What to Do If Your Income Tax Appellate Tribunal Hearing Is Delayed

If your Income Tax Appellate Tribunal (ITAT) hearing appears delayed, first verify the current listing on ITAT’s official case-status page, then check the latest cause list and notices for the relevant bench. If the listing remains unclear, confirm it with that bench’s registry. The ITAT’s e-filing procedure also provides for early-hearing and adjournment petitions, but filing one does not guarantee a particular decision or hearing date.

Check whether your ITAT hearing date has changed

  1. Open the official ITAT Case Status page. It provides a search by date of filing. Find the entry for your appeal and check the listed details carefully.

  2. Open the ITAT Notice Board and look for the latest cause list, revised cause list and notices for the relevant bench. A later notice or revised list may change an earlier listing, so check close to the hearing date rather than relying only on a previously saved list.

  3. If the case-status entry and the bench’s latest notice appear to conflict, or you cannot identify the current listing, confirm it with the relevant bench registry using current official bench information. The ITAT homepage publishes bench cause lists and order-pronouncement listings: itat.gov.in.

Case status and cause lists are ways to verify a listing; they do not by themselves establish that a request for an earlier hearing has been granted. Look for a specific official notice or order before treating a date as changed or a petition as allowed.

Choose the next step based on what you need

Purpose Channel What it can establish
Verify the current listing Case-status page, bench cause list, revised list and notices Published case or listing information; check the latest material for the relevant bench.
Ask the tribunal to consider an earlier hearing or an adjournment E-filing petition A petition has been submitted. Its filing alone does not establish that the bench granted it or set a new date.

When an early-hearing or adjournment petition may be relevant

The ITAT’s E-Filing Standard Operating Procedure, dated 24 June 2021, says: “Petitions like Early Hearing Petition, Adjournment Petition, Clubbing Petition, Withdrawal Petition, etc. can be filed electronically through e-Filing Portal.” The procedure identifies electronic filing as an available channel for these petition types; it does not promise acceptance or a particular outcome. Because the SOP is dated 2021, check the current portal instructions before filing: ITAT E-Filing Standard Operating Procedure.

Use the ITAT e-filing portal and its help page for current filing guidance. Whether to request an early hearing, seek an adjournment or take another case-specific step depends on the circumstances of your appeal. A qualified tax practitioner or tax litigation lawyer can advise on that choice.

If you cannot log in to e-filing

An OTP delivery delay is a portal-access issue, not evidence that the tribunal has changed your hearing date. ITAT’s e-filing information notes that network traffic can sometimes delay OTP delivery. Allow for that possibility and consult the portal’s current help information if login remains blocked: ITAT e-filing help.

What is not established about ITAT hearing delays

The official materials cited here do not establish a universal deadline by which a delayed appeal must be heard, an automatic remedy, an average delay duration or a guaranteed response time for an escalation. Do not assume a particular cause for the delay or that filing a petition will produce an earlier date. Verify the listing for your case and bench, and rely on a specific official notice or order for any change.
