What to Do If Your Company Is Hit by a Data Extortion Attack

If your company receives a threat to publish stolen data, encrypts systems, or both, treat it as a live incident: activate the approved incident-response plan, form a small leadership group, contain affected systems without destroying evidence, bring in experienced responders and authorities, assess what data was exposed, and restore only from verified clean backups. Do not assume that encryption proves theft, or that an extortion claim proves the attacker accessed every system named in a message.

Understand what kind of incident you are handling

Data extortion is an attack in which criminals demand something—usually money—by threatening to disclose information they claim to have taken. The incident may include ransomware encryption, data theft without encryption, or both. The practical response is similar at first, but the facts must be established rather than inferred.

As an Amazon Associate I earn from qualifying purchases.

  • Threatened disclosure without encryption: the attacker claims to have copied confidential files and threatens publication, sale, or notification of customers, employees, regulators, or the media.
  • Encryption with a theft claim: systems or files are unavailable and the attacker also alleges that data was exfiltrated.
  • Encryption without proven theft: an outage may be real while the claim about stolen data remains unverified.
  • Fraudulent or exaggerated claims: a message can name real systems or old information without proving current access or a complete compromise.

Record what is known, what is alleged, and what is still unknown. That distinction prevents a premature public statement, an incomplete breach assessment, or a recovery action that destroys useful evidence.

Take the first coordinated actions

The first objective is to stop the attacker’s access and preserve options for investigation and recovery. Follow the organization’s approved incident-response plan (IRP); CISA’s #StopRansomware guidance specifically says, “Should your organization be a victim of ransomware, follow your approved IRP.” If the plan is missing or unavailable, use the sequence below and document every decision.

1. Activate the incident-response plan and a decision group

Notify the incident commander or security lead through a trusted channel. Establish a small group with authority to make rapid decisions. Include security or IT, an executive decision-maker, legal counsel, communications, and business-continuity or operations leadership as appropriate. Assign one person to maintain a time-stamped incident log and another to coordinate vendors and authorities.

Use the communication and notification procedures already approved for ransomware, data extortion, and data-breach events. If the suspected compromise includes email, chat, identity systems, or remote-management tools, assume those channels may be monitored and move sensitive coordination to an out-of-band method such as verified phone calls.

2. Contain affected systems without causing wider damage

Identify the systems, accounts, cloud workloads, endpoints, and network segments showing indicators of compromise. Isolate them promptly, but coordinate the action through the incident commander. Disconnecting a workstation or server from all networks can be appropriate; indiscriminately shutting down every system can destroy volatile evidence, interrupt safety-critical operations, or alert the attacker before high-value access is removed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If multiple systems or subnets are affected, network-level isolation at a switch or segmentation boundary may be necessary. Prioritize systems that control identity, backups, virtualization, domain services, financial operations, manufacturing, healthcare, or other critical functions. Disable compromised accounts and remote-access paths only after responders have recorded the relevant session, authentication, and system details when feasible.

Do not let individual administrators “clean up” machines, delete attacker messages, or deploy an uncoordinated blocking rule. CISA warns that uncoordinated action can cause an attacker to move laterally or deploy ransomware more widely.

3. Preserve volatile evidence before powering down

Preserve logs and artifacts that can disappear quickly. Capture, or direct your incident-response provider to capture, system memory and relevant disk images when the team has the capability and the collection will not endanger people or critical operations. Powering down a system can destroy evidence in volatile memory, so disconnect affected equipment from networks first when feasible and leave it running until a qualified responder determines the safest collection method.

Bring in experienced responders and authorities

Use a breach-experienced incident-response provider when needed

If your organization does not have the staff, tooling, or forensic experience to investigate a suspected data theft, engage a reputable incident-response provider experienced in data breaches. Ask the provider to preserve evidence, scope access and exfiltration, contain the intrusion, advise on eradication, and coordinate with legal counsel. A provider should not be selected solely because it promises a fast decryption or a quiet settlement; those promises cannot establish what happened or guarantee an outcome.

Use breach-response counsel familiar with the jurisdictions, contracts, and data types involved. Counsel can help structure the investigation, preserve privilege where appropriate, interpret notification duties, and coordinate specialist advice. Legal requirements vary with jurisdiction, the kind of information involved, affected people, contractual commitments, and the facts established during the investigation.

Report the crime early

Contact the FBI, including the Internet Crime Complaint Center (IC3) and the appropriate local field office, and contact CISA. CISA’s guidance describes federal response support and recommends consulting law enforcement even when the organization can mitigate the incident itself, including when a decryptor may be relevant.

Prepare an accurate report rather than waiting for a complete forensic conclusion. IC3 guidance identifies useful details such as the suspected ransomware variant, file extension, attacker email or chat contacts, domains and URLs, the demand amount and currency, deadlines, wallet addresses, and whether any payment was made. Preserve the original artifacts so investigators can verify them.

Determine whether data was accessed or exfiltrated

A data-extortion message is an allegation, not proof of the attacker’s full scope. Conversely, the absence of encryption does not mean that no data was stolen. Have responders examine identity-provider logs, endpoint telemetry, firewall and proxy records, cloud-audit logs, storage access, database activity, archive creation, unusual compression, and outbound transfer destinations. Establish the earliest known access, the accounts used, systems reached, files or databases touched, and the last confirmed attacker activity.

Classify findings by confidence:

  • Confirmed: direct evidence such as an authenticated file access, a captured transfer, or a known compromised account.
  • Probable: multiple corroborating indicators where the exact files or transfer cannot be reconstructed.
  • Possible: an attacker claim or indirect signal that still needs verification.
  • Not established: no evidence currently shows access, copying, or publication.

Map affected information to data owners and categories, such as credentials, financial records, health information, employee files, customer records, intellectual property, or regulated data. Preserve the reasoning behind the classification; facts may change as more logs or attacker samples are examined.

Assess notification and reporting duties by jurisdiction

A suspected data breach triggers a notification assessment, but there is no universal deadline that can safely be stated for every company. The applicable rule depends on where the organization operates, where affected people reside, what data was involved, whether the organization is regulated, and when the relevant facts became reasonably established. Contractual notice duties to customers, insurers, suppliers, and payment partners may apply in addition to statutory requirements.

Give counsel and the response team a fact package containing the incident timeline, affected systems, data categories, number and location of potentially affected people, evidence of access or exfiltration, containment status, and known attacker communications. Use the organization’s approved notification plan. Avoid publishing an exact count, cause, or data category until the evidence supports it, but do not delay required notices merely because every forensic question is unresolved.

Coordinate communications so that customers, employees, regulators, law enforcement, insurers, and business partners receive consistent, accurate information. State what is known, what remains under investigation, what protective steps people should take, and where legitimate updates will appear. Do not repeat attacker links or provide unverified claims that could amplify the extortion attempt.

Make a deliberate decision about ransom payment

Do not promise that paying will recover files, stop publication, or prevent a second demand. The FBI states: “The FBI does not support paying a ransom in response to a ransomware attack.” Its guidance also says payment does not guarantee data recovery. Treat that position as federal guidance, not as a case-specific legal ruling.

Any decision must involve executive leadership, legal counsel, the incident-response lead, the insurer when applicable, and law enforcement. Before considering a transaction, check sanctions and other legal restrictions, preserve the demand and negotiation record, verify who is communicating, and understand that a payment can create additional operational, legal, and security risks. A purported decryptor should be evaluated by qualified responders in a controlled environment; never assume that a criminal’s promise is a recovery plan.

Recover without reinfecting the environment

Validate the recovery foundation

Use offline, encrypted backups whose integrity and availability have been tested. “Offline” means the backup cannot be modified through the compromised production credentials or network path; a drive that remains permanently connected to a server does not meet that goal. Confirm that backup catalogs, encryption keys, administrator accounts, and management consoles were not compromised.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before restoration, eradicate persistence and reset credentials according to the forensic findings. Rebuild or reimage systems when responders cannot establish that they are clean. Patch the exploited weaknesses, remove unauthorized accounts and scheduled tasks, and increase monitoring on identity, backup, and remote-access systems.

Restore in an order that protects critical operations

  1. Define the minimum services needed for safety, legal obligations, customer commitments, and basic business operations.
  2. Restore identity, network controls, and management systems from validated clean sources, with newly secured administrative credentials.
  3. Restore critical applications and data in isolated segments. Verify malware scans, configuration baselines, logging, and access controls before reconnecting each segment.
  4. Test transactions, integrations, authentication, backups, and outbound connections with system owners.
  5. Reconnect services gradually while monitoring for renewed command-and-control traffic, unusual authentication, data staging, or encryption activity.

Keep compromised systems and forensic copies preserved according to the investigation and legal hold. Document which backup version was used, who approved each restoration, what tests passed, and what exceptions remain.

Choose backup controls that survive an extortion attack

Preparation determines whether recovery is a controlled engineering task or a negotiation under pressure. Compare backup approaches by their separation from production, resistance to deletion or alteration, encryption, and proof that restoration works.

Backup approach Isolation from compromised systems and accounts Protection from deletion or alteration Encryption Restore evidence needed
Offline removable or external storage Strong when disconnected and stored under controlled access; weak if left attached to a production host Physical separation helps, but access and inventory controls are still required Use encryption with keys managed separately from ordinary administrator credentials Regular test restores, integrity checks, and documented retention
Cloud or hosted backup with immutable retention Depends on separate accounts, strong identity controls, and a management plane outside the production domain Immutability or object lock can block deletion during a defined retention period Confirm encryption in transit and at rest and understand who controls the keys Scheduled recovery exercises that include account compromise scenarios
Secondary online copy in the same administrative domain Weak if attackers can use the same credentials or network path Usually vulnerable to mass deletion or encryption unless additional controls exist Encryption alone does not provide isolation Tests should prove that the copy remains available after a domain-wide compromise

CISA recommends offline, encrypted backups and regular tests of availability and integrity. A hardware-encrypted external backup drive can be one physical component, but it is not by itself an enterprise continuity strategy: you still need multiple copies, controlled keys, retention rules, access separation, monitoring, and tested restoration.

Communicate with discipline during the incident

Designate one communications lead and one approved spokesperson. Internally, give staff a short, actionable message: which systems to stop using, how to report suspicious prompts, which channel is trusted, and where operational updates will be posted. Tell employees not to contact the attacker, delete messages, or speculate publicly.

External statements should avoid unsupported claims about the attacker, the number of affected people, the exact files taken, or the likelihood of publication. A useful update identifies the service impact, confirms that containment and investigation are underway, explains practical protections for affected people when known, and provides a verified contact or update page. Update the message as facts change rather than repeating an obsolete estimate.

Avoid common response mistakes

  • Shutting down everything immediately: this may destroy volatile evidence and make it harder to determine the attacker’s path. Isolate first when feasible and let qualified responders direct collection.
  • Letting every administrator investigate independently: uncoordinated changes can erase evidence or trigger further lateral movement. Use one incident commander and a change log.
  • Assuming the ransom note is a complete forensic report: validate claims against logs, endpoint data, cloud records, and samples.
  • Treating encryption as proof of theft: encryption establishes availability impact, not necessarily exfiltration. Investigate both questions separately.
  • Relying on a connected backup: attackers who obtain backup-administrator credentials may encrypt or delete it. Separate accounts, networks, keys, and retention controls.
  • Restoring before removing persistence: a clean-looking backup can be compromised again if identity, remote access, or management systems remain under attacker control.
  • Making a fixed legal-deadline promise: notification rules differ by jurisdiction and data type. Obtain counsel’s incident-specific analysis.
  • Negotiating or paying in isolation: involve legal, law enforcement, the insurer, and responders, and preserve every communication.

Use a practical incident timeline

First hour: activate the IRP, form the decision group, move sensitive coordination to trusted communications, identify critical systems, isolate affected assets, and preserve attacker messages and volatile evidence.

First day: engage breach-experienced responders and counsel, contact the FBI/IC3 and CISA, secure logs and backups, disable confirmed compromised access, and create an initial fact-versus-allegation record.

Investigation phase: establish the access timeline, determine whether data was accessed or exfiltrated, classify affected information, evaluate notification and contractual duties, and make communications decisions based on verified facts.

Recovery phase: rebuild trust in identity and management systems, restore from validated offline encrypted backups, test each service before reconnection, monitor for recurrence, and preserve evidence.

After stabilization: document root causes and decisions, close control gaps, test backup restoration and out-of-band communications, update the IRP and notification procedures, and exercise the improved plan with leadership and technical teams. NIST’s SP 800-61 Rev. 3 (2025), NIST IR 8374 Rev. 1 (2026), and SP 1800-29 provide current incident-response and data-confidentiality-breach context for organizations formalizing these capabilities.
