Once it is safe, document the damage, notify your auto insurer, and ask the government agency involved for its property-damage claims process. A conduct complaint and a request for compensation are separate routes; neither guarantees that you will be paid.
What to do first
- Get to safety. Do not approach an active scene or handle suspected ammunition or other evidence. Follow instructions from responders.
- Get medical help if anyone is injured. Keep records of treatment and related expenses.
- Note the basic incident details when you can do so safely. Write down the date, time, location, what happened, which agency responded, and any incident or case number. Record officer names, badge numbers, or unit details only if they have been provided or can be noted safely.
- Contact your insurer. Ask how to open a claim, what your policy requires, and whether the insurer or agency needs to inspect the car before repairs. Save the claim number and written communications.
- Ask the responsible agency where to submit a property-damage claim. Request the instructions in writing, including any form, deadline, and inspection requirements.
How to document the damage and manage repairs
Keep a dated account of the incident while your memory is fresh. Preserve original photos and videos, including metadata where possible, and take clear images of the car and visible damage from safe positions. Keep witness contact details, estimates, towing and storage bills, rental-car receipts, repair invoices, and correspondence with the insurer and agency.

Ask before authorizing repairs if an insurer or agency may need to inspect the vehicle. If the car or a damaged part may be evidence, ask the investigating agency how it should be handled. Do not put yourself at risk to preserve physical evidence, and do not handle ammunition.
Pennsylvania’s Commonwealth claim instructions, which apply only to eligible claims under that state’s process, request incident details, the extent of the damage, information about the police response, and photos. California Department of Insurance guidance describes proof of claim as material supporting the claim and the amount of loss; that is California guidance, not a statement of what every policy or jurisdiction requires.

Who to contact depends on which agency was involved
Identify whether the officers were federal, state, county, municipal, tribal, or from another agency. Then ask that agency for its property-damage or risk-management claims channel. Do not assume that a police conduct complaint starts a financial claim, or that filing either kind of claim proves misconduct or establishes government liability.
| Example route | What the cited guidance says | Important limit |
|---|---|---|
| Federal agency or the United States | The U.S. Department of Justice says an applicable claim under the Federal Tort Claims Act must be presented to the appropriate federal agency within two years after accrual and state a specific amount, called a “sum certain.” Standard Form 95 is a convenient form, not the only permitted format. | This guidance concerns qualifying claims against the United States. It does not set deadlines or procedures for state or local officers. |
| Pennsylvania Commonwealth | Pennsylvania’s Commonwealth claim service describes a six-month filing period for eligible claims and asks for information such as when and where the incident occurred, what happened, the extent of the damage, the police response, and photos. Separate Pennsylvania guidance says to report vehicle damage caused by a Commonwealth employee or vehicle immediately to the responsible agency. | The six-month period and process are Pennsylvania-specific. Eligibility must be checked; they are not a general deadline for claims against police. |
| Local law-enforcement conduct complaint in California | The California Department of Justice says a complaint about a local officer or sheriff’s deputy should first go to the relevant law-enforcement agency. | A conduct complaint is not the same as a compensation claim. The cited guidance does not establish a damages deadline. |
| Police complaint in England and Wales | The Independent Office for Police Conduct says most complaints are handled by the relevant force. It directs people seeking compensation to the force or its solicitor. | The IOPC does not handle compensation claims; its complaint guidance does not establish the deadline for a financial claim. |
These are examples of different systems, not a complete directory of claim routes. Procedures and deadlines for a city, county, state, tribal authority, or another country may differ. Ask the agency involved which office handles property claims and verify the rules that apply where the incident happened.

Keep a compensation claim separate from a conduct complaint
A compensation claim asks an insurer or government body to address financial loss. A conduct complaint asks an oversight body or law-enforcement agency to review officers’ actions. You may choose to pursue both, but one should not be treated as a substitute for the other.
Complaint channels also vary. For example, California DOJ directs complaints about local officers or sheriff’s deputies to the relevant agency. In England and Wales, the IOPC says most complaints are handled by the relevant force and that compensation claims should instead be directed to the force or its solicitor. Follow the process for the place and agency involved.

Check deadlines promptly and get local advice
Do not use a deadline from another jurisdiction as your own. The federal two-year FTCA presentment period and Pennsylvania’s six-month period apply only to the specific kinds of claims described above; other government claims may have different rules. The applicable deadline can depend on who the defendant is, what law applies, and when the claim accrued.
If the agency will not identify the correct process, the damage is substantial, or a deadline may be approaching, promptly contact a local attorney experienced in claims against government agencies. California DOJ also points people seeking incident-specific legal advice or relief to an attorney and notes legal aid as a possible resource for people who cannot afford counsel. The information here cannot determine whether a particular shooting was justified, whether an agency is liable, or what a specific insurance policy covers.
