If you think you have bought stolen goods, preserve the listing, messages, payment and delivery records, and identifying details such as serial numbers. Contact local police or the relevant authority promptly and ask what to do with the item. Do not keep it, alter it, or return it privately to the seller or claimant before receiving local instructions. Ask the seller for a refund, report the listing to the marketplace, and check whether your payment provider still has a fraud or dispute route.
An innocent buyer can still lose possession if the true owner proves a claim; being unaware of theft and owning good title are separate questions. The result depends on your location, whether the seller was a private person or a business, the type of property, what the seller was authorized to transfer, and how the transaction occurred. The examples below come from Wales, Scotland, England, Victoria and New South Wales in Australia, Calgary in Canada, and United States Uniform Commercial Code provisions; they are not a universal rule for every country or state.

First, decide which problem you are dealing with
“Stolen property” usually means the item was taken or sold without the true owner’s consent. “Mistakenly sold property” can describe an item a seller listed or shipped even though it belonged to somebody else, was included in a shipment by mistake, or was sold without the authority needed to pass ownership. A message from somebody claiming the item is theirs is not, by itself, proof of either situation.
For a buyer, the key questions are whether the seller had authority to transfer title, whether you knew or had reason to suspect a problem, whether a reliable identifier connects the item to another owner, and whether police or a court has become involved. For a person whose property was sold, the questions include how the item left your possession, who sold it, whether the seller was acting as a business, and what remedy your local law provides.

What to do if you are the buyer
1. Stop changing the evidence
Do not clean, reset, repair, resell, dismantle or remove labels from the item. Keep packaging, tags and accessories. Save the complete listing, seller profile, photographs, description, username, URL as displayed in your records, and the date and time you saw it. Export or screenshot every message, including offers, collection arrangements and statements about ownership.
Keep the receipt, invoice, bank or card record, payment-service transaction ID, postage label, tracking history, collection address and any identity information the platform lawfully gave you. Record serial numbers, IMEI numbers, model numbers, distinctive marks and photographs. Make a separate note of when and how you first learned that the item might be stolen. Those details can help police match the property and help you show that you paid for it.
2. Do not hand the item over privately
Citizens Advice Wales uses the practical wording “If you think you’ve bought stolen goods” and advises contacting police, not keeping the item and not returning it directly to the seller. Follow the same safety principle if a claimant contacts you: do not arrange a private meeting or courier collection while ownership is disputed. Tell the person you are preserving the item and will cooperate with police or another formal process.
Contact your local police service or the authority it identifies for property disputes. Ask whether you should bring the item to a station, leave it secured at home, or wait for an officer to collect it. Procedures differ, and a general online article cannot prescribe the handover method for every jurisdiction.

3. Obtain and preserve official reference details
If police open a report or take custody, request the crime or incident reference and, where used, the property-log or exhibit number. Keep the officer’s name, station, date and instructions. Give investigators your purchase evidence and explain exactly what you knew at the time of purchase. Do not exaggerate certainty: distinguish what you personally observed from what the claimant or seller told you.
4. Ask the seller for a refund in writing
Use the platform’s message system or another channel that preserves a timestamp. State that a third party or police has raised an ownership concern, identify the transaction, request cancellation and a refund, and ask how the seller wants to respond through the platform’s process. Do not threaten, publish the seller’s personal information, or agree that you committed an offence merely because the item is under investigation.
In Wales, Citizens Advice says a buyer who did not know the goods were stolen should not get into trouble on that basis and recommends showing the seller the police crime reference and property-log number together with purchase evidence when seeking reimbursement. That is Wales-specific guidance, not a promise that every seller or court elsewhere must refund immediately.

5. Report the listing and protect the payment route
Use the marketplace’s fraud or suspicious-listing report function. Calgary Police Service recommends notifying the buy/sell site about suspicious activity and avoiding disclosure of sensitive personal or banking information. Do not send a copy of your full identity document or bank login to a claimant who contacts you through an unverified account.

Check the platform’s current dispute or buyer-protection deadline and the payment provider’s fraud procedure now. Consumer Affairs Victoria notes that marketplace resolution processes can have defined time windows. A deadline on one service is not a universal deadline, so read the terms that applied to your transaction and save a copy of the relevant page.
Can an innocent buyer keep the item?
Not necessarily. Innocence may help explain your conduct, but it does not automatically create ownership. NSW government guidance says a purchaser does not gain title when goods were sold without the owner’s consent or the necessary authority. Scottish Citizens Advice says an owner may seek an order requiring return. In either example, the buyer can face losing possession even after paying a fair price.
Other legal systems recognize limited exceptions. In the United States, Uniform Commercial Code § 2-312 generally includes a seller warranty that title conveyed is good and its transfer rightful, subject to the section’s qualifications. Section 2-403 allows a person with voidable title to transfer good title to a good-faith purchaser for value in specified circumstances. State adoption, the seller’s status, the facts of the original transfer and the buyer’s knowledge all matter. These provisions do not mean every good-faith buyer keeps stolen goods.

What to do if someone says your property was sold
Preserve the transaction and provenance
If you are the seller who is accused of listing somebody else’s property, preserve the listing, photographs, messages, payment records, shipping or collection details, inventory records and any documents showing how you obtained the item. Do not delete accounts, alter timestamps, destroy packaging or edit the original description. If a business employee or family member listed the item, preserve their communications too.
Ask for identifying information
Request the item’s serial number, distinctive marks, purchase documents, photographs, date of loss and any police report number. Compare those details with your records without sending the claimant information that would let an impostor complete a false claim. An unsupported demand in a private message is not a substitute for a police or court process.
Pause a private handover
Do not arrange a private return while ownership is disputed. Tell the claimant that you will cooperate with police, the marketplace and a qualified local adviser. Contact local police or the relevant authority yourself if the allegation suggests theft or fraud. This is prudent general guidance; no single seller checklist is mandated in every jurisdiction.

Consider the seller’s authority
The seller’s authority to transfer title can decide the result. A business or dealer may have duties that differ from those of a private individual. A person who accidentally included another person’s item in a parcel may have made a mistake without intending theft, but the mistake does not automatically give the recipient title. Keep the facts precise and obtain local legal advice before agreeing to a refund, return, admission or settlement.

How rules differ by location and transaction type
| Location or framework | What the cited guidance says | Important limit |
|---|---|---|
| Wales | Citizens Advice says to contact police on 101 or attend a station when stolen goods are suspected. It advises not keeping the item or returning it directly to the seller, and suggests requesting a refund using the crime reference, property-log number and purchase evidence. | The advice expressly applies to Wales. Use local guidance in England, Scotland, Northern Ireland or elsewhere. |
| Scotland | Citizens Advice says to tell police as soon as stolen goods are suspected. An owner may seek a court order for return, and a buyer may have a possible breach-of-contract claim against the seller if the goods are returned. | This is not a rule for every part of the UK or every transaction. |
| England and online purchases | GOV.UK explains that, where the distance-selling cancellation rules apply, an online buyer generally has 14 days to tell the seller they want to cancel and a further 14 days to return the item. | Those periods do not automatically govern a stolen-property dispute. The guidance separately treats faulty, misdescribed and unwanted goods; check whether your facts fit the cancellation rules. |
| Victoria, Australia | Consumer Affairs Victoria says Australian Consumer Law does not apply when a purchase is from a private seller outside that seller’s business. It says a seller must ensure no one will try to repossess or take back the item, including where it was stolen or sold without the owner’s consent. | The response can depend on where and how the sale occurred, and marketplace processes may have set time windows. |
| New South Wales, Australia | NSW guidance says a purchaser does not gain title when goods were not sold with the owner’s consent or necessary authority. A person who believes goods are theirs is directed to a police station for advice about rights and next steps. | Use NSW authorities for NSW facts; do not generalize the title rule to another country. |
| Calgary, Alberta, Canada | Calgary Police Service recommends reporting suspected fraud, informing the marketplace, avoiding disclosure of sensitive personal or banking information, and checking serial numbers through the Canadian Police Information Centre database where available. | This is local safety guidance. A database check does not by itself prove lawful title or establish the law in another province. |
| United States | UCC § 2-312 describes a seller’s warranty that title is good and transfer rightful, while § 2-403 describes circumstances in which voidable title can pass to a good-faith purchaser for value. | State adoption and the detailed facts control. The provisions do not guarantee that a buyer keeps property reported stolen. |
Private seller, dealer, or marketplace: why status matters
A purchase from a business or dealer may trigger consumer guarantees, implied warranties, record-keeping duties or a formal complaints route that does not apply to a casual private sale. A private seller may still have promised that they owned the item or had authority to sell it, but the available remedy can be narrower and recovery harder.
A marketplace usually supplies the communication and payment interface; it may not have verified title. Read the platform’s terms to see whether it offers buyer protection, prohibited-goods reporting, escrow, identity records or a time-limited dispute process. Do not assume that a platform refund decides who legally owns the item, and do not assume a platform rejection prevents a court or police process.
Proving that an item is yours
If you are the original owner, assemble contemporaneous proof rather than relying on a verbal description. Useful material can include purchase invoices, registration or insurance records, dated photographs, repair receipts, serial or IMEI numbers, distinctive damage, and messages showing possession before the sale. Report the suspected theft or unauthorized sale to police and give them the identifier and the marketplace listing.
If you are the buyer, prove the transaction and your good-faith conduct: the original listing, seller representations, payment record, delivery evidence and the date you learned of the concern. A serial-number match can be powerful, but it should be verified through police, the manufacturer’s records where appropriate, or another reliable channel. A claimant’s screenshot with no independent identifier may be insufficient.
Common mistakes that can make the situation worse
- Returning the item to the seller: it can destroy evidence, expose you to another dispute and conflict with police instructions.
- Giving it to the first claimant: an impostor could be attempting to obtain property or personal information.
- Reselling or hiding it: that can complicate the investigation and your credibility.
- Missing a platform deadline: a marketplace or payment provider may close its internal route even while other remedies remain possible.
- Sharing sensitive information: send only what police, the platform or a verified professional needs; never disclose passwords or banking credentials.
- Assuming a 14-day rule solves everything: England’s online cancellation period applies only where its conditions are met and is not an automatic stolen-property remedy.
- Calling the transaction fraud before checking facts: describe the concern accurately and let the appropriate authority determine whether theft, mistake, breach of contract or another issue occurred.
A practical decision path
- Secure the item and records. Photograph identifiers, save the listing and messages, and keep payment and delivery proof.
- Verify the concern safely. Ask for identifying details and a police or case reference; do not treat an unsupported message as conclusive.
- Contact police or the relevant authority. Ask exactly whether to retain, surrender or deliver the item and record the instructions.
- Notify the seller and marketplace in writing. Request a refund or formal review without arranging a private handover.
- Protect the payment deadline. Open the platform or payment-provider dispute promptly and save the terms that applied.
- Get local advice for the remedy. If possession, a refund or a title claim is contested, consult a qualified adviser in the jurisdiction where the sale or property is located.
What outcome should you expect?
There are usually two separate tracks. The first concerns possession and ownership: police, a court or another formal process may determine whether the item should be returned. The second concerns money: you may seek a refund from the seller, a payment provider or another legally responsible party. Keep pursuing the appropriate track even if the other one is unresolved, and keep every reference number and deadline together.
The safest response to “What should I do if I bought stolen property online?” is therefore procedural rather than confrontational: preserve evidence, avoid private transfers, notify the proper authorities and platform, and obtain advice tied to your location and the seller’s status. That approach protects both your chance of reimbursement and the integrity of any ownership investigation.
