible entities under Part 58, while HUD conducts Part 50 reviews in applicable programs. Do not assume one route applies to every federally funded housing project.

- Record the funding agency and specific program.
- Confirm whether the review is under Part 50, Part 58, or another agency’s rules.
- Get the name and contact information of the assigned reviewer or responsible entity.
Turn “the review is delayed” into a status and action list
Ask the reviewer for a written status that identifies the selected review level, completed steps, outstanding information or consultations, required notices and comment periods, and the official responsible for the next action. Request a dated target schedule for the remaining steps. Keep a dated record of your questions, submissions, and responses.

The process begins with a description of the full project, even if HUD funds support only part of it, and the required path depends on the project’s classification. HUD’s Part 58 flowchart shows paths for an exempt activity, a categorically excluded activity, an environmental assessment, or a potential environmental impact statement.
Questions to send the reviewer
- Which agency and funding program’s rules govern this award, and who is the assigned reviewer?
- What review level has been selected, and where is that determination documented?
- What information, consultation, publication, or approval remains outstanding?
- Does the project description include connected activities and all relevant funding sources?
- What is the next decision, its target date, and the person responsible for it?
- Which contracts, expenditures, site work, or other actions must wait for clearance?
For HUD Part 58, avoid actions that could limit the review’s options
If Part 58 applies, do not commit HUD assistance or undertake or commit non-HUD funds for an action that could adversely affect the environment or limit reasonable alternatives before the required release-of-funds and certification approval. A regulatory exemption or categorical exclusion may alter what is required, but the responsible entity should document the applicable basis. Before signing a contract, spending funds, or beginning site work whose status is unclear, ask the responsible entity to confirm in writing whether the action may proceed.
This is a practical safeguard against choice-limiting actions, not a general instruction to halt every project activity. The applicable rules and any exception depend on the activity and the review determination; have the reviewer assess the specific proposed action.
Separate the release-of-funds waiting period from total review time
For Part 58, HUD or the state generally cannot approve a request for release of funds until the applicable 15-day objection period has elapsed. The period runs from receipt of the request and certification or from the date specified in the public notice, whichever is later. Objections must arrive within the applicable period and satisfy the grounds in the regulation. This is a procedural waiting period after specified steps—not an estimate of how long the complete environmental review will take.
Part 58 counts time periods in calendar days. Section 58.21 says the first day begins at 12:01 a.m. local time on the day following publication, or the notice’s mailing and posting date, as applicable. See HUD’s current 24 CFR Part 58 text and confirm the applicable notice date and current rule before relying on a deadline.

The full review may require earlier assessment, consultation, public notices, or an environmental impact statement. HUD’s Special Applications Center FAQ describes a minimum 30-day period for the particular process addressed there; it should not be treated as a schedule for other HUD programs or federally funded housing projects generally. The sources cited here do not establish an average completion time for environmental reviews.
Escalate through the contacts assigned to the program
For a HUD project, raise a stalled decision through the responsible entity’s certifying officer and the HUD program or field-office contact assigned to the grant. If the obstacle is a technical environmental-review question, ask which environmental staff member can address it. Contact routes are program-specific: HUD’s FY2026 Community Project Funding page, for example, distinguishes the overall grant contact from regional environmental staff, who provide technical assistance and coordinate Part 50 concept meetings for that program. Other HUD programs may use different contacts.

When escalating, include the award or project identifier, the review authority and level, a concise list of unresolved steps, dates of prior requests and responses, the decision or clarification needed, and the date by which it affects the project schedule. Ask the assigned official to confirm the right route if the contact is unclear.

Part 58 provides a limited administrative process for objections to a request for release of funds. The regulation identifies grounds such as a responsible entity’s failure to make a required finding, omitted environmental-assessment or impact-statement steps, or funds or activities committed before release in circumstances the regulation prohibits. A general complaint that the review is taking too long is not, by itself, one of those grounds. If you believe a regulatory ground applies, review the current rule and follow the procedure and deadline for the specific notice.
