What to Do If You Receive a Copyright Notice for Downloading a ROM

If you receive a copyright notice tied to a ROM download, first identify who sent it and what kind of document it is. A U.S. DMCA takedown notice by itself does not mean you are being sued; a subpoena or court papers are a separate matter and warrant prompt legal advice. Preserve the notice, verify it through the relevant service’s official channel, and do not send a counter-notice unless you genuinely believe material was removed by mistake or misidentification. This is general U.S. procedural information, not a determination that a particular ROM download or use was lawful.

First, identify the notice and its sender

Do not treat every message mentioning copyright as a DMCA takedown notice. The sender, document type, requested action, deadline, and whether any content was actually disabled all matter. An ISP warning or a private demand may follow a different process from a platform’s removal notice; the U.S. Copyright Office materials explain the DMCA procedure, not every provider’s warning or private demand workflow.

What you received What it generally indicates What to check next
Platform or hosting-service takedown notice A service says material was removed or disabled following a copyright complaint. Check the affected material, the former location, the complainant details, and the service’s official DMCA instructions.
ISP warning A notice or warning from your internet provider; it is not necessarily a platform takedown or court filing. Verify it with the ISP using its official website or support channel, and note any requested action or deadline.
Private demand letter A communication from a rightsholder or representative; its terms and legal significance depend on the document and circumstances. Preserve it and seek qualified legal advice promptly if it threatens litigation or asks for consequential action.
Subpoena or court papers A separate legal process, not simply a platform removal notice. Contact a licensed attorney in the relevant jurisdiction promptly and follow applicable deadlines.

For a platform message, access your account through the service’s official site or contact its support channel independently. Do not rely on a link or contact address that appears only in an unverified message, particularly before sending personal information.

Does a takedown notice mean you are being sued?

No. The U.S. Copyright Office’s Section 512 FAQ answers: “No, a takedown notice does not mean you are being sued. If you are being sued, you will be served with court papers.” A takedown is part of a service-provider removal process; a summons, complaint, subpoena, or other court document requires separate attention.

A compliant DMCA notice identifies the copyrighted work and the allegedly infringing material and its location, provides complainant contact information, and includes required statements about good-faith belief and authority. The provider must act expeditiously to remove or disable access to material covered by a compliant notice and notify the user. See the Copyright Office’s overview and FAQs and the statutory text.

What to do now

  1. Save the complete record. Keep the notice and related emails, including attachments and headers where available. Record when it arrived, any deadline, the sender, the work or activity identified, and what action the service says it took. Do not destroy related records.
  2. Verify the message. Sign in by typing the service’s official web address or reach its support team through a verified channel. If it claims to be a DMCA notice, compare it with the provider’s published copyright instructions.
  3. Determine whether access was disabled. A platform takedown concerns hosted material that has been removed or made unavailable. An ISP warning or private letter is not automatically the same process.
  4. Check for formal legal documents. If the communication is a subpoena, summons, complaint, or court paper—or threatens litigation or demands a consequential response—consult a licensed attorney promptly in the relevant jurisdiction.
  5. Do not assume the notice settles the underlying issue. These procedures do not establish whether a particular ROM download, possession, backup, or use is lawful.

Should you send a DMCA counter-notice?

A counter-notice is for a user whose hosted material was removed and who genuinely believes the removal resulted from mistake or misidentification. It is not a general appeal for anyone who disputes a copyright claim, and it is not an automatic response to an ISP warning or private demand. If you are uncertain whether the removal was mistaken, get legal advice before making sworn statements.

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  • Your name, address, and telephone number.
  • Your consent to the jurisdiction of the relevant federal district court, and agreement to accept service of process from the person who submitted the original notice or that person’s agent.

The statute and the Copyright Office’s Section 512 guidance explain these requirements. Knowingly making a material misrepresentation in a counter-notice can expose you to liability for resulting damages, costs, and attorneys’ fees. Use the provider’s official DMCA instructions and its entry in the DMCA Designated Agent Directory; do not send identifying information to an address supplied only by an unverified message.

What happens after a counter-notice?

Under the statutory process, a provider may restore the material between 10 and 14 business days after receiving a compliant counter-notice unless it first receives notice that the rightsholder has filed a court action seeking to restrain the user. This is a U.S. procedural window, not a guarantee about every platform’s handling or every type of notice. The service’s official instructions describe where and how it accepts submissions.

What these procedures do—and do not—tell you about ROMs

The Copyright Office sources describe notice-and-takedown procedure; they do not decide whether the specific ROM-related activity in your situation was lawful, establish whether your particular message is authentic, or explain every response to an ISP warning or private demand. They also do not establish the rules outside the United States. A takedown alone is not proof that you are being sued, but removal does not by itself resolve any underlying dispute.
