Do not use contact details supplied by the caller. Explain what happened and whether you initiated the transfer, approved it, or shared account access information. Whether the money can be recovered depends in part on how it left the account and who initiated the payment; a refund is not guaranteed.
What to do first
- Contact the bank through a verified channel. Identify the transaction and its date, and describe the phone scam plainly. Say whether you made or approved a payment, or whether the caller obtained access information and initiated the transfer. Ask the bank to secure the account and exposed credentials, block or replace affected cards or other access devices as needed, and open an unauthorized-transaction or error investigation. Ask how to submit details or evidence, and record the case number and representative or team.
- Contact any payment service involved. If the money moved through a payment app or another electronic-funds-transfer provider, contact that service promptly as well as the bank holding your account. Recovery options and applicable protections depend on the payment method and who initiated the transfer. The CFPB advises contacting the bank or payment company if you believe you sent money to a scammer.
- Keep a written record. Save the transaction date, amount, destination or recipient, call time, number used, messages, emails, and case numbers. Follow the institution’s instructions for submitting a written dispute or supporting material, and keep copies of everything you send.
- Secure accounts whose information may have been exposed. From a trusted device and through official account channels, change compromised passwords and PINs. Ask the bank what access devices need replacement. Secure your email and any other accounts that reused the same credentials. The FTC’s identity-theft steps include contacting financial institutions and closing affected accounts.
- Report the scam where appropriate. The CFPB points consumers to ReportFraud.ftc.gov and the FBI’s IC3.gov; it also lists state attorneys general and local police as reporting options. If personal identity information was exposed, use IdentityTheft.gov and consider a fraud alert or credit freeze.
Does the bank have to give the money back?
Not automatically. For U.S. consumer accounts, some electronic fund transfers (EFTs) have protections under Regulation E, including rules on consumer liability and how institutions investigate reported errors. Covered transfers include ATM transactions, debit-card purchases, some online bill payments, and automatic deductions. The rules do not make every loss following a scam refundable.

A key distinction is who initiated the transfer and whether the consumer gave actual authority. The CFPB’s Regulation E FAQ says a transfer may count as unauthorized when a scammer fraudulently persuades someone to share account access information, then the scammer uses it to initiate the EFT. The FAQ applies that reasoning to certain transfers through non-bank peer-to-peer providers and transfers made with stolen credentials.

That is different from a consumer personally sending a payment after being deceived about its purpose or recipient. The circumstances and payment channel matter, so explain accurately what you did and what the scammer did; do not assume the bank will treat a consumer-initiated payment the same way as a transfer initiated by someone without authority. The CFPB’s Regulation E materials describe the governing rules, but they do not establish the outcome for every scam.

How long can an unauthorized-transaction investigation take?
According to the CFPB’s consumer guidance on error investigations, a bank or credit union generally has 10 business days after receiving notice of an unauthorized transaction to investigate. It must correct an error within one business day after determining an error occurred, and report its findings within three business days after completing the investigation. These are investigation and error-resolution timelines, not a promise that every phone-scam loss will be reimbursed.
Why reporting time and payment method matter
Report the loss as soon as you discover it. CFPB guidance gives specific examples for a lost or stolen debit card: reporting within two business days can limit liability to the lesser of the unauthorized amount or $50; later reporting can expose a consumer to up to $500. It also says to report an unauthorized withdrawal within 60 days after the statement showing it, because delay may make the consumer responsible for later transactions if the institution establishes that timely notice would have prevented them.

Those examples are not a single deadline for every phone scam. The applicable rules can differ based on how a card or security code was compromised and the payment channel involved. A debit-card transaction, account EFT, P2P transfer, wire, cryptocurrency payment, and business-account transaction should not be assumed to have identical protections. The cited CFPB guidance addresses consumer EFTs; it does not resolve every wire, crypto, commercial-account, or non-U.S. case. If you are outside the United States or used a business account, ask your institution and relevant local regulator about the rules that apply.

Protect yourself from a follow-up scam
Someone may call claiming they can recover the money, protect the account, or represent a government agency. Treat unsolicited instructions with caution and contact institutions or agencies using independently verified numbers and websites. The CFPB warns that legitimate government agencies and financial institutions do not ask you to send money to “protect it,” withdraw cash, buy gift cards, or use cryptocurrency.
