What to Do if Your Bitcoin Is Frozen or Seized by Law Enforcement

If you cannot access bitcoin, first determine whether an exchange has imposed an internal restriction, a court has frozen a wallet or account, or law enforcement has seized the asset under legal process. Save the complete notice and all related records, do not move or conceal bitcoin that may be covered by an order, and contact a lawyer experienced in asset forfeiture and digital assets in the jurisdiction named in the documents. The correct deadline and remedy depend on the country, the type of proceeding, who held the bitcoin, and the exact wording of the notice.

“Frozen” and “seized” are different events

People often use “frozen” for several legally different situations. Identifying which one occurred determines what you should do next.

Situation What it usually means What to request or preserve
Provider restriction An exchange or other custodian has limited withdrawals or account access under its terms, compliance program, or a request from authorities. This is not automatically a government seizure or a final forfeiture. The provider’s notice, stated reason, reference number, date of restriction, and the legal instrument or authority it can lawfully disclose.
Court or statutory wallet-freezing order A court or authorized agency has directed that a wallet, account, or cryptoasset cannot be dealt with while proceedings continue. The complete order, service details, court, case number, covered addresses or assets, exemptions, and instructions for an application or appeal.
Law-enforcement seizure Authorities have taken control of bitcoin under a warrant or another legal process, often for potential forfeiture or as evidence. The warrant, inventory, receipt, notice of seizure, agency contact details, and every document explaining how to contest the action.
Final forfeiture or confiscation A court or other authorized process has determined that the government may keep the asset, subject to any appeal or review available under local law. The final order, date it was entered and served, appeal instructions, and proof of ownership or other interest.

An exchange’s customer-service message can therefore describe a restriction without proving that a court has ordered forfeiture. Conversely, an exchange may be complying with a warrant and be unable to disclose every detail immediately. Ask precise questions and have counsel interpret the response.

Do these things immediately

  1. Save the complete notice. Keep every page, attachment, envelope, email header, portal message, and delivery record. Note the date and time you received it, the sender, the case or reference number, and contact information for the issuing authority or provider.
  2. Ask who imposed the restriction. If an exchange is involved, ask whether the action is based on an internal policy, a subpoena, a warrant, a court order, or another legal instrument. Ask for the issuing authority and a copy or identifying details if disclosure is legally permitted.
  3. Preserve ownership and transaction evidence. Export account statements, deposits, withdrawals, transaction IDs, wallet addresses, dates, acquisition records, invoices, tax records, and communications. Record which person or entity owned the bitcoin and the source of funds.
  4. Protect the evidence itself. Make read-only copies where possible and keep originals. Do not delete messages, reset phones or computers, wipe a hardware wallet, change relevant account settings, or edit transaction records. Keep a log of what you received and when.
  5. Do not move covered assets. Do not transfer bitcoin, sweep a wallet, hide keys, or ask someone else to hold the asset to defeat an order. A transaction made after notice of legal process can create additional criminal or civil problems and can destroy evidence.
  6. Contact qualified counsel promptly. Find a lawyer who handles asset forfeiture and digital-asset matters in the jurisdiction identified in the papers. Send counsel the original documents, not just screenshots, and identify every stated or possible deadline.
  7. Follow the notice, not a generic checklist. Claim forms, appeals, service requirements, and response periods vary. Have counsel verify where a filing must be sent, whether it must be sworn, and how proof of service is made.

Do not give investigators a substantive explanation, sign a statement, or consent to a search without legal advice. You may need to identify yourself or acknowledge receipt, but counsel should decide how to respond to questions about ownership, passwords, keys, or the underlying conduct.

Build an evidence packet for your lawyer

A complete, chronological packet lets counsel determine whether this is a provider dispute, a seizure, a civil forfeiture case, a criminal case, or more than one process at once.

  • Notices and process: seizure notices, warrants, freezing orders, forfeiture complaints, charging documents, court orders, envelopes, email headers, and portal downloads.
  • Custody information: the exchange or custodian’s name, account ID, support tickets, verification records, withdrawal history, and the dates access changed.
  • Blockchain identifiers: every relevant address, transaction hash, block explorer link saved as a record, and a description of which address belongs to whom. Do not alter the wallet merely to collect this information.
  • Acquisition and ownership: purchase confirmations, bank or card records, mining or payment records, loan or gift documents, company resolutions, and agreements showing beneficial ownership.
  • Communications: messages with the provider, investigators, business partners, employees, and anyone who had custody or authority over the bitcoin.
  • Loss and practical impact: evidence of business operations, payroll, ordinary living expenses, legal bills, and other facts that might support an exemption or variation where local law allows one.

Keep a second secure copy for counsel. If a device may be evidence, do not install recovery software or attempt forensic repairs before receiving instructions.

United States: federal process is document-specific

The U.S. Department of Justice Asset Forfeiture Policy Manual 2025, Chapter 4 describes procedures for government attorneys and agents. It is an agency manual, not a complete statement of every federal or state remedy available to an owner.

Bitcoin held by a U.S. provider

For cryptocurrency held with a U.S.-based virtual asset service provider, the manual describes obtaining and serving a seizure warrant on the provider. An exchange restriction in this setting may reflect compliance with that warrant, but the provider’s message alone does not tell you whether a separate civil forfeiture case has been filed or what claim route applies. Request the legal basis the provider can disclose and give the notice to counsel.

Self-custody in the United States

For self-custodied cryptocurrency located in the United States, the manual describes obtaining a seizure warrant and serving the owner or the owner’s counsel. A self-custody case can therefore involve service on a person rather than an exchange account. Preserve the served papers and do not attempt to defeat the warrant by moving funds or withholding information from counsel.

Foreign-located providers

The DOJ manual treats foreign-located providers separately and notes that international legal assistance may be necessary. A U.S. notice may not be the only process governing an overseas custodian, and a foreign court or regulator may impose additional requirements. Counsel may need to coordinate advice in more than one country.

Making a federal forfeiture claim

The official Forfeiture.gov online-claims FAQ explains that a claim contests the seizure and requests court proceedings. It says the claimant must describe the seized property, identify the claimant’s interest, and swear to those facts. That does not guarantee that the bitcoin will be returned or that every filing will proceed in the same way.

18 U.S.C. § 983 contains federal civil-forfeiture notice and claim rules. The applicable route and timing depend on the process and the notice you received. Read the actual notice and have counsel check the current statute, service date, filing destination, and whether a verified claim or another form is required. Do not import a deadline from an unrelated case.

United Kingdom: cryptoasset wallet-freezing and forfeiture powers

The UK Home Office’s circular 005/2024 summarizes cryptoasset-specific civil-forfeiture provisions inserted into the Proceeds of Crime Act 2002 by the Economic Crime and Corporate Transparency Act 2023. This is a UK-specific framework, not a general rule for other countries.

Wallet freezing orders

Under the regime described in the circular, a judicial authority can make a crypto wallet freezing order. An affected person may apply to vary, set aside, or recall the order. The order and the court’s directions control how and where such an application must be made; obtain advice before filing or dealing with the wallet.

Possible expense exclusions

The circular describes possible exclusions for reasonable living expenses, continuing a business, and legal expenses, subject to the court and statutory conditions. An exclusion is not automatic. Prepare evidence of the amount needed, the purpose, and why the request satisfies the applicable conditions.

The 30-day appeal period

For the forfeiture decisions covered by that circular, an appeal must be lodged within 30 days of the court order. This 30-day period applies to the specific UK provisions summarized there; it is not a universal deadline for challenging a bitcoin freeze or seizure. Confirm the order date, service date, appeal route, and any required permission with a UK lawyer.

Custody changes the practical response

Custody or location Questions counsel will need answered Potential complication
Exchange-held bitcoin Which entity controlled the account? What notice did it receive? Is the restriction contractual, regulatory, or warrant-based? The provider may control the keys and may be prohibited from disclosing the full order.
Self-custody Who controlled the seed or signing keys? What device and addresses were involved? What exactly did the warrant authorize? Changing devices, keys, or wallet activity can affect evidence and may be treated as an attempt to frustrate enforcement.
Domestic provider Which country’s court or agency issued the process, and where was the provider served? Local procedural rules may apply in addition to the law governing the underlying investigation.
Foreign provider Which jurisdictions have authority over the provider, the account holder, and the alleged conduct? International legal assistance and parallel proceedings can add delay and separate filing requirements.

Understand the type of proceeding

Provider restriction

A provider may restrict an account under its customer agreement or compliance procedures. Ask for the internal appeal or review path, but do not assume that an appeal to customer support replaces a legal claim or court deadline.

Civil forfeiture

Civil forfeiture generally concerns the government’s claim to the property itself. The owner’s response may require a timely claim identifying the property and the claimant’s interest, as the U.S. federal guidance illustrates. The exact pleading, verification, and hearing rules depend on the jurisdiction and notice.

Criminal confiscation or evidence seizure

Bitcoin may be held as evidence or be subject to confiscation connected with a criminal case. A property claim and a criminal defense can have different deadlines and strategic consequences. Tell one lawyer about every related investigation, charge, search, or plea discussion before choosing a response.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Initial freeze versus final order

An initial freeze or seizure preserves the asset while authorities investigate or litigate. A final forfeiture order changes the posture and may start an appeal period. The document’s title, issuing body, and operative language matter more than the label used in an email or by a support agent.

How long do you have to challenge it?

There is no single worldwide deadline. Timing can turn on the jurisdiction, whether the matter is administrative, civil, or criminal, the date and method of service, the kind of property notice, and whether an appeal or claim requires a particular form.

  • Write down every date shown on the notice and the date you actually received it.
  • Ask counsel to calculate the deadline under the governing law, including weekends, holidays, and service rules.
  • Use the filing address, portal, verification language, and delivery method specified in the notice.
  • Keep proof that the filing was delivered and accepted.

The UK example above states 30 days for appeals from the specified forfeiture decisions. U.S. federal civil-forfeiture notices have their own rules under the applicable process; the cited statute and notice must be read together. A general article cannot calculate your deadline without those documents.

What not to do

  • Do not transfer bitcoin to another wallet, exchange, person, mixer, or business to evade a freeze or seizure.
  • Do not conceal, destroy, or reset seed phrases, devices, records, or communications.
  • Do not guess at a response deadline or rely on a social-media template.
  • Do not sign a claim, waiver, consent, or ownership statement that you do not understand.
  • Do not assume that a hardware wallet, a new address, or a recovery-seed backup releases an asset subject to legal process.
  • Do not publicly post transaction details or allegations that could compromise an investigation or your legal position.

Can seized bitcoin be returned?

It can be possible to contest a seizure, seek release, challenge forfeiture, appeal an order, or request an allowed expense exclusion, but no general article can promise a return. The result depends on the ownership evidence, the government’s legal basis, the procedural posture, the conduct alleged, and the law of each relevant jurisdiction. A filed claim is a way to contest a seizure; it is not a guarantee of a hearing or recovery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Give counsel a factual timeline rather than a theory: when and how the bitcoin was acquired, who controlled it, when access changed, what authorities or providers said, and every step taken afterward. That record helps counsel choose between a provider review, a forfeiture claim, an application concerning a freezing order, a criminal-case motion, or coordinated action in another country.

Questions to take to your lawyer

  • What legal instrument restricted or seized the bitcoin, and is it validly served?
  • Is this a provider restriction, a court freeze, a seizure for evidence, civil forfeiture, criminal confiscation, or overlapping proceedings?
  • Which jurisdiction controls the asset, the custodian, and the alleged conduct?
  • What is the earliest deadline, and what form, oath, fee, service method, or permission is required?
  • Can any bitcoin or fiat be released for legal costs, living expenses, or business operations?
  • What communications with the exchange or investigators are safe, and who should send them?
  • How should devices, keys, and records be preserved without altering evidence?

Practical conclusion

Treat a bitcoin freeze or seizure as a time-sensitive legal-document problem, not as a wallet-technology problem. Identify who acted, preserve the notice and ownership trail, avoid any transaction that could violate an order, and obtain jurisdiction-specific advice immediately. The actual order, notice, service date, custody arrangement, and applicable law determine what challenge is available.
