If your HOA or condo board has not answered a repair request, first confirm who is responsible for the item, then send a dated written follow-up and keep a clear record. There is no universal response deadline or single remedy: the answer depends on your state, association documents, whether the property is a unit or common element, and the type and urgency of the problem.
First determine whether the association is responsible
Before treating silence as a refusal to repair, check the recorded declaration or CC&Rs, bylaws, maintenance schedule, property boundary descriptions, insurance provisions, and repair-request rules. For a condominium, identify whether the affected feature is inside your unit, a common element, or a limited common element such as a balcony. The declaration may allocate responsibilities differently from a general default rule.

Utah’s Division of Real Estate says a dispute over whether a failing item belongs to an owner or association is answered by the declaration and plat, not simply by statute. Its guidance describes Utah-specific boundary rules: where a wall, floor, or ceiling defines a unit boundary, finished surfaces may be part of the unit while material behind them is common area; pipes and similar features may be classified according to what they serve; and the declaration may assign limited-common-area repairs. Utah community-association guidance likewise describes association responsibility for common areas and owner responsibility for the owner’s lot, subject to the declaration and statutory exceptions. Florida’s 2024 condominium statute assigns common-element maintenance to the association, except where the declaration assigns maintenance of limited common elements to unit owners. There is no universal deadline to answer a repair request
The sources cited here do not establish a nationwide number of days in which every HOA or condo board must respond. A deadline may depend on state or local law, the association’s governing documents, or the circumstances of the defect. Do not rely on a generic online deadline unless it is supported by a current rule that applies to your location and situation.
Send a useful written follow-up
Use the association’s documented contact channel, such as its management portal or official email, and copy the manager and board if appropriate. A clear written follow-up helps establish what you reported and when; this is a practical recordkeeping step, not a universally mandated notice method.

- Describe the condition: give the location, what is failing, when it began, and any worsening or effect on neighboring property.
- Attach evidence: include relevant photos and copies or dates of earlier requests and replies.
- Identify the apparent responsibility: cite the governing-document section that seems relevant, if you have found one.
- Ask for a concrete next step: request confirmation of receipt, an inspection date, a repair schedule, or a written explanation of why the association believes the work is not its responsibility.
- Keep proof: save your message, attachments, portal confirmation, and any delivery record.
What to do if there is still no reply
Follow the association’s own complaint, meeting, or hearing process if one applies. Then check with the responsible state or local agency, or a local community-association attorney, to learn whether a complaint, mediation, arbitration, or court action is available and whether there are prerequisites or deadlines. Choose a route based on the claim, not just the lack of a response.

- Is the issue about the association’s maintenance duty, owner responsibility, insurance coverage, or damage?
- Do the governing documents require internal notice, a hearing, or a vote first?
- Does a state agency have authority over this association and this type of claim?
- Is mediation or arbitration required or available before court?
- How urgent is the condition, what evidence exists, and what deadlines or costs may apply?
Florida illustrates why the route cannot be assumed. The Florida condominium regulator says certain disputes about a unit owner’s action or inaction involving a unit or common area may qualify for arbitration under section 718.1255, but claims for damages based on an association’s failure to maintain common elements or condominium property are excluded from that arbitration category. Avoid steps that can create a second dispute
- Do not withhold assessments because the association has not responded.
- Do not deduct repair costs from dues without confirming legal authority and the governing documents with qualified local advice.
- Do not hire a contractor to alter common elements solely because the board is silent.
