First identify where the case is stuck. An employer’s petition may be pending with U.S. Citizenship and Immigration Services (USCIS), while a worker applying abroad may have a separate visa application at a U.S. consulate. Those stages use different status systems, deadlines and remedies. Check the receipt, notice or interview paperwork before taking action.
The practical sequence is: verify the agency and case status, read the latest notice in full, meet any evidence deadline, use an inquiry only when the agency’s rules allow it, and obtain individualized legal review when a denial or refusal turns on facts your employer or you cannot easily correct.

Start by locating the delay or denial
“Work visa” can describe several different steps. A U.S. employer generally files a petition with USCIS; the worker may then apply for a visa stamp at a U.S. embassy or consulate if a visa is required to enter. A pending USCIS petition is not the same thing as a pending consular visa application. A consular refusal does not automatically mean USCIS denied the underlying petition.

- USCIS case: petition or application status, requests for evidence (RFEs), approval notices and denial decisions are handled through USCIS tools and notices.
- Consular case: a visa interview, a refusal under section 221(g), document submission or administrative processing is handled by the Department of State (DOS) and the particular consular post.
Do not treat a case that says “refused” in the Consular Electronic Application Center (CEAC) as necessarily final. DOS says CEAC can display “refused” while administrative processing is underway; the status can change if eligibility is later established or outstanding issues are resolved.
If your USCIS petition or application is still pending
1. Check the case with the receipt number
Use USCIS Case Status Online with the receipt number printed on the I-797 receipt notice. Confirm that USCIS has your current mailing address and, where applicable, the correct email and phone details in your account. A missed notice can create a separate deadline problem, so keep copies of every notice and status update.
2. Read the processing-time result correctly
USCIS’s processing-time tool requires the correct form, category and office. Its displayed time represents how long USCIS took to complete 80% of adjudicated cases during the previous six months. That is a population measure, not a promise that your case will be decided by that date.

USCIS uses a different 93% completion measure to calculate the case-inquiry date. When the tool says your case is outside normal processing, it may provide a date on which an inquiry is permitted. If your form type is not listed, USCIS says the default inquiry threshold is more than six months pending. This threshold authorizes a question about the case; it is not an adjudication deadline and cannot compel an approval.

3. Submit an inquiry only when eligible
If the displayed inquiry date has passed, use USCIS’s online case inquiry channel or the contact route specified for your form. Include the receipt number, petitioner or applicant name, form type, filing date and a concise description of the problem. Save the confirmation number. Do not submit duplicate inquiries simply because the first response is slow; duplicate contacts can make it harder to track the substantive issue.
4. Preserve the evidence trail
Keep the receipt notice, the complete petition or application copy, any RFE, the response sent to USCIS, delivery proof and screenshots of status changes. USCIS notes that workload, staffing, policy, operations and the time needed to review a response can affect duration. A recent RFE response or an online update may indicate active processing rather than a lost case.
5. Respond to an RFE completely
An RFE is not a denial. Follow the notice’s deadline and submission instructions, organize the response to match each numbered request, and retain the exact version sent. For an IT professional, that may involve employer evidence, role and project details, degree or experience records, or other documents named in the notice. Do not send unrelated material that obscures the requested proof. If the deadline has passed, obtain advice tied to the notice instead of assuming a late response will be accepted.
If USCIS has denied the petition or application
Read every page of the decision. Identify the filing party (often the employer), the legal and factual reason for denial, and any instructions about a motion or review. Procedural rights differ by form and decision, so there is no single USCIS appeal deadline or universal appeal route that applies to every work-related filing.

Who controls the case matters. If the employer filed the petition, the employer or its authorized representative generally receives and controls the petition-side response. The worker may need the employer’s cooperation to obtain the filing record or decide whether a new filing is practical. A denial of a petition is not the same as a consular visa refusal, and a new petition may not cure the reason for the original decision.
Because the correct remedy depends on the exact form and notice, have an immigration lawyer evaluate the decision before choosing among a motion, an authorized review option, a new petition or a different visa strategy. Counsel cannot guarantee approval or force USCIS to finish faster, but can identify the controlling deadline and whether the stated defect is curable.
If the consulate refuses the visa under 221(g)
What 221(g) means
DOS explains that a 221(g) refusal means the consular officer has not found the applicant eligible at that stage. The cause may be missing or incomplete documents, or administrative processing. The refusal sheet should tell you which situation applies and what the post wants next.
When documents are requested
Follow the refusal letter and the consular post’s submission method exactly. Upload or deliver a complete response as soon as the requested records are available, and keep the upload receipt, courier confirmation or other proof. DOS states that an applicant has one year from the refusal to provide requested additional information. If that one-year period expires, the applicant must apply again and pay another application fee.

When the case is in administrative processing
There is no reliable universal duration. DOS states: “The duration of the administrative processing will vary based on the individual circumstances of each case.” The officer may later determine that you qualify, or may conclude that you remain ineligible. Avoid booking non-refundable travel or setting a start date that assumes a particular completion day.
DOS guidance says applicants should generally wait at least 180 days after the interview or the submission of supplemental documents, whichever is later, before making a routine administrative-processing inquiry. The stated exception concerns emergency travel involving serious illness, injury or death in the immediate family. The 180-day point is guidance on when to ask for a status update, not an estimate that a decision will arrive then.
Use the consular post’s instructions
Each post can specify its own document-submission channel and contact form. Use the instructions on your refusal sheet and the post’s current website, rather than a checklist from a different country or visa category. Keep the case number, interview date and copies of all submissions together so an inquiry can be precise.
Can you appeal a U.S. work-visa denial?
For a consular visa refusal, DOS’s answer is direct: “There is no appeal process.” A 221(g) document request is handled by supplying the requested information within the one-year period; it is not an appeal. If the refusal remains, the normal alternative is a new application that addresses the refusal ground, with a new fee.
Best Value
USCIS petition decisions are different. The decision notice may describe a motion or other review mechanism, but the available procedure and deadline depend on the form and the person or entity entitled to file. Do not assume the worker can file personally when the employer was the petitioner, and do not use consular appeal guidance for a USCIS decision.
Can you reapply after a refusal?
Often, yes, but reapplication is not a reset button. A new visa application normally requires a new application and another fee. The new filing should address the specific refusal basis with materially stronger or corrected evidence; repeating the same record can lead to the same result.
Before reapplying, compare the refusal sheet with the petition approval, employment details and supporting documents. Confirm that the job, employer, qualifications and intended travel still match the records. If the issue is a missing document, provide it through the 221(g) route within one year when that route remains open. If the issue is a substantive ineligibility, obtain case-specific legal advice before spending another fee.

| Consular 221(g) document request | DOS allows one year from refusal to provide additional information. | Follow the post’s instructions and submit the complete documents promptly. |
| Consular administrative processing | Duration varies by individual circumstances; routine inquiries are generally advised after 180 days, subject to the emergency exception. | Wait the stated period, then contact the post with the case number and interview or submission details. |
| Final consular refusal | There is no appeal process. | Evaluate a corrected new application and fee, or obtain individualized advice before reapplying. |
Build a practical delay plan with your employer
- Ask the employer’s immigration contact which receipt number and filing stage controls your start date.
- Separate petition approval from visa issuance and entry; an approval notice does not itself place a visa stamp in your passport.
- Agree on a backup start date, remote-work or transfer plan only if those arrangements comply with the employer’s immigration advice and applicable work authorization.
- Keep one dated folder containing notices, submissions, delivery evidence and agency responses.
- Escalate promptly when a notice deadline, the 221(g) one-year period or a passport/travel constraint is approaching.
Do not pay anyone who promises to accelerate a consular administrative-processing case or reverse a refusal. The official measures above are status and inquiry rules, not guarantees of speed or approval.
When individualized legal review is worth the cost
Consider a qualified U.S. immigration lawyer when the denial alleges fraud, misrepresentation, inadmissibility or a complex eligibility problem; when the employer will not provide the petition record; when a USCIS decision offers a motion or review option; when a 221(g) request is extensive or ambiguous; or when the one-year response period or another notice deadline is close. Bring the complete notice, petition or application copy, prior immigration history and every submission receipt. Ask the lawyer to identify the filing owner, controlling deadline, realistic remedy and risks of reapplying.
Legal review is not a substitute for the agency’s process. It can clarify which process applies and prevent an avoidable missed deadline, but no representative can promise a visa, waive a statutory ineligibility or guarantee a particular processing time.
The Bottom Line
Identify whether USCIS or a consulate has the case, follow the exact notice, and treat every timing figure as guidance rather than a promise. Supply 221(g) documents within one year, wait the Department of State’s recommended 180 days before routine administrative-processing inquiries, and remember that consular refusals have no appeal; reapplication requires a new case and fee.
