What to do if GST officials detain your goods or vehicle in India

If GST officials stop your consignment or vehicle, stay cooperative but do not make an unauthorised admission or pay personally. Ask for the written detention or seizure order, record the time and place, preserve every invoice and e-way-bill record, obtain copies of inspection forms and notices, and immediately inform the goods owner or authorised representative. A current section 129 notice must generally be issued within seven days of detention, followed by an order within seven days after notice service; a hearing is required before penalty is determined. Because the amount, deadlines and release route depend on ownership, tax status, valuation and the goods’ condition, have a GST practitioner or Indian tax lawyer examine the papers promptly.

GST officials detained my truck—what should I do first?

Stay present, cooperative and precise

The driver or transporter should follow lawful inspection directions, answer factual questions and avoid arguing at the roadside. Do not sign a statement that is inaccurate, do not accept a proposed contravention without authority from the owner, and do not assume the driver must fund a tax or penalty personally. Tell the officer that the owner or an authorised representative is being contacted.

Obtain the written detention or seizure order

Section 129 of the Central Goods and Services Tax Act, 2017 requires the order to be served on the person transporting the goods before goods or a conveyance are detained or seized. Ask the officer to identify their name, designation and office, and request a copy of the order. Record:

  • the date and exact time of interception and service;
  • the location, vehicle registration number and transporter details;
  • the goods, quantities, packages and declared value described by the officer;
  • the stated legal grounds for detention; and
  • the name and designation of the person who receives each document.

Keep proof of when each paper was received. The service date controls several statutory periods, and an informal telephone message is not a substitute for retaining the written order.

Secure the consignment records

Put one person in charge of a complete document set. It should normally include the tax invoice, bill of supply or delivery challan; the e-way bill or its number when required; vehicle and transporter details; and records explaining a legitimate route change, trans-shipment, delay, return, stock transfer or other unusual fact. Preserve electronic copies, portal screenshots, GPS or toll records, weighbridge slips, purchase and dispatch records, and correspondence with the consignee. Never alter a document after interception.

Ask for copies of inspection paperwork

CBIC Circular 41/15/2018-GST describes a practical form sequence. A statement may be recorded in FORM GST MOV-01, an inspection order issued in MOV-02, written permission in MOV-03 when inspection extends beyond three working days, and the physical verification report prepared in MOV-04. Request a copy of every form actually used and check that the vehicle, goods and quantities match the consignment.

If no discrepancy is found, the circular describes release in MOV-05. If detention is proposed, it describes a detention order in MOV-06 and a notice specifying proposed tax and penalty in MOV-07. These forms come from a 2018 procedural circular; use them as a workflow reference, but read the current Act, rules and the order served in your case rather than assuming the circular’s older timelines remain law.

Report an extended stop when appropriate

The e-way-bill rules provide a facility for a transporter to report a vehicle detained for more than 30 minutes through the GST portal in FORM GST INS-04. This creates a record of the delay; it is not an automatic release mechanism and does not replace the detention order or a legal response.

What section 129 currently requires

Section 129 applies when goods or a conveyance are intercepted during movement or storage in transit in contravention of the CGST Act or rules. The version currently displayed by CBIC reflects amendments effective 1 January 2022. The amended Act, not the 2018 circular, governs the penalty formula and statutory deadlines.

Notice, hearing and order deadlines

Event Current statutory rule What to preserve
Detention or seizure The written order must be served on the person transporting the goods. Copy of the order, date, time and recipient’s acknowledgment.
Notice under section 129(3) The proper officer shall issue a notice specifying the penalty payable within seven days of detention or seizure. Notice and proof of the date it was served.
Opportunity of hearing Penalty cannot be determined without giving the person concerned an opportunity to be heard. Written objections, hearing request and attendance record.
Order under section 129(3) The officer shall pass the order within seven days from service of the notice. Signed order, date of service and any calculation sheet.
Post-order risk Section 129(6) presently provides a 15-day period from receipt of the order copy before goods or the conveyance become liable to sale or other disposal to recover the penalty. The officer may reduce that period for perishable or hazardous goods or goods likely to depreciate. Order copy, delivery date and evidence of perishability, hazard or depreciation.

The statute says: “No penalty shall be determined under sub-section (3) without giving the person concerned an opportunity of being heard.” If a notice gives no realistic chance to respond, or an order is issued without considering the response, tell your adviser immediately and keep the service evidence. Do not rely on the 2018 circular’s seven-day payment wording as though it were the current section 129 deadline.

How much can release cost?

The statutory amount depends first on whether the owner comes forward, and then on whether the goods are taxable or exempt. These are formulas, not a determination of what any individual must pay. The order should identify the tax, value, ownership position and calculation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Goods and ownership position Section 129(1) penalty formula
Taxable goods; owner comes forward Penalty equal to 200% of the tax payable.
Taxable goods; owner does not come forward The higher of 50% of the value of the goods or 200% of the tax payable.
Exempt goods; owner comes forward 2% of the value of the goods, capped at ₹25,000.
Exempt goods; owner does not come forward 5% of the value of the goods, capped at ₹25,000.

Confirm the classification, exemption notification, taxable value, tax rate, ownership documents and the applicable rules before accepting the calculation. A mismatch in an invoice or e-way bill does not by itself establish the correct value or prove an intention to evade tax.

Security instead of immediate payment

Section 129 also permits release on furnishing security equivalent to the applicable amount in the prescribed manner. The 2018 CBIC circular describes a bond and bank-guarantee route using FORM GST MOV-08. Current prescribed requirements, acceptable security and bank documentation should be confirmed with the proper officer and a GST professional before signing or arranging funds.

Should you pay, furnish security or object?

There is no universal best route. Compare the following facts with the owner and adviser before choosing:

Decision factor Why it matters
Owner or authorised person coming forward The statutory formula is materially different when the owner does not come forward. Obtain written authority for anyone acting for the owner.
Strength of the document or factual explanation An incorrect vehicle number, typographical error, duplicate e-way bill, lawful route diversion or trans-shipment record may support an objection, but the documents must establish what actually happened.
Payment versus security Payment may enable release without arranging a guarantee; security preserves cash but can involve a bond, bank limits, fees and conditions. Confirm whether the proposed security satisfies the officer’s current requirements.
Nature of the goods Perishable, hazardous or rapidly depreciating goods may face a shortened period before sale or disposal, making an immediate legal and logistical decision necessary.
Cost of delay Storage, missed delivery, production stoppage and contractual exposure should be compared with the disputed amount and the strength of the legal objection.

If the owner disputes the proposed amount, submit a written objection before the order is passed and request a hearing. Identify each disputed line item, attach the supporting document and ask the officer to record the response in the speaking order. Do not treat payment as an admission unless your written strategy and professional advice support that position.

How to challenge a proposed GST detention penalty

  1. Build a chronology. List dispatch, invoice creation, e-way-bill generation, vehicle changes, interception, inspection, service of notice and every communication.
  2. Reconcile the consignment. Match invoice or challan numbers, HSN or description, quantity, value, tax, consignor, consignee, vehicle number and e-way-bill validity. Explain every difference with an independent record.
  3. Submit a signed response. Address the legal ground in MOV-07 or the current notice, state the requested relief, attach an indexed evidence set and obtain an acknowledgment or portal submission record.
  4. Attend the hearing. The person concerned is entitled to an opportunity before penalty determination. Carry authority letters, identity documents and duplicate copies of the response.
  5. Check the speaking order. The circular describes FORM GST MOV-09 for the order. Verify that the officer considered each objection, stated the facts, applied the correct ownership and goods category, and showed the arithmetic.
  6. Decide the release route promptly. If the amount is accepted, follow the order’s payment instructions. If security is proposed, confirm the bond and guarantee wording before execution. If the order is disputed or procedurally defective, obtain advice on the available statutory or constitutional remedy rather than allowing the post-order period to expire.

Transport documents and e-way-bill checks

Documents normally carried during movement

The person in charge should carry an invoice, bill of supply or delivery challan and a copy of the e-way bill or its number in the prescribed form, subject to applicable exceptions and notifications. The general e-way-bill rule applies to consignments exceeding ₹50,000 in specified circumstances, but product-specific, movement-specific and notification-based exceptions exist. Verify the rule applicable to the actual movement and date.

Vehicle and validity reconciliation

  • Confirm that the vehicle registration in the e-way bill matches the conveyance actually carrying the goods.
  • Check that the invoice description, quantity, taxable value and tax details correspond to the e-way bill.
  • Check the e-way-bill validity period against dispatch time, distance, stoppages and any permitted extension.
  • When a transporter changes conveyances, generate the required updated e-way bill before further movement.
  • Keep evidence of a breakdown, accident, natural event, route closure, trans-shipment or other delay that explains a validity or vehicle discrepancy.

These checks help identify a defensible explanation; they do not determine liability without the full record and the applicable notification.

Detention is not automatically confiscation

Section 129 detention and section 130 confiscation are separate statutory processes. Section 130 addresses specified circumstances, including contraventions with intent to evade tax and certain uses of a conveyance. A documentation error should not be described as proof of intent to evade, and detention alone does not establish that confiscation conditions are met.

The 2018 CBIC circular describes FORM GST MOV-10 as a confiscation notice and MOV-11 as the confiscation order. Section 130 also requires an opportunity of hearing before an order. If a notice invokes confiscation, treat it as a substantially more serious step: obtain the complete factual record, respond to the alleged intent and statutory conditions, and seek specialist advice immediately.

What not to do while the vehicle is held

  • Do not leave without knowing where the goods and vehicle are being held and who has custody.
  • Do not hand over original records without requesting a receipt or copy.
  • Do not delete portal messages, GPS data, accounting entries or dispatch communications.
  • Do not sign a blank form or a statement you cannot read or do not understand.
  • Do not promise a payment date, provide a personal guarantee or arrange a bank guarantee without the owner’s authority.
  • Do not assume that a verbal assurance of release cancels the need to obtain the written order and release form.

When professional help is urgent

Contact a GST practitioner or Indian tax lawyer as soon as the order or notice is disputed, the value or tax appears wrong, the owner cannot immediately come forward, security is demanded, confiscation is mentioned, or the goods are perishable, hazardous or rapidly depreciating. Send the adviser a single chronological file containing the detention order, notice, inspection forms, invoice or challan, e-way-bill history, ownership authority, photographs and proof of service. Ask specifically for a deadline calculation under the current section 129 text and for advice on payment, security, objection and any further remedy.

A practical release checklist

  • Written detention or seizure order obtained and service time recorded.
  • Officer, location, vehicle, goods and custody details logged.
  • Invoice, bill of supply or challan and e-way-bill records preserved.
  • MOV-01 through MOV-07 copies requested where used, with discrepancies noted.
  • Owner or authorised representative identified and written authority prepared.
  • Section 129(3) notice and seven-day order period diarised from actual service dates.
  • Objections and hearing request submitted before penalty determination.
  • Payment or security option evaluated against the applicable formula and commercial delay.
  • Fifteen-day section 129(6) post-order period checked, including any shortened period for sensitive goods.
  • Any section 130 confiscation notice escalated to specialist counsel.

Key takeaway

The safest response is documented and time-sensitive: obtain the written order, preserve the transport trail, involve the owner, insist on the statutory hearing, and verify the calculation against the amended section 129. Payment and security can both be release routes, but neither should be selected blindly. The 2018 CBIC circular remains useful for identifying procedural forms, while current Act text and applicable rules control the deadlines, formula and consequences in an individual detention.
