If you learn that your medical records may have been exposed online, verify the notice through a phone number or website you already trust, then secure any affected accounts and look for signs that someone has used your information. An exposure does not by itself prove identity theft. If you find unfamiliar care, prescriptions, bills, or medical debt, get your records and dispute errors in writing.
1. Verify the notice without replying to a stranger
An unexpected call, email, or text about a breach can itself be a phishing attempt. Don’t click its links or provide health, identity, or account details in response. Instead, open the provider’s or insurer’s known website yourself, or call a number from a card, bill, or other trusted source. The FTC recommends using a known-good contact route rather than responding to an unexpected message (FTC guidance on medical identity theft).

Ask the organization whether your information was involved, what types of information were affected, when the exposure occurred, what it has done in response, and where to report suspicious activity. Keep the notice and record the dates, names, and case numbers from your conversations.

If you suspect someone got into an online account—not merely a copy of records—visit its official website or app, change the password, and choose a unique password you do not use elsewhere. Turn on multifactor authentication if the service offers it. Changing a password can help protect the account going forward, but it cannot retrieve or erase records that were already exposed.

Review mail, insurer messages, bills, and account statements for activity you do not recognize. The FTC identifies these as warning signs:
- A bill or explanation of benefits for care or prescriptions you did not receive.
- A collection notice for medical debt you do not owe, or unfamiliar medical debt on a credit report.
- A notice that you have reached a health-plan benefit limit when you have not used the benefits.
These signs call for investigation; they are not, on their own, proof of who used your information. The FTC lists these indicators in its medical identity theft guidance.

Use a delivery method that confirms receipt, and keep copies of what you send and receive.

The FTC says a provider must respond to a correction request within 30 days and notify other providers that may have the same mistake. If a provider refuses access because another person’s information has been mixed into your file, the FTC advises appealing through its privacy contact, patient representative, or ombudsman (FTC guidance).

5. Check credit reports and dispute suspicious bills
Get your credit reports through AnnualCreditReport.com and check for medical collections you do not recognize. If you find suspicious medical billing or collection information, report the billing errors to all three credit bureaus through the recovery process at IdentityTheft.gov. The FTC’s medical identity theft guidance explains these steps.
6. Choose the right place to report the problem
The right complaint route depends on who held the information and what happened. A privacy complaint is not a substitute for contacting the organization, correcting a record, or disputing a bill.

|---|---|---|
| You suspect someone used your medical identity. | IdentityTheft.gov | Use it to create a recovery plan; the FTC also directs people to report billing errors to all three credit bureaus through this process. |
| You allege a HIPAA or Part 2 violation by a regulated entity, such as a health plan or covered provider. | HHS Office for Civil Rights (OCR) | OCR accepts written complaints, including through its online portal. Name the entity and describe the alleged violation. Generally, file within 180 days of learning of it; OCR may extend the period for good cause. |
| A non-HIPAA app or health-data business mishandled your information. | Federal Trade Commission (FTC) | Some consumer health-data businesses outside HIPAA may be covered by the FTC Health Breach Notification Rule. HealthIT.gov says concerns about a non-HIPAA company’s handling of health information can be reported to the FTC. |
HIPAA generally covers health plans, health care providers conducting specified electronic transactions, health care clearinghouses, and relevant business associates. It does not cover every app or online company that holds health information. Some businesses outside HIPAA may be subject to the FTC rule or other laws. See HealthIT.gov’s guidance on protecting health information and HHS’s HIPAA and FTC Act overview.
What a breach notice means—and what it does not
For a breach of unsecured protected health information, a HIPAA-covered organization must notify affected people without unreasonable delay and no later than 60 days after discovery. The notice should describe the incident and kinds of information involved, explain protective steps for affected people and the organization’s response, and provide contact information. The organization—not the patient—is responsible for required notification. Other reporting obligations, including reports to HHS and, in some circumstances, the media, have their own rules and thresholds. See HHS’s Breach Notification Rule guidance.

The FTC rule covers certain personal health record vendors, related entities, and service providers outside HIPAA. For covered companies, notification duties apply to affected consumers and the FTC, and sometimes the media. FTC guidance describes a 60-day-after-discovery outer limit for incidents affecting 500 or more people, and reporting of smaller incidents by the 60th day of the following calendar year. Those are company reporting requirements, not deadlines for an individual to file a complaint. See the FTC’s Health Breach Notification Rule guidance.
These notification deadlines do not tell you whether your own information was misused or when you personally must take action. Use the notice to identify what was involved, then follow the practical steps above.
