If you think your appointment was recorded or transcribed without your consent, first find out exactly what data was captured and how it was used. Write down what you observed, ask the provider for a written account, state that you do not want the tool used at future visits, and check the clinical note for errors. Whether the lack of explicit consent broke a rule depends on where you are, the purpose and method, and what happened to the data; discovery alone does not prove a violation.
What to do first
- Record what you observed. Note the appointment date, what suggested recording or transcription, what the clinician said, and any wording in your visit note that suggests you agreed. Keep relevant messages and screenshots. A visible timer or recording indicator does not establish that an audio file was retained.
- Write to the clinic’s privacy contact or records office. Ask for an explanation of what happened and the applicable privacy notice and complaint process. Request the information listed in the next section, and keep a copy of your request and the response.
- Set your preference for future visits. Tell the provider plainly that you do not want an ambient scribe or recording used and ask for the appointment to proceed without it. Ask for your preference to be recorded in the appropriate place. NHS England’s patient guidance says a patient can ask for an ambient scribe not to be used and that the professional should respect the choice.
- Review the resulting record. Request the clinical note and ask whether any transcript or recording is accessible under the rules and policies that apply to you. Check for errors, including a statement that you consented if you did not.
- Use the relevant complaint route if needed. Start with the organization’s formal privacy complaint process, or use it alongside a complaint to the regulator with authority where you live.
Was my doctor recording me, or did an AI scribe transcribe the visit?
These are not interchangeable. A conventional recording creates an audio or video file. An ambient scribe may capture speech for transcription and produce a summary, draft letter, or draft clinical note; the service may process speech without leaving a persistent audio file for the clinic or patient. A final note in the medical record is another distinct item.

Ask the provider to explain each stage: what was captured, whether an audio source file exists, how transcription or summarization was done, whether a clinician reviewed the output, what entered your health record, and how long each item is kept. NHS England warns that ambient-scribe outputs can contain errors and says staff must check the notes or letters before adding information to the record.
What to ask the provider
Send specific questions rather than asking only whether you were “recorded.” You can adapt this list:

- Was audio or video recorded, or was speech captured for transcription without a retained recording?
- Was an AI ambient scribe used? What vendor or service processed the information?
- What was the purpose? Was the audio, transcript, or other information used for another purpose, such as product development or model training?
- Which items became part of my clinical record? Can I access the transcript, draft, or source file under the applicable rules?
- Who could access each item, and was anything shared outside the care organization?
- How long is each item retained? Can a separate audio file or draft be deleted, and what policy governs that?
- Does my chart or visit note say I agreed? If so, what is the basis for that entry, and how can I challenge inaccurate documentation?
- How can I register my objection for future appointments and submit a formal privacy complaint?
Access and deletion rights can differ by location and by data type. Ask the provider to identify the policy or rule behind its answer rather than assuming that every file is part of the medical record or can be erased on request.
Does recording or transcription without consent mean the provider broke the law?
Not necessarily. Consent requirements depend on jurisdiction, purpose, notice, the technology used, and whether information was retained or shared. The guidance below addresses specific settings; it is not a complete account of every country’s or US state’s recording and privacy laws.

Can I ask for the recording to be deleted or get a copy?
Ask separately about the audio source file, transcript, generated summary, draft note, and final clinical note. Their retention and access rules may differ. Do not assume that an underlying audio file is part of an accessible medical record, or that a patient can require its deletion; the answer depends on the applicable law, record type, and provider policy.

That does not guarantee access to every transient or separately held audio file. Ask the records office to identify what is in the designated record set and how to submit an access request.

What if my medical note says I consented?
Ask the provider to identify the entry and challenge it through the records office’s correction or amendment process. State what is inaccurate and what wording you believe would accurately describe what happened. Keep your request and the provider’s response.
Under HIPAA, a patient may request an amendment to inaccurate information. The provider must respond; if it denies the request, the patient may submit a statement of disagreement for inclusion in the record. This is a right to request an amendment, not a guarantee that the provider must delete or replace the original entry.

How to escalate a privacy complaint
United States
You can submit a written complaint to HHS’s Office for Civil Rights (OCR) alleging a HIPAA or 42 CFR Part 2 privacy, security, or breach-notification violation. Identify the organization and describe what happened and when. The usual filing window is 180 days from when you knew the act or omission occurred; OCR may extend it for good cause. OCR’s authority is limited to entities and allegations covered by those rules, so not every organization handling health-related information is within its jurisdiction.

Use the privacy regulator, health ombudsman, or professional regulator with authority where the appointment took place. The right agency and any filing deadline depend on that location and the facts, so a single non-US complaint portal or deadline cannot be specified here.
