Keep the letter and envelope, identify the agency, program, tax year or loan, requested action and response date, then verify the communication through official IRS or SBA resources you reach independently. Follow the instructions for that specific notice: an IRS tax adjustment, an SBA identity-theft case, a PPP appeal and an SBA repayment demand do not share one response process or deadline.
First, verify the notice and preserve the record
- Keep every page and the envelope. Scan or copy them, and note when the letter arrived. Record the agency, program (such as the Employee Retention Credit, PPP or COVID EIDL), tax period or loan identifier, response deadline, documents requested and stated submission method.
- Check the communication independently. Do not rely on a phone number, QR code, payment link or email address solely because it appears in a suspicious message. Go directly to IRS.gov or SBA.gov and use the agency’s notice or program guidance to check what you received. An SBA logo alone does not prove that a webpage is accurate or endorsed by SBA.
- Keep a response file. Save copies of letters, forms and supporting records you send, along with dates and notes from any calls. Use the contact route verified through the relevant agency if you need clarification.
A real agency can contact you by mail, so an unexpected letter is not automatically a scam. Conversely, a message claiming to be from the government may be fraudulent. Treat the sender and requested action as questions to verify, not as proof either way.

Which process applies to your notice?
| Process | What triggers it | Deadline | What to do |
|---|---|---|---|
| IRS tax or ERC notice | A letter about a tax return, examination, adjustment or employment-tax credit | Use the date and instructions in that notice; there is no single deadline for all IRS letters. | Verify the notice, identify the tax year and issue, then respond using the notice’s instructions. |
| SBA identity-theft submission | You believe someone used your information to obtain SBA funding without permission | Use any date specified in your SBA communication; the identity-theft guidance does not establish one universal deadline for all cases. | Submit the SBA-requested identity-theft documents through a current route listed by SBA. |
| SBA Office of Inspector General (OIG) complaint | You want to report suspected fraud, waste, abuse, mismanagement or misconduct involving an SBA program or personnel | No universal response deadline is stated for making a complaint. | Give OIG the relevant facts and supporting material. A complaint does not answer a notice addressed to you. |
| Lender decision on a PPP loan | Your lender made a decision you dispute | The SBA Office of Hearings and Appeals (OHA) says it does not hear appeals of lender decisions. | Contact the lender about its decision. |
| Qualifying final SBA PPP loan review decision | You received a final SBA loan review decision in a category OHA can hear | File within 30 calendar days after receipt of the qualifying final decision. | Use the OHA appeals portal and follow the applicable procedural rule and any OHA order. |
| SBA repayment or demand letter | SBA seeks repayment of a pandemic-era loan | Use the deadline in the particular letter; the PPP appeal deadline does not automatically apply. | Follow the amount, response route and timing specified in the verified demand letter. |
Responding to an IRS notice, including an ERC issue
Use the notice’s own instructions and deadline. IRS procedures differ by letter and tax issue, so do not substitute steps from a different notice number. Check the tax year and the issue under review, preserve relevant returns and records, and contact the IRS through a route you independently verify if something is unclear.

If the letter concerns the Employee Retention Credit (ERC), check which eligibility period and employment-tax return it addresses. The IRS says the ERC is claimed on a federal employment tax return, and eligibility depends on the period. An incorrect claim may have to be repaid, with penalties and interest. A request to review or correct a claim is not, by itself, proof that the taxpayer intentionally committed fraud.

SBA lists Loan Portal upload and program-specific email routes, as well as fax and mail options. Because these channels and addresses can change—and the submission includes sensitive identity documents—check SBA’s current “Report fraud or identity theft” page before sending anything. Keep a copy of each item and a record of the submission.
Reporting suspected SBA misconduct is separate from defending yourself
The SBA OIG Hotline accepts complaints about fraud, waste, abuse, mismanagement or misconduct involving SBA programs or personnel. Useful information includes the program name; identifying or contact details for the subject, if known; what happened; the activity’s scope and timeframe; and relevant attachments.

- Great way to organize and store vital tax records
- Instruction sheet/checklist and preprinted labels included
- 12 pockets plus one large pocket in back provides ample storage
- Protective flap and elastic cord closure
- Contains 10% recycled content, 10% post-consumer material
OIG says you do not have to provide personally identifying information, though an anonymous report may be harder to process. If you received a notice addressed to you, filing an OIG complaint does not replace responding to that notice through its stated process.

OHA does not hear appeals of lender decisions. For a qualifying final SBA loan review decision, its guidance gives borrowers 30 calendar days after receipt to file through appeals.sba.gov. The appeal should include the decision being challenged, a full and specific explanation supported by facts and legal arguments, and contact information for the borrower or counsel.

What an SBA pandemic-loan demand letter means
In a September 16, 2026 announcement about Operation NO DOZE, SBA OIG said demand letters identify the amount SBA seeks and explain how the recipient may repay or otherwise respond. The announcement describes possible Treasury collection and administrative, civil or criminal referral if a matter is not resolved on time. The exact amount, response route and deadline are in the individual letter, so verify it and act promptly rather than applying the PPP appeal timetable by default.
That enforcement context does not establish that any particular recipient committed fraud. SBA’s September 2026 announcement also described suspensions involving 870,000 U.S. borrowers and an estimated $39 billion in suspected pandemic-era PPP and COVID EIDL activity; those figures describe agency-reported suspected activity, not proven fraud by every borrower named or affected.
Quick Recap
If you paid a scammer or shared information
- Stop communicating with the suspected scammer and do not send more money or personal information.
- Contact your financial institution if you shared payment details or sent money.
- Use IdentityTheft.gov if your identity information was misused, and follow IRS guidance if tax identity theft is involved. The IRS also advises considering a report to your state tax agency, setting up an IRS account and obtaining an Identity Protection PIN for tax identity theft.
- For a suspicious IRS email, do not reply, click links or open attachments. The IRS directs recipients to forward phishing email to [email protected]. Reporting instructions vary for email, text, social media, websites, phone calls and mail, so check the current IRS page on reporting fake IRS, Treasury or tax-related messages.
- Be wary of anyone who promises to recover money for a fee; scam victims may be targeted again.
