What to Do if Your Electricity Provider Denies Your Usage-Data Request

By Freedom251 Team · · 10 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Put the refusal and your renewed request in writing. Identify the account, meter, dates, data interval and file format; ask the provider to state the precise reason for refusing and any legal or policy exemption. Keep bills, meter readings, correspondence and proof that you are the account holder. In the UK, use a UK GDPR subject access request (SAR) and, where the data qualifies, a separate data-portability request. If the supplier still does not resolve the issue, escalate through the appropriate energy regulator, ombudsman, consumer body or data-protection authority.

The correct remedy depends on where you live, whether you want billing totals or smart-meter intervals, and whether the records concern only you. EU law expressly supports access to requested consumption data, but national rules, privacy limits and technical records determine how a refusal is handled.

Start by turning the refusal into a written record

A telephone explanation is difficult to challenge because you may not know the exact wording, policy or account information the provider relied on. Reply by email, web form or the supplier’s privacy channel and refer to the date of the refusal. Ask the provider to treat your message as a renewed data request and to confirm its complaint or information-rights reference number.

Include enough detail for the supplier to locate the records without guessing:

Minute and hour data are retained in the cloud. 1 minute data is retained 7 days, 1 hour data is retained indefinitely. Export cloud data whenever you want in the app.
  • Your full name and service address.
  • Account number, meter-point identifier (where applicable) and meter serial number.
  • The exact start and end dates.
  • The interval you need, such as monthly, daily or half-hourly readings.
  • Whether you want a raw export, a readable statement, corrected billing data or a transfer to another service.
  • A short explanation of the purpose, such as checking a bill, analysing household consumption or moving to a new supplier.
  • Your preferred format, for example CSV, spreadsheet or a human-readable PDF.

Ask for a reasoned decision, not just “we cannot provide that.” Specifically ask whether the obstacle is identity or authority, another person’s data, a retention limit, technical unavailability, or a request that is too broad or unclear. Request the exact policy or legal exemption, the records covered by the decision, and the review or appeal route.

Use a concise written request

Subject: Request for electricity-usage data and review of refusal

I am the [account holder/joint account holder/authorised representative] for [service address], account [number], meter [serial or point identifier]. Please provide my electricity-consumption data from [start date] to [end date], at [monthly/daily/half-hourly] intervals, in [requested format].

Your earlier response dated [date] refused or limited this request. Please state the precise reason, policy or legal exemption relied upon; whether the issue concerns identity, authority, another person’s data, retention, technical availability or scope; and how I can request an internal review.

Please confirm what data you hold, what you can disclose, and the expected response route.

Keep the sent message, delivery confirmation and every reply. If the supplier calls, write down the date, the representative’s name or reference, and the substance of the conversation, then send a short email confirming your understanding.

Separate the data you need from the route that can provide it

“Usage data” can mean several different records. A refusal to provide a historical interval file does not necessarily justify withholding billing totals, and a smart-meter display is not the same as the supplier’s back-office records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Data you want Typical contents Important question to ask
Billing totals Meter readings, billed kilowatt-hours, tariff periods and invoice calculations Can the supplier provide the statements or readings for each billing period?
Interval smart-meter data Daily or half-hourly consumption measurements held by the supplier or network Does the provider actually hold the requested interval and date range?
Meter-device data Readings visible through an in-home display or another home-area-network device Can you retrieve the information directly from the device even if the provider will not export it?
Corrected or disputed records Amended readings, estimated-versus-actual flags and rebilling information Are you seeking a data copy, a billing correction, or both?
Transfer-ready data Data supplied by or observed about you in a technically portable form Is the request for your own use or for transmission to another organisation?

State the outcome you want. A raw file, a readable statement, an explanation of a refusal and a corrected bill are different remedies. Asking for all four at once can make a request look unclear; list each outcome separately and identify which is essential.

Check who is entitled to the records

Providers must protect information that identifies another person. Your position is strongest when you are the named account holder and the requested period relates to your account. A joint account, tenancy change or landlord-managed meter needs more care.

Account holder or joint holder

Send proof of identity or account ownership if requested through a secure channel. A joint holder may be entitled to account records, but the supplier may need to separate information about other individuals or explain how it will handle their privacy.

Tenant, former occupant or landlord

If the account is in a landlord’s name, ask the provider what authority is required and request records that relate to you separately. A former occupant should identify the dates when they were responsible for the account. Do not demand another person’s identifiable consumption history; ask for aggregated, redacted or otherwise privacy-protected information where appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Authorised representative

If you are acting for someone else, provide the supplier’s required authority or consent. Ask whether it wants a signed authorisation, power of attorney or its own form. Keep the request limited to the person and period covered by that authority.

Use UK data-rights routes when the account is in the United Kingdom

For a UK customer, label the request “UK GDPR Subject Access Request”. A subject access request seeks a copy of your personal data and supplementary information. Meter readings and consumption records linked to your account can be personal data even when the provider presents them as technical measurements.

Make a separate request for data portability when the information is provided by or observed about you and is technically portable. Raw data from connected objects such as smart meters can potentially fall within portability rules. Portability is aimed at receiving data in a usable, machine-readable form and, where feasible, having it transmitted to another organisation; it is not a guarantee that every historical record or every requested format exists.

The UK Information Commissioner’s Office (ICO) advises following up a verbal request in writing. Written communication lets you explain the complaint, provide evidence and state the solution you want. If the supplier refuses, ask its privacy officer or information-rights team for an internal review and identify the specific UK GDPR exemption being applied.

How Ofgem’s route fits

Ofgem describes subject access requests as a way to obtain personal data and supplementary information and identifies an internal-review route for information-rights concerns. Use the supplier’s own review process first, preserving the original request and refusal so an external body can see the sequence.

Smart-meter privacy and access choices

The UK Smart Meter Data Access and Privacy Framework governs supplier, network and third-party access to smart-meter data and is intended to give consumers control over who accesses consumption information, subject to regulated purposes. The framework review identifies three consumer access routes:

  1. An in-home display.
  2. Additional devices connected to the home-area network.
  3. A request to the supplier.

These routes can help you see current or future usage, but an in-home display or local device does not compel a supplier to disclose historical provider-held records. If the supplier says the data is not available, ask whether it was never collected, has been deleted under a retention rule, is held by another entity, or exists only in a different interval or format.

Understand the European Union position

Directive (EU) 2019/944, Article 24, states: “if final customers request it, data on the electricity they fed into the grid and their electricity consumption data shall be made available to them.” The directive also describes standardised communication, remote access or an authorised third party as possible delivery routes.

That wording supports a strong access principle, but it is not a single EU-wide complaint form. National legislation and regulators determine implementation, identity checks, exemptions, retention rules and enforcement. Tell the provider which member state governs your supply contract and ask it to identify the national rule supporting any refusal. If the issue concerns personal data, use the data-protection authority in the relevant member state; if it concerns supply or billing conduct, use the national energy regulator or an approved ombudsman.

Escalate in a controlled sequence

  1. Complete the written request. Include the account, meter, dates, interval, format and desired outcome.
  2. Request a reasoned refusal. Ask for the exact policy or legal exemption and a review deadline or route under the applicable rules.
  3. Submit the formal data-rights request. In the UK, use a UK GDPR subject access request and separately request portability where appropriate.
  4. Preserve evidence. Save the refusal, request, bills, meter photographs or readings, privacy notice, call notes and proof of authority.
  5. Use internal escalation. Contact the supplier’s privacy officer, complaints team or information-rights reviewer and quote the existing reference number.
  6. Choose the external body. Depending on location and issue, contact the energy regulator, ombudsman, consumer council or data-protection authority.

For Northern Ireland, the Utility Regulator says to complain to the supplier first and then contact the Consumer Council if the matter remains unresolved. Other UK nations use different bodies and procedures, so confirm the regulator for the nation and service involved rather than assuming one route covers the whole UK.

Match the escalation to the result you need

Your main problem Most relevant route Evidence to attach
You need a copy of personal consumption records Supplier privacy team; UK GDPR subject access request in the UK Identity, account details, date range and the refusal

What to do when the provider claims the data is unavailable

“We do not hold historical interval data”

Ask whether the data was never collected, is held by a network operator, was converted into billing totals, or was deleted under a stated retention policy. Request any surviving readings and the name of the organisation that holds the remainder. A provider may be unable to recreate intervals that were never recorded, but it should distinguish that situation from a refusal based on privacy or policy.

“The request is too broad”

Narrow the dates and interval, then ask for the provider’s preferred scope. You can request one billing year, a specific meter or a defined set of readings first. Keep a broader request in reserve if the narrower response shows that more records are needed.

“We cannot disclose it because someone else is on the account”

Ask for records that can be separated from the other person’s information, with redactions if necessary. Explain your status as account holder, joint holder, tenant or authorised agent and provide only the authority the supplier requires.

“Use the smart-meter display”

The display may show useful current or future consumption, but it is not necessarily a complete historical export. Ask the supplier to confirm whether the display is the only available route and whether it can provide billing records or a portable file separately.

Keep expectations realistic about awareness and access

Consumer awareness of smart-meter data controls is limited. In the UK BEIS Smart Meter Customer Experience Study covering 2016–2018, approximately 16% of respondents recalled receiving information about how their supplier stored smart-meter consumption data about 10 weeks after installation. A Citizens Advice survey reported in the UK government’s framework review found that 47% of smart-meter owners said they knew how regularly they were sharing consumption data.

These figures describe awareness, not a provider’s legal response deadline or the likelihood of winning a complaint. They are a reason to request the supplier’s privacy notice and data-sharing settings in writing, not evidence that a particular refusal is lawful or unlawful.

When the refusal may be justified

A provider may have a legitimate reason to limit or refuse a request, including failure to verify identity, lack of authority over another person’s account, protection of third-party information, records that are outside its retention period, or data that it never held. A request may also need clarification if it combines several meters, properties or decades of records.

A justified limit should still be explained clearly enough for you to understand what was considered, what can be released, what has been withheld and which review or complaint route applies. Ask for partial disclosure rather than treating an all-or-nothing refusal as the only option.

Questions to answer before escalating

  • Which country, UK nation, state or province governs the supply contract?
  • Are you asking for billing totals, interval smart-meter data, device data, a corrected bill or a transfer-ready file?
  • Are you the account holder, a joint holder, a tenant, a landlord or an authorised representative?
  • What exact dates, meter and interval did you request?
  • Did the supplier identify a legal exemption, a policy, a technical limitation or an identity problem?
  • Have you used the supplier’s internal privacy or complaints review?
  • Which external body handles the remaining issue in your jurisdiction?

Answering these questions prevents your complaint from being redirected between a privacy team and an energy-billing team. It also gives a regulator, ombudsman or data-protection authority a clear record to assess.

Bottom line

Do not rely on a verbal “no.” Make a precise written request, ask the provider to identify the exact reason and exemption, and preserve proof of your account authority. In the UK, use a subject access request and consider portability for technically portable smart-meter data. Use the supplier’s review process before escalating to the regulator, ombudsman, consumer body or data-protection authority that covers your jurisdiction. EU customers have a clear access principle under Directive (EU) 2019/944, but the practical procedure still depends on national law and the facts of the account.
