What to Do If You Discover an Indian GST Notice After the Reply Deadline

If you discover an Indian GST notice after its reply deadline, first check whether the tax authority has already issued an order. If no order has been issued, promptly prepare the reply and send the proper officer a written explanation for the delay, asking that the reply be considered and requesting a hearing. If an order has been communicated, focus immediately on the separate appeal deadline. A late reply is not automatically accepted, and the appeal’s possible extra time does not extend the notice-reply deadline.

First establish whether you are responding to a notice or challenging an order

Read the entire notice and check the GST Portal for attachments, later communications, and any order. Note the notice type and cited section, issuing authority, date and method of service, stated reply deadline, hearing date, tax periods, and amounts involved. Keep the notice and order distinct: a reply deadline concerns the notice-stage process, while the appeal period described by the GST Portal and section 107 of the CGST Act runs from communication of an adjudicating order.

The GST Portal describes filing an appeal against an order, not as a substitute for a missed notice reply. Do not assume an appeal is available merely because the reply deadline has passed. The relevant remedy depends on what has actually happened in your case. See the GST Portal’s appeal guidance.

Procedural stage What to focus on
No order issued yet Prepare the substantive reply and evidence; explain the delay in writing, ask that the reply be considered, and request a hearing. Acceptance is not assured.
An order has been communicated Calculate the appeal period from the order’s communication date and urgently check appeal eligibility, any condonation request, pre-deposit, and filing requirements.

Preserve the notice, service evidence, and timeline

Save the notice, every attachment, portal downloads and service records, and relevant email or other delivery evidence. Make a dated record of when you actually discovered the notice, why the response was missed, and any steps already taken. These details may support a request for consideration or a sufficient-cause argument, but do not guarantee relief.

  • Record the service and discovery dates separately; do not assume they are the same.
  • Keep copies of any earlier reply, extension request, hearing communication, or portal acknowledgement.
  • Match the tax periods and amounts in the notice against your records and identify what is admitted and what is disputed.

If no order has been issued, act promptly in writing

Prepare the full reply with relevant supporting documents rather than sending only a request for more time. Write to the proper officer, explain the circumstances of the delay, ask that the reply and evidence be taken on record, and request a hearing. Retain proof of submission through the applicable channel.

Section 75(4) of the CBIC-hosted CGST Act text states: “An opportunity of hearing shall be granted where a request is received in writing from the person chargeable with tax or penalty, or where any adverse decision is contemplated against such person.” Section 75(5) says the officer shall, if sufficient cause is shown, grant time and adjourn a hearing for reasons recorded in writing; the passage also limits adjournments. These provisions concern a hearing and adjournment. They do not establish an automatic mechanism for reviving an expired reply deadline or require acceptance of every late reply. Read the CBIC-hosted CGST Act text.

If an order has issued, calculate the appeal deadline immediately

The GST Portal FAQ and section 107 of the CGST Act describe a general appeal period of three months from communication of the order. They also describe a possible extension of up to one additional month where sufficient cause prevented timely filing. That additional month is discretionary, not automatic, and relates to an appeal—not to a late reply to the original notice. Treat the dates as urgent and have the applicable current law checked.

The GST Portal FAQ describes the following appeal process and conditions. Confirm them in the live portal and against the current law before filing:

  • An order must exist to file an appeal against a demand order.
  • The online route is Services > User Services > My Applications > Appeal to Appellate Authority.
  • The FAQ states a minimum pre-deposit of 10% of the remaining disputed tax, in addition to payment of the admitted amount. Verify the calculation and current applicability for your case.
  • If the order is not uploaded, the FAQ says a self-certified copy may be required within seven days; late submission can affect the appeal filing date.
  • Starting an online application is not necessarily the same as completing filing. The FAQ distinguishes submission, acknowledgement, and admission statuses, so check the portal’s filing requirements and final status.

Verify current law and get case-specific advice

The guidance here concerns India and general CGST and GST Portal procedure. A notice may also involve state GST provisions, a particular statutory section or form, different service facts, or amendments and transition rules. The CBIC-hosted consolidated Act PDF cited here is updated only through 31 August 2021; it does not settle every current-law question, including whether section 74A applies to a particular notice. Before relying on a section number, deadline, or payment calculation, verify the current consolidated Act and applicable notifications.

Ask a qualified GST practitioner or tax lawyer familiar with GST appeals to review the notice, service evidence, tax period, hearing or extension history, and any order’s communication date. The right next step depends on those case-specific facts.
