First identify the exact token, issuer legal entity, contract terms and jurisdiction. Then compare your request with the issuer’s current redemption conditions, preserve every piece of evidence, ask for a written explanation through a verified channel, and use the complaint, regulator, court or law-enforcement route that actually applies. A token balance, reserve statement or secondary-market price alone does not establish a right to physical delivery or prove that the issuer is insolvent.
Start with a precise fact pattern
Write down what you know before taking further action. Record the token’s full name and ticker, blockchain network and contract address, the issuer’s legal entity, any reserve custodian or redemption agent, the quantity held, and whether the tokens sit in your own wallet, an exchange account or a custodial platform. The company that marketed a token may not be the entity contractually required to accept it.

- Identify the country where you live and, if different, the country of the issuer and the delivery destination.
- Save the exact redemption policy, white paper or equivalent disclosure, terms of service, fee schedule and complaint procedure that applied when you submitted the request.
- Note whether you requested physical delivery, cash value, a sale of the token or another settlement method.
- Write a timeline with the submission date, amount, wallet or account, support-ticket numbers, promised processing time and every response.
Do not assume that a marketing label such as gold-backed, asset-referenced or fully allocated determines your legal rights. The instrument’s structure, offering documents, current terms and governing law control.

Find the documents that govern redemption
Use the issuer’s official website or the disclosure delivered with the token, not a link in an unsolicited message. Check whether the document has a version date and whether the issuer changed the policy after your request. The following documents answer different questions:

For asset-referenced tokens within the scope of the European Union’s Markets in Crypto-Assets Regulation (MiCA), the white-paper disclosure requirements include complaint contacts, dispute or redress procedures, insolvency rights, redemption mechanics, applicable law and the competent court. Those disclosure requirements are a useful checklist, not proof that an unidentified token falls within MiCA.
Test whether your request met the stated conditions
Compare the request you actually made with the policy version in force on that date. Ask the issuer to identify the exact unmet condition rather than accepting a generic message such as pending, risk review or unavailable.
Identity and account status
Some issuers require direct onboarding, a completed identity check, a verified bank account or a wallet whitelisted by the issuer. A token purchased through a third-party exchange may not automatically create a redemption account with the issuer. Confirm whether the issuer accepts requests from residents of your country and whether the account name, wallet owner and delivery recipient must match.

Physical commodities are often delivered only in specified units, bars, coins or lots. A balance that appears large in token units may still be below the minimum for a deliverable item. Check whether the policy permits fractional cash redemption while requiring a whole-bar threshold for physical delivery.

Geography and logistics
Review permitted delivery countries, address types, customs obligations, restricted regions, shipping insurance and whether delivery is available to residential addresses. The policy may require collection from a vault, an approved dealer or a logistics partner rather than shipment to your home.
Valuation, fees and timing
Determine which price is used: a published market reference, an issuer quote, an end-of-day value or another formula. Check the time at which the value is fixed, the currency, minimum fees and who pays shipping, insurance, taxes and storage. Record the policy’s stated processing window and distinguish business days from calendar days.
For covered asset-referenced tokens, MiCA Article 39 describes redemption-policy conditions including thresholds, periods and timeframes, redemption mechanisms, valuation principles and settlement conditions. Treat that list as a comparison framework only; it does not automatically govern every commodity token.
Compare physical delivery with a cash route
If the issuer offers more than one route, compare them against the same facts. Do not assume that a cash option is an equivalent substitute if your contract promises delivery, and do not assume that physical delivery is available merely because reserves are advertised.

A Federal Reserve Board paper published in 2023 used Tether Gold (XAUt) as an illustration in which physical redemption was described as requiring a full gold bar of 385 to 415 fine troy ounces. The paper also noted that one XAUt did not entitle its holder to delivery of one troy ounce. This is a historical example from that paper, not a statement of current terms or a universal rule for other tokens.
Create an evidence file before escalating
Keep original files and make working copies. Screenshots should show the date, URL or application screen and the relevant account identifier. Preserve blockchain evidence independently of an exchange account, because an exchange can later restrict access.
- Token name, ticker, contract address, network and wallet or account addresses.
- Transaction hashes, block explorer links saved as records, token amounts and timestamps.
- Purchase, transfer and redemption dates, requested quantity and requested delivery or cash form.
- Copies of the applicable policy, white paper, fee schedule and terms, including version or publication dates.
- Redemption forms, confirmation emails, support tickets, chat transcripts and screenshots of error messages.
- Bank, carrier or vault references, if the issuer gave any settlement or delivery number.
- A calculation showing how you believe the minimum, fees and valuation conditions were met.
The FBI Internet Crime Complaint Center (IC3) asks for transaction details such as addresses, type and amount, date and time, and transaction ID or hash. Organizing those details now makes an issuer complaint and any later report more precise.

Send a written complaint to the verified issuer channel
Use the contact details in the current disclosure or official site. Do not rely on an address supplied by a social-media account, a direct message or someone claiming to be a recovery specialist. State the facts in a way that lets the issuer answer each point:

Please confirm:
1. Whether my request is complete and eligible;
2. The precise policy provision relied on for any refusal or delay;
3. Any missing document, fee or verification step;
4. The expected processing or settlement date; and
5. The complaint escalation route and case number.Attach copies, not irreplaceable originals. Ask for a written response and a case number. If the issuer claims a pause, request the start date, scope, published notice and the process for orderly redemption. Keep the tone factual; threats and repeated submissions can make the record harder to interpret.

Regulatory or ombuds escalation
Follow the complaint and redress process named in the token’s documents. Depending on the issuer, that may lead to a financial regulator, an ombuds service, an alternative-dispute body or a court. Check that the body has jurisdiction over the issuer, product and location; a regulator in your country may not supervise an overseas issuer.
Where MiCA applies to a covered asset-referenced token, Article 39 states: “Holders of asset-referenced tokens shall have a right of redemption at all times against the issuers of the asset-referenced tokens, and in respect of the reserve assets when issuers are not able to meet their obligations as referred to in Chapter 6 of this Title.” The scope matters. You must first establish that the instrument and issuer are covered and that your facts satisfy the applicable conditions.

Orderly redemption and insolvency concerns
MiCA Article 47 provides for an orderly redemption plan after a competent authority determines that an issuer is unable, or likely unable, to meet its obligations. That provision is not a shortcut for every delayed request. If the issuer appears to be winding down, stop sending funds to newly supplied addresses and obtain advice on preserving a creditor or redemption claim under the governing law.
Fraud, theft or misappropriation reports
If the facts suggest that the issuer or an intermediary took assets without intending to perform, fabricated reserve information, impersonated an official service or diverted your tokens, consider an official fraud or crime report in the relevant jurisdiction. For US-connected cryptocurrency crime, IC3 accepts complaints and may analyze or refer them for possible investigation. Filing does not promise contact, an investigation or reimbursement.
The Consumer Financial Protection Bureau’s general US fraud guidance identifies the FBI, Federal Trade Commission, state attorney general and local police as possible reporting channels. Use independently located agency websites and phone numbers. A 2022 CFPB analysis covering complaints submitted from October 2018 through September 2022 recorded more than 8,300 crypto-asset complaints; 40% were categorized as fraud or scams. Those are historical figures for crypto complaints generally, not a rate for tokenized-commodity redemption disputes.
Get specialist advice when the amount or legal uncertainty warrants it
Consider an independent lawyer qualified in the relevant jurisdiction when the amount is material, the issuer is insolvent or winding down, a court or arbitration clause applies, the reserve structure is disputed, or the governing law is unclear. A lawyer experienced in commodities, insolvency or digital-asset disputes can assess whether the documents create a delivery claim, a cash claim, a creditor claim or no enforceable claim.
Provide the lawyer with your evidence file and the exact policy version. Ask about limitation periods, preservation letters, interim measures, insolvency filing deadlines, arbitration costs and the realistic value of pursuing the matter. No lawyer, regulator or tracing company can guarantee recovery.
Recognize and block recovery scams
A failed redemption makes you a target for a second fraud. Ignore unsolicited offers from people who promise guaranteed recovery, claim privileged access to a blockchain, demand an upfront release fee or ask you to transfer tokens to a new wallet. The FBI warns that private recovery companies cannot issue seizure orders to recover cryptocurrency and advises caution toward anyone claiming they can recover funds.
- Never pay a supposed investigator, lawyer, exchange employee or government agent through an unsolicited crypto address.
- Do not provide seed phrases, private keys, one-time passwords or remote access to your device.
- Verify alleged official affiliations using contact details you find independently.
- Preserve the scammer’s messages and wallet addresses for a report, but do not continue negotiating to obtain a promised refund.
Use a simple decision path
- Terms permit the route and the request is complete: send the written complaint, request the missed performance date and escalate if the policy deadline passes.
- A condition is missing: ask whether it can be cured, what document or fee is required and whether the issuer offers a permitted cash alternative.
- The policy is contradictory or unavailable: preserve older copies, ask the issuer to identify the controlling version and obtain jurisdiction-specific advice.
- The issuer is unreachable, changes wallet addresses or solicits new money: treat the matter as a potential fraud or insolvency issue, stop sending funds and make appropriate official reports.
- A third-party exchange is holding the token: complain to both the exchange and the issuer, separating the exchange’s custody obligations from the issuer’s redemption obligations.
What not to infer from market signals
A discount to the token’s purported commodity value can reflect liquidity, fees, market risk, exchange restrictions or uncertainty; it is not by itself proof of fraud or insolvency. Conversely, a stable market price or a reserve attestation does not prove that your account meets delivery conditions. Only the applicable contract, issuer process and evidence of your completed request can answer the entitlement question.
