If GST officers from different jurisdictions contact you, do not assume either that the second communication is invalid or that it cancels the first. Compare the authority, legal basis, subject matter, tax period and procedural stage of each communication; preserve the records and protect every response deadline. Central and State or Union Territory officers can have cross-empowered roles, but section 6(2)(b) of the CGST Act restricts proceedings on the same subject matter in the circumstances it covers.

Can officers from different GST administrations act on the same taxpayer?

Not simply because they belong to different administrations. Section 6 of the CGST Act provides for State and Union Territory tax officers to act as proper officers for CGST purposes, subject to applicable conditions; corresponding State GST provisions address Central officers. GST Council material also describes cross-empowerment for intelligence-based enforcement across the value chain.

In its judgment dated 14 August 2025, the Supreme Court of India explained that taxpayer allocation supports ordinary administration, while intelligence-based enforcement action may be initiated by either Central or State administration. The Court distinguished audit or detailed scrutiny of returns, which it said should be initiated by the administration to which the taxpayer is assigned. An officer outside your usual assigned interface is therefore not automatically unauthorized; the particular action still needs to be assessed under its legal authority and facts.

When can two communications raise a same-subject-matter issue?

Section 6(2)(b) addresses a situation in which a State or Union Territory proper officer has initiated proceedings on a subject matter: a CGST proper officer shall not initiate proceedings on the same subject matter, subject to the statutory scheme and conditions. The Supreme Court describes this restriction as a safeguard against multiple proceedings on the same subject matter.

Compare what each communication actually concerns, rather than relying on the officer names or broad labels such as “GST” or “tax.” Check whether they pursue the same GSTIN, transaction or alleged issue, tax period and subject matter, and note the legal provision and stage of each action. Two contacts about the same business are not necessarily about the same subject matter; different labels or officers do not, by themselves, settle whether an actual overlap exists.

How the action type affects the comparison

Situation Relevant distinction What to check
Assigned administration conducts an audit or detailed scrutiny The Supreme Court says these actions are ordinarily initiated by the administration to which the taxpayer is assigned. Assigned jurisdiction, legal provision, tax period, records and procedural stage.
Central or State administration takes intelligence-based enforcement action The Court says either administration may initiate this kind of action; cross-empowerment also appears in GST Council material. Stated enforcement basis, actual subject matter, any earlier proceeding on that matter and applicable legal conditions.
Registration jurisdiction changes while a matter is under way CBIC Circular 255/01/2026-GST, dated 25 June 2026, is described as preserving valid action taken before a migration or transfer and assigning subsequent stages and pending matters to the new jurisdiction. Effective transfer date, authority when each action was taken, current authority and the CBIC-hosted circular text.

Does a GST summons count as proceedings?

Not by itself for the purpose of the section 6(2)(b) restriction. The Supreme Court held that “the issuance of summons under Section 70 of the CGST Act is not hit by Section 6(2)(b) of the CGST Act”. The Court distinguished an inquiry from proceedings for this statutory purpose. That holding concerns the summons/proceedings distinction; it does not establish that every summons, or any later notice, is valid.

What should you do after receiving communications from different jurisdictions?

  1. Preserve the record. Save each complete communication and its enclosures, the envelope or email metadata, and any GST portal record. Record when and how it was served.
  2. Make a notice-by-notice inventory. For each communication, note the GSTIN, issuing officer, Central, State or Union Territory administration, jurisdiction shown, statutory provision, communication type, tax period, alleged issue and response date.
  3. Put them in date order and mark the stage. Identify whether each is a summons or inquiry, audit or scrutiny communication, show-cause notice, order, appeal or review step, or another action. A summons and a formal proceeding are not interchangeable for the section 6(2)(b) analysis.
  4. Compare the substance and procedural history. Check whether the same GSTIN, issue or transaction and period are being pursued. Keep earlier replies and records of any proceeding; the action dates and stages matter as well as the officers involved.
  5. Check for a jurisdiction change. If the registration moved, record the effective date and determine which authority acted before and after it. For the 2026 circular’s migration or transfer framework, verify the current text on the CBIC website before relying on it.
  6. Get case-specific advice promptly and protect each deadline. Ask a qualified GST professional or lawyer to assess any apparent overlap, the proper authority and the response strategy. Do not ignore a live communication or presume that another one cancels it; respond within applicable deadlines unless competent counsel confirms a lawful procedural course.

What if the GST registration moved to another jurisdiction?

The transfer issue is distinct from a dispute about cross-empowerment between administrations. Circular 255/01/2026-GST is dated 25 June 2026. Its reported framework says valid action by the authority that had jurisdiction when it acted remains valid after the move; the new jurisdiction handles subsequent stages and takes over a matter pending at transfer; and the former authority should not initiate new action after the transfer. The CBIC portal listing surfaced the circular’s title and date, while the accessible full text was a specialist reproduction. Check the CBIC-hosted original and the effective transfer date before applying that framework to a live matter.

What the available rules do not decide automatically

The statutory and judicial distinctions help identify the right questions, but they do not provide a universal objection format or guarantee that an overlapping communication will be withdrawn. The outcome depends on the actual subject matter, procedural record, legal authority and dates. The Supreme Court judgment and GST Council material establish that a different administration alone does not invalidate an action, while the transfer circular should be checked against its official CBIC text before reliance.
