What to Do If the DOJ Declines to Investigate Your Civil Rights Complaint

If the U.S. Department of Justice (DOJ) Civil Rights Division says it will not investigate your complaint, read the notice carefully, follow any referral or information request, and promptly get legal advice if you may want a personal remedy. A DOJ complaint is a request for government review—not a lawsuit filed on your behalf—and submitting one does not stop an applicable deadline for your own claim.

What a DOJ decision not to investigate does—and does not—tell you

The Civil Rights Division reviews reports and decides what, if anything, to do next. Its public guidance describes possible outcomes that include asking for more information, beginning mediation or an investigation, directing a person to another organization, or informing the person that DOJ cannot help. The Division may not be able to provide updates while reports are under review or an investigation or case is active.

A decision not to open an investigation is about the government’s handling of that report. By itself, it does not establish that no violation occurred, that no individual legal claim exists, or that every possible remedy is unavailable. Nor does it establish that a lawsuit is permitted. Whether a person can bring a private action depends on the law governing the specific claim and on facts such as the defendant, forum, jurisdiction, and any required administrative process.

Start with what the notice actually says. A notice may close a particular review, decline federal enforcement, identify a referral, or ask you to provide something further. Do not read a limited statement as a ruling on issues it does not address. If the notice is unclear, ask the office that sent it what its decision covers and whether it identifies a next step.

What to do first after you receive the notice

  1. Keep the complete record. Save the notice, its envelope or electronic delivery details, your original complaint and attachments, and all related correspondence. Make a dated chronology of the events and communications, including complaints or proceedings involving other agencies.
  2. Identify the decision and its scope. Look for the stated reason, whether the Division is closing a particular review or declining to act, any request for more information, and any named office or agency. If the notice says nothing about a private claim or court filing, do not assume that it decided either issue.
  3. Act on explicit instructions. If the notice directs you to another office or asks you to correct or supply information, check the instructions and respond through the stated channel. The Division’s reporting page gives current online and contact options for reports; use the notice itself to identify the office handling your matter.
  4. Ask about the referral if necessary. If the notice names a destination but does not explain what it will handle, contact that office to confirm whether it received the report and what information it needs. If no destination is named, identify the subject and respondent before seeking guidance from a relevant agency or qualified lawyer.
  5. Get prompt legal advice if you may seek personal relief. Give the lawyer the notice, chronology, supporting documents, and details of every agency complaint or proceeding. Ask which law applies, whether it allows an individual action, what prerequisites apply, and which filing deadline controls.

These steps help preserve and clarify the record; they do not determine your legal rights. The important reason to treat deadlines separately is the DOJ complaint form’s express warning that submitting a complaint does not commence a lawsuit for the individual and has no effect on applicable limitations periods.

Will DOJ send your complaint to another agency?

Sometimes. DOJ says it may forward or direct a report to another Division team or a federal agency that may be able to address it. Its page about complaints for which the Division does not open an investigation says that, when an issue is outside its remit, it tries to direct the complainant to another DOJ component or federal agency. If no federal agency can address the issue, the page suggests contacting state or local officials or a private attorney. That referral page was updated July 28, 2017, so treat it as general guidance and rely on your notice and current contact information for the next step.

A referral is not necessarily a decision by the receiving agency, and it does not answer whether that agency can provide the remedy you want. Confirm which office has the matter, what that office can consider, and whether a separate complaint or application is required. Do not assume that a referral automatically starts a process, satisfies a prerequisite, or protects a court deadline.

There are two broad routes to consider, and they are not always alternatives: an agency process may address public enforcement or a particular administrative remedy, while a private legal action may seek relief for an individual. The applicable law determines whether the routes can proceed in parallel or whether a prerequisite must come first. DOJ’s current reporting site also describes forwarding to another team or agency, and its contact page provides an online form as well as printed-report and other contact options. These channels can help with reporting or routing; they do not substitute for finding out what process applies to a personal claim.

Route What it may address What to verify
Referral or another administrative complaint Review by an agency or government office that may have authority over the subject or respondent. Whether the recipient has authority, whether you must submit a separate complaint, and whether the law requires an administrative step. A referral should not be assumed to pause a court deadline. See DOJ’s referral guidance and the statute-specific examples below.
Advice about a possible individual action Assessment of whether you personally have a claim and what remedies may be available in court. Whether the law permits a private action, where it may be brought, what prerequisites apply, and the deadline. These questions depend on the claim and facts; see the DOJ Title VI Legal Manual and its discussion of 34 U.S.C. § 10228.

Can you still sue if DOJ declines your complaint?

Possibly, but the decision alone cannot answer that question. Civil-rights laws do not all provide the same rights or procedures. For example, DOJ’s Title VI Legal Manual discusses private litigation under Title VI and states that, in the circumstances it addresses, a plaintiff need not exhaust administrative remedies. In contrast, DOJ’s page reproducing 34 U.S.C. § 10228 describes an administrative exhaustion provision for actions under that statute. These are examples of different rules, not a general rule for every complaint.

There is also an important distinction between DOJ’s enforcement authority and an individual’s possible cause of action. DOJ explains that some police-misconduct statutes it enforces do not provide a private right of action. That means DOJ’s ability to enforce a law does not necessarily mean an individual can sue under that law; the governing statute and the specific legal theory need to be checked.

For the same reason, do not infer from a declination that a private action is available, or that it is unavailable. A lawyer familiar with the relevant subject area and jurisdiction can assess the actual claim, defendant, forum, available remedies, and procedural requirements. This article cannot supply a universal answer without those facts.

Does filing a DOJ complaint stop the statute of limitations?

Do not assume that it does. The Civil Rights Division complaint form warns: “SUBMITTING A COMPLAINT TO THIS OFFICE HAS NO EFFECT ON ANY STATUTE OF LIMITATIONS THAT MIGHT APPLY TO ANY PERSONAL CLAIM YOU MAY HAVE. BY SUBMITTING THIS COMPLAINT, YOU HAVE NOT COMMENCED A LAWSUIT OR OTHER LEGAL PROCEEDING, AND THIS OFFICE HAS NOT INITIATED A LAWSUIT OR PROCEEDING ON YOUR BEHALF. IF YOU BELIEVE YOUR CIVIL RIGHTS HAVE BEEN VIOLATED AND YOU INTEND TO SUE, YOU SHOULD CONTACT A PRIVATE ATTORNEY.” The warning appears on the DOJ Civil Rights Division complaint form.

There is no single deadline that can safely be given for every civil-rights complaint. The applicable period depends on the claim and governing law, and the relevant facts may affect how it is calculated. Ask a lawyer specifically which deadline applies and whether any event changed it. Do not rely on a DOJ complaint, referral, or request for reconsideration to pause a limitations period unless qualified counsel confirms that a rule applies to your claim.

Can you appeal or ask DOJ to reconsider?

The official guidance described here does not establish one general appeal or reconsideration process for all Civil Rights Division complaints. Check the notice for a review procedure, response deadline, or contact point; if none is stated, you can ask the office that issued it whether it accepts a request to clarify or reconsider its decision. Do not treat that inquiry as a formal appeal, assume it will be accepted, or wait for an answer before getting advice about a personal claim’s deadline.

Keep the questions distinct: whether DOJ will revisit its enforcement decision is not the same as whether an individual has a claim in court. The sources do not establish that asking DOJ to reconsider preserves a court claim or changes a filing deadline.

If the decision concerns a criminal civil-rights investigation

A criminal declination is a separate situation from a decision not to investigate a civil complaint. The DOJ Justice Manual says that when a U.S. Attorney’s Office declines prosecution in a federal criminal civil-rights investigation, that declination does not bind the Civil Rights Division; ultimate declination authority rests with the Assistant Attorney General for the Civil Rights Division. The manual page was updated March 2018. This is a rule about coordination of criminal enforcement, not a general right to appeal a civil complaint closure and not a promise that DOJ will conduct further review.

Questions to take to a lawyer or agency

  • Which statute and legal theory apply to these facts, and does that law allow an individual to bring an action?
  • Is there an administrative prerequisite, and if so, which office and process satisfy it?
  • What deadline applies to each potential claim, and is there any fact-specific rule that changes the calculation?
  • Does the DOJ notice close only a federal review, identify a referral, request more information, or say something else about the scope of the decision?
  • What can the named referral agency consider, and must I file something separately with it?
  • What records, dates, or communications are needed to assess the claim and any remedy?

For a current DOJ contact route, use the Division’s contact page or its reporting and contact-options page. A contact inquiry can clarify routing or the notice; it is not a substitute for advice about an individual claim.

Frequently Asked Questions

What should I do if the DOJ won’t investigate my civil rights complaint?

Read the notice for its stated reason, scope, referral, or request for more information. Keep the complete record, follow any specific instructions, and promptly consult a lawyer if you may want a personal remedy or need to confirm a deadline.

Can I still sue if the DOJ declines my complaint?

Possibly, but the declination alone does not determine whether you have a private claim. The answer depends on the specific statute, defendant, forum, facts, and any administrative prerequisites.

Does filing with the DOJ stop the statute of limitations?

Do not assume it does. The DOJ complaint form says submitting a complaint does not commence a lawsuit for you and has no effect on applicable limitations periods. Ask a lawyer promptly which deadline applies to your claim.

Can I appeal a DOJ Civil Rights Division decision?

The official guidance does not establish one general appeal or reconsideration process for all complaints. Check the notice for instructions and ask the issuing office whether it accepts a request for clarification or reconsideration, but do not assume that request changes a court deadline.

Will the DOJ send my complaint to another agency?

Sometimes. DOJ says it may forward or direct a report to another Division team or federal agency. If the notice names a recipient, confirm what that office can handle and whether you need to file a separate complaint. A referral does not automatically protect a court deadline.

The Bottom Line

A DOJ declination is not automatically a decision about whether your rights were violated or whether you can sue. Read the notice, verify any referral or requested next step, and treat your personal claim and its deadline as separate questions. DOJ’s complaint form expressly says that filing a report does not start a lawsuit on your behalf or affect applicable limitations periods, so seek advice promptly if you may pursue individual relief.
