What to Do If You’re Accused of Sexual Assault at a New York College

First, find out which process is underway and get the written allegations, applicable policy, deadlines, and evidence-review rules. A New York college conduct case, a federal Title IX grievance process, and a police investigation can be separate tracks. Preserve relevant material, avoid contacting the reporting person or witnesses about the allegation, and consult an independent New York attorney—especially before an interview or written response.

What should you do first?

Start by identifying who contacted you and what they are asking you to do. A notice from a college conduct office is not the same thing as a Title IX notice or a request from law enforcement; more than one process may be underway at once.

  1. Save the notice and note every deadline. Keep the original email, letter, attachments, and envelope if one was mailed. Record the sender, date received, meeting dates, and any response deadline.
  2. Ask the school to identify the process in writing. Request the written allegations, the policy and version being applied, the procedural schedule, evidence-review method, interim restrictions, and appeal rules. Ask who your contact person is and how to submit questions or materials.
  3. Preserve potentially relevant material in its original form. Do not delete, edit, or selectively publish messages, photos, calendar entries, or other records. Ask a lawyer how to handle material that may be relevant; do not try to investigate by pressuring other people.
  4. Do not contact the reporting person or witnesses about the allegation. Avoid direct messages, social media, and asking friends to make contact on your behalf. Do not post about the matter online.
  5. Speak with an independent New York attorney before giving a substantive response. Seek advice from someone experienced in college discipline; if police or prosecutors are involved, seek criminal-defense advice before answering their substantive questions. A lawyer can help assess how the campus and criminal matters may interact.

These are prudent general steps, not a universal legal protocol or a substitute for case-specific advice. The applicable college policy and the circumstances of the allegation matter.

Which process might be involved?

There is no single procedure for every New York college accusation. State campus requirements, a college’s own conduct code, a federal Title IX grievance procedure, and the criminal justice process may each be relevant. A campus outcome or statement should not be assumed to decide a separate criminal matter.

Track Who administers it What governs it What to clarify
College conduct matter The college’s conduct office or another designated school official. New York Education Law Article 129-B where applicable, together with the institution’s current code and procedures. Allegations, deadlines, access to evidence, advisor’s role, interim measures, possible school sanctions, and available appeal.
Federal Title IX grievance process The college’s Title IX coordinator and other officials assigned under its procedures. The federal Title IX framework applies only when the matter falls within that framework, alongside applicable school procedures. Whether the school has designated the matter as a Title IX grievance case, which regulation and policy apply, how evidence is reviewed, and how questioning and appeal work.
Criminal investigation or case Police, prosecutors, and, if charges proceed, the courts. Criminal law and criminal procedure, separate from the college’s conduct rules. Whether law enforcement is seeking an interview or other response, and how to obtain criminal-defense advice before answering substantive questions.

New York’s Office for the Prevention of Domestic Violence advises people seeking details about a particular college’s policies and procedures to contact that school directly. Ask for the current written documents rather than relying on a general description or another institution’s rules.

What protections does New York law provide in a campus case?

New York Education Law Article 129-B, commonly called “Enough is Enough,” establishes statewide campus-response requirements for covered institutions. Its framework includes notice, an opportunity to offer evidence and witnesses, an advisor of choice who may assist and advise a reporting individual, accused person, or respondent through the conduct process, and at least one level of appeal.

The law uses “accused” for a person accused before entering the institutional process and “respondent” for a person who has entered it. The terminology does not by itself establish what happened or predict an outcome.

These statewide protections do not mean every college uses the same hearing format, evidence rules, questioning method, schedule, or advisor role. Get the school’s current policy and written procedure, then compare the notice you received with those documents. Ask the school to explain any term or step you do not understand.

What is the federal Title IX status as of October 3, 2026?

As of October 3, 2026, the U.S. Department of Education says the 2024 Title IX final rule was vacated by a federal district court on January 9, 2025, and that the 2020 regulations are again the basis for its Office for Civil Rights enforcement. The Department announced on September 28, 2026 that it formally rescinded the 2024 rewrite and reinstated the 2020 regulation in the Code of Federal Regulations. This is a date-specific status: regulations and court orders can change, so verify the current position when relying on it.

For covered postsecondary Title IX grievance procedures, the 2020 rule materials describe written notice, an advisor of choice, an opportunity to present and review evidence, a live hearing with advisor-conducted questioning, a written determination, and an equal opportunity to appeal. Those procedures do not automatically apply to every campus accusation. Ask the Title IX coordinator whether the school is treating your matter as a federal Title IX grievance case and which current procedures it will use.

How should you prepare for a school meeting or response?

Before a meeting or written submission, organize the notice, policy, timeline, and relevant material for your attorney to review. Do not assume that a deadline can be extended or that a school will accept a particular form of response; ask the designated school contact about the procedure and get important answers in writing.

  • Ask what the meeting is for, who will attend, whether it is recorded, and whether you may bring an advisor.
  • Ask when and how you may inspect or receive the evidence the school will consider, and how to submit your own evidence or identify witnesses.
  • Ask whether any interim restriction is in place, what it requires, and how to seek a review or modification under the school’s rules.
  • Ask how findings are communicated, what review or appeal route exists, and the deadline for using it.

An advisor of choice is part of the New York statutory framework, but the precise permitted role depends on the applicable procedure. Confirm the advisor rules with the school rather than assuming that an advisor may speak or question witnesses in every kind of meeting.

What if police or prosecutors contact you?

Treat law-enforcement contact as a separate matter from a campus notice. Promptly seek criminal-defense advice before answering substantive questions, agreeing to an interview, or providing a written account. The available statewide campus materials establish that institutional and criminal processes are distinct; they do not supply a universal rule for coordinating an individual case. Your attorney can advise you on the facts and the interaction between the proceedings.

Where can you get school-specific guidance?

The New York State Office for the Prevention of Domestic Violence’s “Enough is Enough” guidance points readers to their particular college for its policies and procedures. The state page also identifies rape crisis programs that support survivors; it is not, on the information available there, an accused-student legal referral service. For advice about your rights or response, seek an independent attorney whose experience fits the campus process and, if applicable, criminal-defense issues.
