What to Do if You Discover Human Bones on a Construction Site

Stop every excavation or other activity that could disturb the find. Keep people, vehicles and equipment out of the area, leave the bones and surrounding soil exactly where they are, and protect the location from weather, vandalism and public view without altering it. Tell the site supervisor, the local coroner or medical examiner and law enforcement immediately. Work in the affected area can restart only when the official with authority over the site releases it; federal and tribal land generally requires written certification.

First actions in the first few minutes

A discovery may be a recent forensic case, a historic burial or an archaeological site. A crew cannot reliably tell which one it is from appearance alone. Treat every suspected human bone, tooth or skull as a protected discovery until an authorized official decides otherwise.

  1. Stop the source of disturbance. Shut down excavators, trenchers, graders, drilling, hauling and hand work that could affect the find or its surrounding soil. Washington guidance directs anyone whose ground disturbance exposes remains to cease activity that could cause further disturbance. The Washington State Department of Transportation’s July 2024 construction manual says all work adjacent to a discovery must stop. The safe perimeter depends on the jurisdiction, project plans and the extent of the burial; do not choose a distance by guesswork.
  2. Make the area safe without entering the find. Move workers and equipment away from unstable edges, suspended loads, traffic and other hazards. Keep a route open for emergency responders. Do not step through the exposed soil, probe for additional bones or take samples.
  3. Leave the discovery in place. Do not touch, wash, collect, reposition or distribute bones, grave goods, clothing, tools or soil. If rain, animals or vandalism threaten the location, use only a protective measure that does not contact or shift the remains, and follow the responding official’s directions before placing any cover.

Secure and preserve the scene

Assign one person from the site chain of command to control access while the supervisor makes notifications. Use barriers, a spotter or existing fencing to keep workers, visitors and vehicles out. Keep the location out of public view where practical; do not post photographs, coordinates or speculation on social media and do not invite media onto the property. Access should be limited to the supervisor, the coroner or medical examiner, law enforcement and authorized cultural-resources personnel.

Preservation is about context as much as the bone itself. Soil layers, the position of fragments and nearby objects can establish whether a discovery is a burial, a crime scene or an archaeological deposit. Even apparently loose fragments can be evidence. A well-intentioned attempt to “clean up” the area can destroy information officials need.

Who to call and what to report

Use the project’s emergency and inadvertent-discovery plan if one exists. Otherwise make these notifications without delay:

  • Site supervisor or project engineer: report the exact work operation, shutdown time and location.
  • Local coroner or medical examiner: that suspected human remains were exposed, whether anyone was injured and whether the remains appear recent.
  • Local law enforcement: especially when remains could be recent, disturbed by a crime or at risk of removal. Police and the medical examiner control a possible crime scene.
  • Land-managing authority: contact the responsible federal agency on federal property. On tribal land, notify the designated tribal authority as well as the federal contact required by the land-management agreement.
  • Cultural-resources authority: once the coroner or medical examiner addresses forensic concerns, follow the state archaeologist, historic-preservation office or agency archaeologist’s instructions.

When you call, state that work has stopped and give the project name, address, access instructions, exact location within the site, what was exposed, the equipment involved, immediate hazards and the names of people already notified. Ask for a case or incident number and the official’s instructions for securing the area. Do not offer a conclusion about age, identity, ancestry or cause of death.

Document only what the response protocol requires

Make a factual log while the details are fresh. Record the date and time of exposure, the time work stopped, the task and machine involved, the location reference used by the plans, visible hazards, access restrictions and every notification (person, agency, time and instructions). Preserve original photographs or survey data only if your protocol permits them and officials do not object; do not move objects to obtain a better image. Keep the log and any authorized images secure as project records.

Do not publish the location or send images through informal group chats. A public post can attract trespassers, damage the context and compromise a forensic investigation. Route all external questions through the owner’s designated spokesperson or the responding agency.

How the determination is made

Forensic remains or a possible crime scene

The coroner or medical examiner decides whether the remains are forensic. If they appear recent or circumstances are suspicious, law enforcement may establish a crime scene, restrict entry, document the area and direct any recovery. Contractors must not make that classification themselves. Pennsylvania Department of Transportation guidance, for example, directs police notification when remains appear recent and otherwise directs the county coroner.

Historic or archaeological remains

If the coroner determines that the remains are non-forensic, the matter is generally referred to cultural-resources officials. A state archaeologist, physical anthropologist, tribes or descendants may be consulted. Officials can require a professional survey, controlled excavation, reburial, avoidance or another treatment before construction proceeds. The presence of associated objects or a burial feature can change the required process even when the bones are old.

Why crews should not sort bones on site

Age and cultural affiliation cannot be established safely from a quick visual inspection. A fragment that looks animal or ancient can still require protection, and removing one piece can make the remaining evidence harder to interpret. Leave identification, dating and affiliation to qualified authorities working under the applicable law.

State rules differ, so check the site’s jurisdiction

The common safety response is consistent, but state law controls contacts, distances, deadlines and restart authority. The following examples illustrate why a project’s location matters:

Jurisdiction or guidance Requirement described by the authority
Washington Anyone whose ground disturbance exposes human remains must cease activity that could further disturb them. WSDOT’s July 2024 manual says work adjacent to the discovery must cease.
North Carolina Immediate notice to the medical examiner is required, and construction disturbance must not resume without authorization.
Florida Cessation and notification requirements apply even when the discovery is on private property.
Tennessee Remains of every age are protected. Stop work in the immediate area and notify the medical examiner or coroner and local law enforcement.
Missouri An unmarked burial encountered during construction carries a 50-foot cessation radius.
Nebraska Stop immediately and report to local law enforcement within 48 hours.

These examples are not a substitute for the law where your project is located. A county, permit condition or state agency may impose a different boundary or a shorter reporting period. Before breaking ground, the project owner should identify the applicable state and county contacts and place them in the site plan.

Special rules on federal and tribal lands

The National Park Service’s NAGPRA guidance requires the responsible person to immediately stop activity that could threaten a discovery, report it and document that work has stopped. Work must not resume until the appropriate official issues written certification. Notifications can include the federal land manager, the Secretary or agency with primary management authority, and the appropriate Indian tribe or Native Hawaiian organization.

Do not assume that a private contractor’s contract manager can waive these requirements. Follow the land-management agency’s inadvertent-discovery plan and any tribal agreement for the project. Keep the area protected while the agency determines whether the discovery is a Native American burial, another cultural item or a forensic matter. Written direction should identify the area released, any conditions on resumed work and any portion that remains closed.

When can construction resume?

Stopping the machine is not the same as receiving clearance. Continue to isolate the affected area until the responsible authority tells you what may restart. A verbal assurance from a coworker, subcontractor or equipment operator is not a release. Ask for written clearance when state law, a permit, the federal land manager or the project’s cultural-resources plan requires it; on federal or tribal land, NAGPRA guidance specifically calls for written certification.

The release may cover only a defined zone. Confirm the coordinates or station limits, the equipment and methods allowed, monitoring requirements and the person who must be present. Update the daily briefing and method statement so operators do not re-enter a protected area by mistake. If additional bones or objects appear after work resumes, stop again and repeat the notification process.

Worker safety and OSHA reporting

A bone discovery can coincide with ordinary excavation hazards such as a collapsing trench, contaminated soil, traffic or unstable equipment. Follow the employer’s hazard-control and incident procedures, keep workers out of unsafe areas and ask the competent safety officer what controls are needed. Do not enter a trench or climb into an excavation merely to inspect the find.

OSHA’s reporting page addresses work-related fatalities and severe injuries such as hospitalization, amputation or loss of an eye, with variations for state-plan jurisdictions. It does not identify a bone discovery by itself as an automatic OSHA report. If a worker was injured, exposed to a hazard or suffered another reportable event, the employer must evaluate that event under the applicable OSHA and state-plan rules separately from the remains notification.

Common mistakes that create legal and practical problems

  • “It is probably an animal bone.” Guessing can destroy a burial or crime scene. Treat uncertainty as a reason to stop.
  • Moving the skull or a fragment for safekeeping. Relocation removes evidence about position and may violate state or federal protections.
  • Covering the find with soil or a tarp without instructions. Contact, pressure or runoff can alter the context. Protect it only by a method officials approve.
  • Letting another crew continue nearby. Vibration, trenching, grading and hauling can disturb remains outside the original machine’s footprint. Define the closed area with the supervisor and responding officials.
  • Calling only the project owner. Internal notice does not replace the coroner, medical examiner or law-enforcement report required by local rules.
  • Resuming after an informal phone call. Confirm the authorized release, its boundaries and any monitoring or permit conditions.
  • Publishing photos or coordinates. Publicity can invite theft, trespass and damage, and can interfere with a forensic investigation.

Prepare before excavation begins

Owners and contractors can reduce confusion by putting an inadvertent-discovery procedure in the bid documents, orientation and daily briefing. The plan should identify the local coroner or medical examiner, law-enforcement dispatch, the state cultural-resources contact, the federal land manager or tribal contact when applicable, and the person authorized to stop work. Include a site map, emergency access route, communication tree and a simple incident form.

Train operators and laborers to recognize that a discovery is a stop-work event, not a sorting task. Make clear that subcontractors have the same obligation to preserve the location. Keep barriers and weather-protection materials available, but emphasize that equipment never substitutes for notification. A short rehearsal of who calls whom and who controls the gate is more useful than asking workers to interpret burial law at the machine.

Quick-reference checklist

  • Stop excavation and every activity that could disturb the remains or surrounding context.
  • Move people and equipment away from physical hazards; establish a controlled perimeter.
  • Do not touch, move, clean, collect or redistribute bones, objects or soil.
  • Protect the location from weather, vandalism and public view without altering it.
  • Notify the site supervisor or project engineer, coroner or medical examiner and law enforcement.
  • On federal or tribal land, notify the responsible agency and the appropriate NAGPRA contacts.
  • Record times, location, equipment, hazards and notifications as your protocol requires.
  • Wait for the authorized determination and obtain the required written clearance before restarting work.
