Stop the brief from moving any farther. Treat every citation and material factual assertion in an AI-written legal brief as unverified until a human checks it against the official opinion, statute, court record, or another trusted primary source. Freeze publication, filing, service, and client delivery; preserve the original output; create an authority ledger; verify each item field by field; remove anything that cannot be substantiated; and, if the document was already filed or served, promptly disclose and correct the error under the court’s local procedure.
Why an apparently polished brief can be unsafe
Generative AI can produce a citation that looks perfectly conventional but points to a nonexistent case, the wrong court, an unrelated decision, or a real opinion that says something different. It can also invent quotations, attach the right holding to the wrong case, use an outdated rule, or cite a real authority that has been overruled or narrowed. A citation that exists is not necessarily a citation that supports the proposition in your sentence.

The American Bar Association identifies fabricated authorities, misquoted decisions, incorrect holdings, and wrong jurisdictions as recurring hallucination patterns. Its central warning is simple: lawyers must check AI output, especially citations and sources. The National Center for State Courts likewise advises independent verification of every citation, case, statute, rule, and material claim.

Responsibility does not shift to the software or to a junior person who pasted the text into a draft. The person whose name appears on a filing remains responsible for its accuracy. Depending on the jurisdiction and the facts, an unsupported authority can create duties of candor and diligence problems, sanctions exposure, client harm, and possible professional discipline.

The first hour: contain the problem
Freeze every use of the draft
Do not file, serve, publish, send to a client as finished work, or let another editor build on the document while its authorities are unverified. Make a read-only copy and label the working version as under verification. If the brief is in a shared system, tell the team which copy is authoritative so an old version is not accidentally submitted.
Preserve the original AI output
Save the complete prompt, model response, date, account or workspace, attached files, and any subsequent edits. Preserve the original in its native format and record who made each change. The output is not evidence, but retaining it lets you reconstruct how an error entered the brief and demonstrate a responsible remediation process.
Notify the responsible lawyer or editor
Escalate immediately to the person who will sign, file, or approve the work. Give a short factual report: which passages are questionable, whether any deadline is pending, and whether the document has been transmitted outside the team. Do not quietly replace a citation and assume the risk has disappeared.

Build an authority and fact ledger
Inventory more than the footnotes. Record every item that materially supports the argument, including authorities, quotations, docket references, statistics, procedural history, names, dates, and factual assertions about the record. A ledger prevents a reviewer from checking only the citation that first triggered concern.

Keep a copy of the ledger with the matter file. Put a source or an explicit “unverified” note beside every material claim while the review is in progress; do not allow an unsupported sentence to look final.
Verify each authority step by step
- Find the primary source. Search the official court opinion or docket, the official statute or regulation database, or a trusted legal database. A search-engine snippet, an AI summary, or a secondary blog can help locate a document but cannot establish what it says.
- Match identity fields. Confirm the exact party names, reporter volume and page or docket number, court, decision date, rule or section number, and pin cite. The Judicial AI Standards Institute’s citation checklist treats these as separate fields because an error in one can lead to an entirely different authority.
- Read the cited passage in context. Compare every quoted word with the opinion or record. Check who made the statement, whether the court adopted or rejected it, and whether a sentence has been clipped to reverse its meaning.
- Test the proposition. Write the brief’s proposition in plain language and explain, in the ledger, exactly how the cited passage supports it. A case can be genuine and still fail this test because its facts, procedural posture, or legal standard differ.
- Check later treatment. Use an established citator or equivalent official history to see whether the decision was overruled, vacated, limited, or criticized. Verify that a statute or regulation has not been amended and that the cited rule was in force on the relevant date.
- Cross-check record facts. For assertions about filings, testimony, dates, or statistics, return to the docket, transcript, exhibit, or original dataset. Do not treat an AI-generated narrative of the record as a source.
- Obtain a second human review. The signer or responsible editor should compare the corrected brief with the ledger, source documents, and original output before approval.
Classify what you find and fix it accordingly
Verified
The source exists, the identifying information is accurate, the quotation is exact, the context is fair, and the authority supports the stated proposition. Keep it, while correcting ordinary citation-format errors.

Real but miscited
The authority exists, but a party name, court, date, reporter, docket, pin cite, or rule number is wrong. Correct the citation and reread the passage; a bad pin cite may have concealed that the cited text does not support the sentence.
Real but mischaracterized
The case or statute is genuine, but the brief overstates its holding, omits a limiting fact, or presents dicta as a rule. Rewrite the proposition to match the source, add the material limitation, or remove the authority.
Fabricated or unlocated
If a diligent search cannot locate the authority in a trusted source, delete it. Do not retain a plausible-looking citation, guess at a replacement, or ask the same model to invent another case. The Eastern District of Michigan’s AI guidance specifically says that a case that cannot be found in a trusted source should not be included.

What to do when the brief has not been filed
Replace unsupported propositions with authorities you have actually read, or narrow the argument to what the verified record establishes. Remove invented quotations rather than paraphrasing them. Recheck every cross-reference, table of authorities, heading, and conclusion affected by the deletion; one fabricated case often appears in several locations.
Run a clean-document review after the substantive correction. Search for the removed case name, docket number, quotation fragments, and distinctive phrases to catch duplicates. Confirm that every remaining footnote resolves to the cited document and that the table of authorities matches the text. Keep the original output and the completed ledger, but submit only the corrected version.

If the brief was already filed or served
Act promptly and candidly. The exact filing, notice, amendment, or motion depends on the court, jurisdiction, and procedural posture; there is no single universal deadline or form. Consult the applicable local rules and the clerk’s procedures immediately.
- Confirm the scope. Determine precisely which passages, authorities, and arguments are affected and whether the error appears in attachments, exhibits, a table of authorities, or a related filing.
- Alert the responsible lawyer. Do not wait for the opposing party or court to discover the problem, particularly if a hearing, response deadline, or decision is imminent.
- Notify the court and opposing counsel as appropriate. Identify the affected passages, explain that the authority was unsupported or misstated, and provide corrected authorities or withdraw the assertions. Follow local requirements for a notice, amended filing, motion for leave, or other remedy.
- Correct the public record. File the procedurally proper document rather than silently uploading a replacement. Ask whether the court requires a redline, a clean copy, an affidavit, or a separate explanation.
- Document remediation. Preserve the ledger, source documents, communications, and dates of discovery and correction. Record who reviewed the final version and what preventive control was added.
Candor is safer than concealment. A prompt, specific correction does not guarantee that sanctions or other consequences will be avoided, but withholding a known error can compound the problem.
Professional responsibility and court-specific rules
Ethical duties apply regardless of whether research was delegated to a colleague, outsourced, or generated by software. The ABA connects hallucinated authorities with duties of diligence and candor and warns of sanctions and possible discipline. A human must independently ensure that a filing is accurate.
Some courts state that obligation expressly. New York Courts’ Part 161 provides: “Accordingly, any attorney or party who uses an artificial intelligence tool, as defined in 22 NYCRR 161.2(a), in preparing any paper, as defined in 22 NYCRR 161.2(b), filed in or submitted to this court or served on another party in a case before this court is required to carefully review the paper and independently ensure that it contains no fabricated or fictitious cases, statutes, or other material.” Check the rules and standing orders for the court in which the document will be filed; requirements vary by jurisdiction and change over time.
How common are these errors?
Available studies show why a legal-product label or retrieval feature is not a substitute for review, but their figures are not a universal error rate for every model or matter. A 2024 arXiv evaluation of leading legal-AI tools reported hallucination rates from 17% to 33% under its test conditions. A 2026 arXiv benchmark reported more than 1,000 filings containing fabricated citations and released a dataset of 1,300 brief excerpts with injected errors. The populations, prompts, and definitions differ, so apply the findings as risk signals rather than predictions about a particular brief.
A safer AI-assisted briefing workflow
Before prompting
- Define the jurisdiction, date range, court, and issue.
- Supply authoritative documents when the tool must summarize a record.
- Instruct the system to say it cannot locate a source instead of guessing.
After generation
- Run the authority ledger before any stylistic editing.
- Read every cited opinion, statute, rule, and record passage yourself.
- Separate “citation exists,” “citation is correctly formatted,” and “citation supports this proposition.”
- Have the signer or another qualified reviewer perform a final human sign-off.
For repeatable quality control
- Use a standard checklist covering identity, quotation, holding, currency, and record support.
- Require stable document links, docket or reporter information, and pin cites in the matter file.
- Retain prompts, outputs, source documents, ledgers, and correction history.
- Train staff that an AI draft is a starting document, never evidence or an authority.
A practical decision rule
If you can open the underlying document, match its identity, read the relevant passage, confirm the proposition in context, and establish current status, the authority may remain after human review. If any of those steps fails, mark the item unresolved and remove it from the filing until a qualified reviewer resolves it. When the document has already left the office, pair that same verification work with prompt disclosure and the court’s prescribed correction process.
