Do not treat a utility’s “no” as a complete answer. Get the constraint, available megawatts, upgrade plan, dates, costs, and remaining approvals in writing; then compare a staged connection, flexible load, onsite supply, efficiency measures, or another site against the same reliability and schedule requirements. The right choice depends on the utility, state, transmission or distribution process, and engineering facts for your project.
Turn the utility’s answer into a documented constraint
A verbal statement that “there is no more power” can describe very different problems. The limit might be a distribution feeder, substation transformer, transmission path, generation adequacy, a study queue, protection requirements, or a tariff condition. Each leads to different remedies and timelines.

Ask the utility’s account, planning, and interconnection contacts for a written response that answers these questions:
- What is the limiting element or rule: distribution, substation, transmission, generation adequacy, protection, study capacity, or something else?
- How many megawatts (MW) can be served today, and how many can be served at each proposed construction phase?
- What is the earliest service date for each additional increment?
- Which network, substation, generation, protection, or communications upgrades are required?
- What studies, permits, regulatory approvals, and design reviews remain?
- What is the estimated cost of each upgrade, and which costs would the customer, utility, or another party pay?
- Could a smaller initial service, ramp schedule, interruptible service, or non-firm arrangement be offered under the applicable tariff?
- Which transmission or distribution process and, where relevant, which regional transmission organization or independent system operator (RTO/ISO) governs the request?
These are diligence questions, not a promise that every utility offers every option. The Federal Energy Regulatory Commission (FERC) large-load docket specifically raises study timing, flexibility and curtailment, upgrade cost allocation, and reliability for a power plant serving a colocated large customer. Review the docket at FERC RM26-4-000.

Build one load and reliability brief before negotiating
Utilities, engineers, lenders, and regulators make different assumptions when a project presents inconsistent forecasts. Create one controlled load brief and use the same version in every meeting.
Describe the electrical requirement
- Existing connected load and measured peak, if the facility is operating.
- Requested peak MW, expected average MW, power factor, and planned energization dates.
- Each construction phase, including the date and MW of the next increment.
- Critical loads that cannot be interrupted and workloads that can be delayed, throttled, or moved.
- Minimum dependable capacity needed for the business case, separate from nameplate or aspirational capacity.
- Required voltage, redundancy topology, backup duration, ride-through requirements, and restoration expectations.
Separate firm service from flexible service
State whether each MW is required as firm capacity or could be curtailed. For every flexible block, document the maximum reduction, response time, minimum run or curtailment duration, notice period, frequency of events, and recovery behavior. A claim that a workload is “flexible” is not useful until the utility or grid operator can model those characteristics.
Ask which process applies
Large-load thresholds and procedures differ by utility, tariff, state, and RTO/ISO. FERC’s large-load advance notice of proposed rulemaking (ANOPR) treats loads generally above 20 MW as large for that proceeding, but that figure is not a universal interconnection threshold. Confirm the governing process in writing rather than assuming a federal category controls your project.

A staged grid connection may preserve some project value while network work proceeds. Ask for a lower initial capacity that can be energized safely, followed by defined increments after specific upgrades or study milestones.
What a workable stage plan contains
- Initial service level: the firm and, if applicable, interruptible MW available on the first energization date.
- Milestones: study completion, equipment orders, construction completion, testing, and regulatory approvals tied to each later increment.
- Conditions: protection, power-quality, operating, telemetry, and curtailment requirements for every stage.
- Dates and responsibility: who performs each upgrade, who pays, and what happens if a date slips.
- Commercial treatment: deposits, demand charges, stranded-asset exposure, and termination or delay rights.
A staged connection does not create grid capacity by itself. It works only if the studies, tariff, construction schedule, and utility commitments support it. FERC’s large-load docket identifies faster studies and upgrade treatment as policy questions, not automatic customer rights.

Can we get power sooner if we agree to be curtailed?
Possibly, but do not assume that curtailment guarantees faster interconnection. FERC’s docket asks whether flexible or curtailable loads should receive different study treatment; it does not establish a universal expedited path.
Define the operating bargain
Ask the utility or RTO/ISO whether an applicable demand-response, interruptible-service, or other flexibility program exists. Obtain the rules for notice, telemetry, testing, event frequency, maximum duration, performance measurement, penalties, and compensation. Model the operational and financial effect of every called event, including the time needed to restore workloads.
Recommended Free Tools
FERC states that “Effective demand response can help reduce electric price volatility, mitigate generation market power, and enhance reliability” on its Demand Response page. That statement describes system benefits; it does not promise that a particular data center will receive an earlier connection or payment.
Make flexibility measurable
- Identify the applications, racks, cooling systems, or batch jobs that can be reduced.
- Specify the MW reduction at the meter, not merely an internal IT percentage.
- Document response time, minimum duration, maximum annual hours, and recovery ramp.
- Test controls and telemetry under the same conditions required by the program.
- Calculate lost output, service-level effects, labor, and restart costs before accepting compensation.
Can we bring our own power or connect to a nearby generator?
Onsite generation, batteries, and hybrid microgrids can provide energy or capacity, bridge a utility-service delay, or support a flexible operating plan. They are engineering and regulatory projects, not simple substitutes for a utility connection.
Onsite generation checklist
- Fuel supply, storage, transport, and price-volatility exposure.
- Generator availability, maintenance intervals, spare parts, and black-start capability where required.
- Emissions limits, air permits, noise rules, water use, and local environmental approvals.
- Protection coordination, controls, synchronization, islanding, and safe reconnection.
- Interconnection studies and any transmission, distribution, retail-service, or standby requirements.
- Operating expense, testing fuel, staffing, insurance, and the risk of stranded equipment if grid service arrives sooner.
Battery and hybrid systems
A battery can cover short-duration peaks, ride through disturbances, or reduce the grid peak. Size it against a stated MW and duration requirement, then check fire protection, thermal management, degradation, augmentation, warranty limits, inverter controls, and permitting. A battery that can discharge for one hour is not equivalent to firm generation for a multiday fuel or transmission outage.

Co-location with generation
Sharing a site with an existing generator may change the transmission-service, retail-service, and reliability questions, but it does not eliminate them. FERC’s December 18, 2025 order directed tariff changes in PJM for loads colocated with generation, including transmission-service choices. The applicable tariff and service must be checked for the specific location; a PJM approach cannot be generalized to another region. See the FERC PJM co-location fact sheet.
FERC identifies co-location and behind-the-meter arrangements as requiring explicit reliability and cost-allocation treatment. Confirm who is responsible for balancing, outage coordination, transmission charges, metering, protection, and emergency operations before treating a nearby generator as available capacity.
Reduce the connection you actually need
Demand-side changes can lower peak MW or postpone a later increment. Have qualified electrical, cooling, and data-center engineers examine:
- Cooling set points, air- and liquid-cooling controls, and thermal storage.
- Power-conversion efficiency, UPS operating modes, and distribution losses.
- Workload scheduling, geographic shifting, batch processing, and utilization controls.
- Rack-density assumptions and the timing of high-density deployments.
- Whether the planned ramp reflects contracted demand or a long-term possibility.
Present the result as a verified load-shape revision, not as a generic efficiency percentage. The available sources do not establish a universal reduction, payback, or schedule benefit. Re-run protection, fault-current, cooling, and reliability studies after any material change.
Compare another site or utility territory
If land, permits, or construction have not made the location irreversible, compare alternatives using verified service evidence rather than regional headlines about abundant power.

- Firm MW available at each required date and the utility’s documented ramp schedule.
- Transmission and distribution upgrades, construction lead times, and cost allocation.
- Tariffs, demand charges, standby rates, and exposure to curtailment.
- Generation access, fuel logistics, emissions limits, water and cooling resources.
- Fiber routes, workforce, permitting, community acceptance, and emergency access.
- Redundancy options and the ability to serve critical loads during an outage.
Obtain written utility studies or service commitments for each candidate parcel. A state-level surplus or a nearby power plant is not proof that a particular site can be energized on your schedule.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Use one decision model for every option
Score the grid-only plan, staged service, flexible load, onsite supply, efficiency measures, and relocation against identical assumptions. A simple comparison table keeps a low-cost but unreliable option from appearing superior.
| Decision axis | Questions to answer |
|---|---|
| Dependable capacity | How many MW are dependable at each date, and what ramp rate is contractually or technically supported? |
| Service firmness | Is service firm, interruptible, or non-firm? Under what notice, duration, and frequency can curtailment occur? |
| Schedule | What are the interconnection, equipment, construction, permitting, and commissioning dates, including contingencies? |
| Cost and risk | Who funds upgrades? Include tariffs, demand charges, fuel, operations, maintenance, deposits, and stranded-asset exposure. |
| Reliability | What redundancy, outage performance, black-start or islanding capability, and backup duration are delivered? |
| Environmental fit | Are fuel availability, emissions, carbon-free matching goals, water, noise, and local permits acceptable? |
| Rule availability | Is the arrangement allowed under the applicable state, utility, and RTO/ISO rules today? |
DOE’s large-load rate-design brief highlights fair cost allocation, the risk of underused utility investments, resource adequacy, risk-sharing for newer technologies, carbon-free matching, and onsite generation. It does not rank one arrangement as best for every project.
What the U.S. regulatory picture means in 2026
FERC large-load docket
The RM26-4-000 page describes an ANOPR process considering possible reforms for large loads connecting to the interstate transmission system. Questions include whether flexible or curtailable loads could move faster through studies, who pays for grid upgrades, and how reliability should be assessed when an existing generator serves a new customer at the same location. These are proposals and questions, not an established entitlement to service.
Actions reported in 2026
On April 16, 2026, FERC said it intended to act on the docket by June and quoted Chairman Laura V. Swett: “Our nation stands at a pivotal moment as we face rapid growth in demand from data centers and other large-scale consumers that are reshaping our transmission landscape.” The release is available at FERC’s April 16 announcement.
Best Value
FERC’s June 18, 2026 announcement reported show-cause orders to six RTOs/ISOs concerning large-load tariffs. The cited materials do not establish the final disposition of RM26-4-000 by October 13, 2026. Check the docket and the governing tariff before relying on a purported new right or timeline. See FERC’s June 18 release.
Do not confuse generator-queue statistics with data-center service
FERC Order No. 2023 addresses generator interconnection, not a guaranteed route for a data-center load request. FERC’s explainer describes the first-ready, first-served cluster process and reports that, at the end of 2022, more than 10,000 active U.S. generation interconnection requests represented over 2,000 GW. It also says 68% of 2,179 interconnection studies issued in 2022 were late. Those historical figures describe generator queues, not the status or wait time of a particular data-center load. Read FERC’s interconnection explainer.
DOE roadmap targets are not guarantees
The Department of Energy’s Distributed Energy Resource Interconnection Roadmap sets 2030 targets of a median request-to-agreement time under 140 days for large distributed-energy projects above 5 MW and a queue-to-agreement completion rate above 85% for that category. These are roadmap targets, not current observed performance or guaranteed timelines for transmission-level data-center loads.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsA practical escalation plan
- Week one: appoint one owner for the utility process, freeze the load brief, and request the written constraint and data listed above.
- Weeks two to four: have electrical, cooling, controls, permitting, and finance specialists validate staged service, flexibility, onsite supply, and load-reduction assumptions.
- Study phase: obtain written scopes, deposits, milestones, and cost-allocation terms; ask what information would change the study result.
- Commercial decision: compare options using dependable MW, outage consequences, total cost, schedule risk, and exit exposure rather than headline capacity.
- Approval gate: do not order major generation, storage, or site infrastructure until interconnection, permits, protection, fuel, and tariff conditions are documented.
- Operating readiness: test curtailment controls, backup systems, telemetry, restoration procedures, and communications before accepting a flexible or staged service.
Common mistakes that make a power denial worse
- Accepting “no capacity” without identifying the constrained equipment or rule.
- Using one optimistic peak forecast for the utility and a different forecast for investors or designers.
- Assuming a nearby generator, battery, or microgrid bypasses tariffs, permits, protection, or reliability obligations.
- Promising curtailment without quantifying MW, response time, duration, and recovery.
- Treating a federal proposal, agency target, or historical generator-queue statistic as a binding data-center timeline.
- Comparing sites by regional generation headlines instead of written service studies.
- Counting nameplate generation or battery energy as dependable capacity without accounting for fuel, outages, degradation, and duration.
Bottom line for the project team
The next move is disciplined fact-finding: document the limiting constraint, map available MW and dates, and obtain the upgrade, cost, study, and approval path in writing. Then test staged service, measurable flexibility, onsite or colocated supply, demand reduction, and relocation against the same reliability and schedule requirements. Regulatory changes in 2026 may alter large-load treatment, but only the applicable utility, tariff, jurisdiction, and engineering studies can establish what your data center can actually receive.
