What to Do If Your Health Insurance or Medical Claims Information Was Exposed in a Data Breach

Exposure does not automatically mean someone has used your identity, but it does require prompt verification and monitoring. Confirm what was exposed through a known insurer or provider channel, then check your Explanation of Benefits (EOB), bills, claims and medical records. If Social Security or financial details were included, add credit and account-protection steps. Keep every notice and document your disputes.

Start with the breach notice, not the message link

Save the letter, email or portal notice as evidence. Record the organization’s name, the incident date (if stated), when it discovered the incident, the data fields involved and any deadline for enrolling in assistance. A legitimate notice should explain the categories of information affected and advice relevant to those categories, according to Federal Trade Commission (FTC) health-breach guidance.

Verify the notice independently. Use a phone number printed on your insurance card, a website you already know is genuine, your insurer’s official app or prior paperwork. Do not use a link in an unexpected email or text. Do not provide medical details to an unsolicited caller. The FTC’s September 2024 consumer guidance puts it plainly: “Don’t give your medical information to someone who calls, emails, or texts you unexpectedly.”

Ask the insurer, provider or health-record service to confirm whether the incident is real and whether your member or group number, Social Security number, date of birth, claims, diagnoses, prescriptions or clinical records were involved. The response determines which protections you need. An exposed member number calls for claim and record monitoring; an exposed Social Security number also calls for credit-file precautions.

Match your response to the information exposed

Information named in the notice Priority actions What the action does not do
Insurance member or group number Review EOBs, bills and claims; ask the insurer whether questionable claims can be flagged and whether a replacement number is available. A number change is not guaranteed and does not erase incorrect medical records.
Medical records, diagnoses or prescriptions Request records from each relevant provider, review for unfamiliar visits or medicines, and dispute errors in writing. Credit monitoring alone will not reveal every medical-record misuse.
Social Security number Obtain your credit reports, consider a credit freeze or fraud alert, and investigate unfamiliar accounts or medical collections. A freeze restricts access to credit reports; it does not correct a medical file or stop all insurance-credential misuse.
Bank or payment-account number Review transactions and contact the financial institution about suspicious activity or closing the compromised account. Watching medical claims does not protect a bank account.
Only contact details Expect targeted phishing and impersonation attempts; use known contact channels and change reused passwords. Contact information alone does not prove that a claim or account was used.

If the notice is vague, ask for the exact data categories and whether the organization has evidence of misuse. Treat exposure as a reason to monitor, not as proof that identity theft has already occurred.

Check your health plan activity immediately

Read every recent EOB

An Explanation of Benefits identifies the provider, date of service, services or procedures, amount charged, insurance payment and your patient responsibility. Compare each line with your calendar, appointments and prescription history. Flag a provider you do not recognize, a service you did not receive, a medicine you never obtained, an unfamiliar charge or a benefit-limit notice that makes no sense.

Compare bills with EOBs

Look for medical debt you do not owe, duplicate services, altered dates or a bill for a clinic you have never visited. An unfamiliar medical collection account is another warning sign. Do not pay a disputed charge merely to make it disappear; first ask the insurer and provider to investigate and explain the item.

Act if expected bills stop arriving

A missing bill can indicate that someone changed the billing address or account contact information. Call the provider using a known number and ask whether your address, email or phone number was changed, when the change occurred and how to restore accurate details. Confirm that future statements will be sent to you.

Dispute suspicious claims and repair medical records

Open a claim investigation

Contact the insurer’s member-services or fraud department and the provider that submitted the claim. Give the claim number, service date, provider name and the reason you believe it is wrong. Ask whether the claim can be flagged for review, whether additional claims under your member number can be monitored and whether the insurer offers a replacement member number. Policies differ, so ask what protections are actually available rather than assuming a number will be changed or money will be reimbursed.

Request records from every relevant organization

Request your records from each insurer, doctor, clinic, hospital, pharmacy or laboratory connected with the notice or suspicious claim. Review visit dates, procedures, diagnoses, prescriptions and demographic details. Keep a copy of each request and the records you receive.

Submit a written correction request

Tell the provider exactly which entry is wrong, include a copy or clear description of the incorrect record, and explain what should be corrected. Send the request by a trackable method and retain delivery proof. FTC consumer guidance says the provider must respond within 30 days and notify other providers that may have the same error. This 30-day period concerns the provider’s response to a correction request; it is not a universal deadline for you to dispute every record.

If a provider refuses access because it believes another person’s privacy is involved, appeal through the privacy officer named in the organization’s Notice of Privacy Practices, a patient representative or an ombudsman. Keep a timeline of calls, letters, claim numbers and responses.

If your Social Security number was exposed

Pull all three credit reports

Use AnnualCreditReport.com, the federally authorized source for free credit reports, and inspect accounts, hard inquiries and medical collection entries you do not recognize. Save copies or PDFs showing the dates you checked. If an unfamiliar medical bill appears, follow FTC identity-theft instructions and dispute the entry with each of the three nationwide credit bureaus.

  • Quality tested: As part of Amazon Basics quality inspections, we test every shredder before shipping it, which means you may see some paper shreds from the testing

Choose a freeze or fraud alert

A credit freeze limits access to your credit report and generally must be placed separately with each bureau. A fraud alert tells prospective creditors to take additional steps to verify your identity. Either can make new-account fraud harder, but neither repairs an inaccurate medical record or blocks every use of an insurance member number.

Use the federal recovery plan when misuse appears

If you find an account, collection or other identity-theft sign you did not create, file a report and follow the individualized recovery checklist at IdentityTheft.gov. Keep the report number and copies of correspondence. If a bank or payment account was exposed, review transactions daily at first and ask the institution whether the account should be closed and replaced.

Evaluate services offered with the breach notice

Organizations often offer free credit monitoring or identity-theft insurance after a breach. The FTC recommends considering legitimate offers, but verify them through a known official channel before enrolling. Record the activation deadline and read the terms rather than assuming the service covers every kind of medical misuse.

Question to ask Why it matters
How long is the service free? A promotional period may end and create a paid renewal.
Which exposed data does it monitor? Credit-file monitoring may not detect a false medical visit or prescription.
Is medical-identity recovery included? Some services focus on financial identity and provide no help correcting clinical records.
Is a recovery specialist available? Assistance can matter when several providers or bureaus must be contacted.
What insurance limits, exclusions and documentation apply? Coverage is not a promise that every loss will be reimbursed.
What must you do before the deadline? Missing activation steps can forfeit the offered benefit.
What will it cost after the free period? Cancel or keep the service knowingly, rather than by accidental renewal.

Monitoring is an alerting tool, not a substitute for reading EOBs, checking bills, reviewing records and disputing errors. Official guidance does not establish that a paid service is necessary or that any particular provider is best.

Secure your documents, accounts and communications

  • Store the notice, EOBs, bills, records, dispute letters, delivery receipts and call notes in a secure folder.
  • Shred paper medical and insurance documents before disposal, or use a local shred event. For prescription bottles that are difficult to shred, obscure your name, prescription and other personal details before recycling or discarding them.
  • Sign in by typing a known website address or using the official app. Do not follow unexpected links or attachments.
  • Do not confirm your date of birth, member number, diagnosis or prescription to an unsolicited caller, texter or emailer.
  • Change passwords that were reused on the affected organization’s account and enable multi-factor authentication where offered.
  • Check that your mailing address, email address and phone number are correct with the insurer and providers.

Understand the breach-notice deadlines

For HIPAA-covered health plans, providers and business associates, the HHS Breach Notification Rule applies to breaches of unsecured protected health information. Affected people must generally be notified without unreasonable delay and no later than 60 days after the organization discovers the breach. That is the organization’s notification obligation, not a 60-day deadline for you to file a claim, freeze credit or correct a record.

Some personal health-record vendors that are not covered by HIPAA may fall under the FTC Health Breach Notification Rule, which also generally calls for individual notice without unreasonable delay and within 60 calendar days after discovery. Coverage depends on the organization and service. The HHS rule page cited for this guidance says it was last reviewed July 26, 2013, so check current agency information if you are disputing compliance or relying on a legal deadline. State requirements and remedies outside the United States can differ.

A practical response timeline

Today

  1. Verify the notice through the insurer’s or provider’s known official channel.
  2. Write down the data categories, incident and discovery dates, and enrollment deadline.
  3. Secure your online account and check that contact details are correct.
  4. Review the newest EOBs, bills and prescription records.

Within one week

  1. Request records from relevant insurers, providers, pharmacies and laboratories.
  2. Report suspicious claims to the insurer and submitting provider.
  3. If Social Security information was exposed, obtain all three credit reports and decide on a freeze or fraud alert.
  4. Contact your bank promptly if payment information was included.
  5. Enroll in legitimate offered monitoring before its deadline, after checking scope and cost.

Over the next month

  1. Send written correction requests for inaccurate medical records using trackable delivery.
  2. Follow up on the provider’s response; FTC guidance describes a 30-day response period.
  3. Continue checking EOBs, bills, account notices and credit reports for new irregularities.
  4. Use IdentityTheft.gov if you find confirmed identity misuse and keep your recovery documents together.

Common mistakes to avoid

  • Assuming exposure equals confirmed fraud. Continue monitoring even when no misuse is visible.
  • Relying only on credit monitoring. Medical claims and records can be misused without a new credit account.
  • Believing a credit freeze fixes a clinical record. Record correction must be handled with the provider.
  • Waiting for a bill that never arrives. A changed address can hide fraudulent activity.
  • Calling a number in an unexpected message. Verify through your card, official app, known website or prior paperwork.
  • Discarding the notice or failing to record deadlines. You may need the details to dispute a claim or activate assistance.
  • Promising yourself a particular result. Ask what the insurer can do about a flag, member-number change or reimbursement; procedures vary.

When to escalate

Escalate to the insurer’s fraud unit when a claim is not yours, to the provider’s privacy officer or patient representative when a record correction is denied, and to your financial institution when account activity is suspicious. If an organization will not explain the notice or you believe it failed to provide required notice, consult the relevant federal or state regulator about the current rule. Keep your complaint factual and attach the notice, disputed records and correspondence.
