What to Do If You Discover Archaeological Artifacts During Home Construction

Stop construction in the immediate area, leave the object where it is, protect the location, and notify the archaeology or land-management authority named by your jurisdiction or permit. If anything could be human bone or a grave, treat it as an emergency: keep everyone out, call law enforcement and the coroner or medical examiner immediately, and do not touch or move the material. Do not assume that a discovery on private property is yours to keep, sell, or remove. The correct response depends on your land status, location, and what has been uncovered.

The first 10 minutes after a discovery

Your priority is preservation, not identification. Soil layers, fragments, tool marks, and the relationship between objects can be more important than the object itself. Follow this sequence before calling anyone to the site.

  1. Stop work in the immediate area. Shut down excavation, grading, trenching, drilling, and any equipment that could strike or bury the find. Keep operating machinery outside the protected area.
  2. Leave everything in place. Do not pick up, wash, scrape, repair, separate, or rotate an object. Do not dig around it to see whether more material is present.
  3. Mark and secure the location. Use temporary construction fencing, barrier tape, stakes, or flagging to keep workers, vehicles, children, pets, and curious visitors away. A barrier is site control, not permission to resume work.
  4. Keep the location discreet. Do not post exact coordinates, recognizable photographs, or directions on social media. Potential archaeological resources can attract looters before officials evaluate them.
  5. Document without disturbing the find. If it is safe and your local authority permits photography, take clear images showing the object in place and include a simple scale such as a coin or pen. Record the address, date, time, excavation depth, nearby construction activity, and everyone who saw the discovery.
  6. Notify the right authority. Contact the local or state/provincial archaeology office, the project archaeologist, the land-management agency, or the official identified in your building or excavation permit. On federal or tribal land in the United States, follow the responsible agency’s Native American Graves Protection and Repatriation Act (NAGPRA) procedure.
  7. Wait for instructions. Do not promise a contractor a restart time. Work near the discovery resumes only after the responsible authority or a qualified archaeologist gives the required clearance, assessment direction, treatment plan, or written certification.

How to tell what kind of discovery you have without handling it

You are not expected to authenticate an artifact in the field. Describe what is visible and let qualified officials determine whether it is modern debris, an archaeological object, a feature, or human remains. A seemingly ordinary item can be significant because of its depth, position, or association with other material.

Loose objects and fragments

Pottery sherds, worked stone, glass trade beads, metal tools, bullets, coins, shell, bone, or pieces of brick may be isolated artifacts or part of a larger site. Their value to archaeologists often comes from the undisturbed soil around them. Keep all fragments together exactly as found and do not put them in a bag or toolbox.

Features in the ground

Dark soil stains, aligned stones, post holes, walls, hearths, pits, buried floors, and clusters of objects are features rather than single portable finds. Widening a trench to “look for more” can destroy the pattern officials need to interpret the site. Stop the equipment at the edge of the visible area and mark the boundary.

Possible human remains or a burial

Never decide from appearance whether bones are recent, historical, or archaeological. A fragment can be difficult to identify in the field, and associated clothing, coffins, tools, or funerary objects may be legally protected. Keep the area untouched and contact police and the coroner or medical examiner immediately. State guidance in Florida, Tennessee, Queensland, and Washington all treats suspected human remains as requiring prompt official involvement.

Who to call: jurisdiction and land status change the answer

There is no single homeowner rule. British Columbia protects archaeological sites on both public and private land and requires a permit before alteration. Queensland requires reporting of discoveries during development and immediate police notification for suspected human remains. In the United States, federal and tribal lands can trigger NAGPRA duties for Native American human remains, funerary objects, sacred objects, and objects of cultural patrimony.

Private property, ordinary suspected artifact Local or state/provincial archaeology office, project archaeologist, or permit contact Private ownership does not automatically authorize disturbance, removal, sale, or export.
State, provincial, municipal, or other public land Land-management agency and its archaeology or heritage official Follow the agency’s stop-work and site-protection instructions; permits may be required before any alteration.
U.S. federal land or a federally authorized project Responsible federal official under the project procedure; NAGPRA official when applicable Written discovery records and consultation with an affiliated tribe or Native Hawaiian organization may be required.
Tribal land or a discovery potentially affiliated with an Indigenous nation Tribal cultural-resource authority and the designated government official Do not publish the location; cultural affiliation and disposition are determined through the applicable legal process.
Possible human remains anywhere Law enforcement and the county coroner or medical examiner; then archaeology or heritage officials Preserve the scene. Do not move bones or associated objects unless emergency responders direct you to do so.

Tell the person who answers that the discovery occurred during active construction, give the exact property address, state whether bones may be involved, and explain what work has stopped. Ask for a case number, the official’s name, and written instructions if possible.

Human remains require an emergency response

When bones or a possible grave appear, stop all nearby work and prevent entry to the area. Call law enforcement and the coroner or medical examiner immediately, even if the bones look old. Officials must determine whether the matter is forensic, historic, archaeological, or a combination.

Florida’s Division of Historical Resources warns that moving or removing items can destroy forensic or archaeological data needed to understand the remains. Tennessee guidance states that tampering with human burials or funerary objects without a court order is illegal. Washington State Parks summarizes the operational response as Stop, Protect, Notify: stop activity, protect the area, and notify law enforcement and the county medical examiner or coroner.

Do not clean dirt from bones, lift a skull, open a coffin, remove jewelry, or separate objects found nearby. Keep photographs and descriptions private until officials advise otherwise. If an emergency such as a gas leak or unstable trench makes the location unsafe, leave and tell responders about the hazard rather than attempting to secure it yourself.

What to record for the officials

Make a factual record while the scene is intact. Do not estimate cultural age or affiliation; record observations and measurements instead.

  • Property address and whether the land is private, municipal, state or provincial, federal, or tribal.
  • Date and time of discovery, weather, and soil or site conditions.
  • The construction task in progress, equipment used, and the depth and dimensions of the excavation.
  • Exact location, coordinates if safely available, or a measured distance from permanent features such as a foundation corner.
  • A description of every visible object, bone, stain, wall, pit, or cluster, including what remains embedded in the soil.
  • Photographs taken in place, with a scale and a wider image showing the surroundings, when photography is allowed.
  • Names and contact details of workers, owners, contractors, or visitors who witnessed the find.
  • The time work stopped, how the area was fenced or marked, and any steps taken to prevent weather, erosion, looting, or vehicle damage.
  • Every call or message made to an authority, including the date, recipient, case number, and instructions received.

For discoveries covered by NAGPRA procedures, written documentation must identify the location, contents, and protective steps taken. Keep the record with the project file and provide copies to the designated official.

How long will construction be stopped?

No universal deadline applies to a home project. The pause can last from a short site visit to a longer assessment, consultation, excavation, or treatment process. The duration depends on what was found, whether human remains are involved, land ownership, weather and safety, the availability of specialists, and the legal approval required before work resumes.

Authorities may allow construction to continue in unaffected areas while the discovery vicinity remains protected. Alexandria, Virginia, for example, requires the contractor to halt activity within the area surrounding a discovery; work elsewhere can proceed only when it is outside that vicinity and officials allow it. Other programs may require an archaeologist’s monitoring, a written treatment plan, or written certification before resumption.

A frequently misunderstood number is 72 hours. Under 30 CFR § 585.702, a covered operator on the U.S. Outer Continental Shelf must halt seafloor-disturbing activity and notify the Bureau of Ocean Energy Management within 72 hours. That is a specialized offshore rule, not a general reporting deadline for private home construction. Do not use it to justify waiting three days before calling your local authority.

Can you keep, sell, or remove what you found?

Do not make that decision at the excavation. Ownership and disposition depend on the jurisdiction, land status, object type, cultural affiliation, permit conditions, and whether human remains or funerary objects are involved. British Columbia’s Archaeology Branch states that archaeological sites on private land are protected and asks people not to disturb finds or remains. Queensland also warns that failing to report discoveries during development can result in fines.

Even where a landowner may eventually receive an object, removal before assessment can violate a permit or destroy information that gives the object its legal and historical meaning. On federal or tribal projects, NAGPRA can require consultation and a formal process for culturally affiliated remains and items. Wait for written direction about custody, documentation, conservation, transfer, or return.

What not to do

  • Do not pocket an object, wash it, polish it, restore it, or throw away associated fragments.
  • Do not widen, deepen, or hand-dig the excavation to search for additional material.
  • Do not drive machinery, dump soil, pump water, or store materials inside the protected area.
  • Do not invite collectors, amateur diggers, or media to the location.
  • Do not publish exact coordinates or identifiable site photographs.
  • Do not promise a restart date before the responsible authority responds.
  • Do not rely on a verbal assumption that private land means unrestricted removal rights.
  • Do not ship, sell, or advertise the object while its status is unresolved.

A practical contractor and homeowner workflow

Before excavation begins

Give the contractor the permit conditions and emergency contacts, identify whether the parcel is near a recorded heritage area or cemetery, and decide who has authority to stop work. Keep barrier tape or temporary fencing available. A simple site plan with property lines, utilities, and the planned excavation makes later location recording more accurate.

When a worker reports a find

The site supervisor should stop the equipment, move workers to a safe distance, photograph only if allowed, and notify the owner and designated authority. The owner should preserve the work log, secure the site, and make the required calls. One person should keep a written timeline so that officials receive consistent information.

While waiting

Protect the find from rain, runoff, animals, and accidental vehicle movement without covering or touching it unless officials instruct you to do so. Continue only unrelated work that is clearly outside the protected area and approved by the responsible authority. If the authority requests an archaeologist, monitoring, testing, or a treatment plan, obtain that scope in writing and keep all reports with the permit file.

Key takeaways by discovery type

Discovery Immediate action Resume condition
Possible artifact or feature Stop nearby work, leave it in place, secure and document the area, notify archaeology or the permit authority. Instruction or clearance from the responsible authority or qualified archaeologist, according to local rules.
Possible human bone or grave Stop all nearby work, protect the scene, call police and the coroner or medical examiner immediately. Official determination and any required forensic, archaeological, tribal, or court process.
Federal or tribal discovery subject to NAGPRA Stop threatening activity, document the location and contents, notify the responsible official and potentially affiliated Indigenous nation. Required consultation, treatment, and, where applicable, written certification.
Offshore federal construction under 30 CFR § 585.702 Halt seafloor-disturbing activity and notify the Bureau of Ocean Energy Management within 72 hours. BOEM direction under that offshore rule; it does not govern ordinary homebuilding.
