Do not fire, suspend, or publicly accuse the worker based only on a suspicious Social Security number, document, or E-Verify result. Treat the issue as an allegation, secure any systems or personal information at risk, preserve evidence, and involve employment, immigration, privacy, and data-security counsel before taking steps that could affect the person’s job or immigration rights.
A Form I-9 or E-Verify discrepancy can have innocent causes, including a data-entry mistake, name change, or outdated government record. If the suspected misuse also exposed employee, customer, payroll, tax, health, or financial information, the matter may be a security incident with separate breach-notification duties.

Start with a neutral, documented response
Record exactly what triggered the concern: the date and time, the source of the information, the records or account involved, who observed it, and what systems may be affected. Use factual language such as “the Social Security number on this payroll record appears associated with another person” rather than labeling the worker a thief or fraudster.
Restrict the allegation to people who need it to perform an investigation. A broad email, group chat, or informal warning can expose sensitive personal information, create defamation risk, and undermine a later inquiry. Store the investigation record separately from routine personnel files when counsel advises that approach, and preserve the original files and logs in their existing form.

Protect systems and personal information first
If credentials, badge access, payroll accounts, customer records, or other systems may be compromised, follow the organization’s incident-response plan. Security controls should address the risk without assuming that the worker is responsible.
- Rotate or suspend affected credentials through a controlled process, documenting who approved the change and why.
- Preserve authentication, endpoint, email, badge, payroll, and application logs before retention settings overwrite them.
- Secure physical areas, devices, paper files, and removable media that may contain identity information.
- Monitor for additional logins, downloads, forwarding rules, payroll changes, or access from unusual locations.
- Assemble the appropriate team: human resources, information security, privacy, legal, and qualified forensic specialists.
- Do not wipe devices, delete accounts, or “clean up” records in a way that destroys evidence.
Federal Trade Commission guidance recommends moving quickly to secure systems, using legal and forensic expertise, preserving evidence, and coordinating communications with investigators. A suspected identity problem can involve both an employment question and a data-breach investigation, so keep those workstreams coordinated but factually distinct.
Get legal advice before re-verification or discipline
Ask counsel to analyze the facts before demanding new documents, repeating an employment-verification process, changing work conditions, or ending the relationship. Employment, immigration, privacy, state-notification, sector-regulatory, and collective-bargaining rules can all affect the lawful response.

For an employee, counsel can determine whether a new Form I-9 is legally appropriate or whether the original form should instead be corrected under the Form I-9 instructions. An employer should not automatically make every existing employee complete a new I-9 because one record looks unusual. A new form may be relevant in a lawful rehiring or other circumstance, but using re-verification as a targeted demand can create discrimination and document-abuse risk.
For an independent contractor, the company normally does not complete the contractor’s Form I-9 as though the person were its employee. The contract, staffing arrangement, or classification may assign verification duties to another employer or agency. Counsel should confirm who is legally responsible, whether the person is actually an employee under applicable law, and what the agreement permits the company to investigate or restrict.

Use Form I-9 and E-Verify consistently
What Form I-9 covers
Form I-9 is required for employees hired after November 6, 1986. The employer reviews documents establishing identity and employment authorization, while the employee generally chooses acceptable documents from the Lists of Acceptable Documents. The employer records the information and retains the form as required.
An employer may not demand a particular document, insist on a specific combination of documents, or request extra proof because of citizenship, immigration status, national origin, accent, surname, or perceived foreignness. Apply the same process and document standards to similarly situated workers.
What E-Verify adds
E-Verify is an electronic check used by participating employers after Form I-9 information is entered. Participation can be required by federal contract terms, state rules, or an employer’s chosen program, and the applicable rules depend on the employer and worksite.
An E-Verify result is not a general identity-theft finding. The official guidance describes a DHS or SSA mismatch as occurring when information entered in E-Verify does not match records held by the Department of Homeland Security or data available to the Social Security Administration. It expressly cautions: “A mismatch does not necessarily mean that the employee is not authorized to work in the United States.”
Handle a tentative nonconfirmation correctly
Misspellings, transposed numbers, a recent name change, an unreported status change, outdated records, and employer data-entry errors can all produce a mismatch. Give the employee the required notice and a meaningful opportunity to contest or correct it under the applicable E-Verify process.

Do not fire, suspend, reduce hours, change a schedule, delay placement, deny training, or otherwise take adverse action merely because the employee received a tentative nonconfirmation. The Equal Employment Opportunity Commission’s guidance treats such action as improper while the employee has the opportunity to resolve the mismatch. Continue normal employment treatment unless an independently documented, lawful reason requires a different decision.

Define the allegation
Separate the possible problems before drawing conclusions:
- Document or account irregularity: A credential, ID image, payroll record, or account may have been altered or used by someone else.
- Verification mismatch: Information entered into E-Verify or another system does not match a government record.
- Unauthorized access: Someone may have used the worker’s credentials to enter systems or obtain data.
- Broader breach: Company, customer, health, tax, payroll, or financial information may have been exposed.
These categories can overlap, but each requires different evidence. A mismatch alone does not establish that the employee supplied a stolen identity, and evidence that an account was misused does not by itself identify who operated it.
Preserve and review records
Work with counsel and qualified forensic professionals to set a preservation scope. Potentially relevant material can include the original I-9 and audit trail, E-Verify case notices, onboarding records, access logs, device images, badge events, payroll-change history, email forwarding rules, help-desk tickets, CCTV, contractor invoices, and communications with agencies.
Preserve metadata and chain-of-custody information. Make read-only copies where practical, record collection times, and limit access to investigators. Avoid opening or editing a questionable file on the only original device. Do not promise the worker or a complainant that a conclusion has been reached before the evidence is evaluated.

Interview fairly
Plan interviews with counsel and an HR investigator. Explain the issue neutrally, ask open-ended questions, give the person a chance to identify name changes or record errors, and document answers accurately. Do not ask immigration-status questions unrelated to the verification process, and do not require a worker to prove innocence beyond the standard process.
Decide whether access restrictions are necessary
Access decisions should be based on documented risk, not on the person’s nationality, accent, age, disability, or the mere existence of an E-Verify mismatch. If there is credible evidence that a credential is compromised, a temporary, proportionate control may be justified while preserving pay and procedural rights. Examples include requiring a password reset, moving privileged access to supervised access, or placing a system account in a monitored state.
Before suspending someone, changing duties, or placing them on leave, counsel should assess wage-and-hour rules, contracts, collective-bargaining obligations, anti-discrimination laws, and whether the step would be viewed as punishment for contesting a mismatch. Record the specific security reason, the approver, the duration, and the review date.

Determine whether personal information was accessed, acquired, or reasonably believed to be exposed. The answer can affect state breach-notification laws, contractual commitments, sector-specific requirements, insurance notices, and communications with regulators.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Ask counsel to map:
- Which states’ residents are involved and which state laws apply.
- What data elements were exposed, such as Social Security numbers, financial information, health information, tax data, credentials, or identity documents.
- Whether the company is subject to federal or industry rules with additional notice requirements.
- Whether customers, employees, contractors, vendors, or business partners must be informed under contract.
- Required deadlines, delivery methods, regulator notices, and documentation of the risk assessment.
Notify law enforcement when appropriate and coordinate timing so that a notification does not compromise an active investigation. If affected people must or should be notified, explain what information was involved, the relevant dates, what the organization has done, and practical steps such as changing exposed credentials, watching account statements, placing fraud alerts or freezes where appropriate, and reviewing credit reports. Do not state that identity theft occurred if the investigation has established only possible exposure.

Employee and contractor responses are not interchangeable
| Question | Employee | Independent contractor |
|---|---|---|
| Who normally handles Form I-9? | The employing entity for an employee hired after November 6, 1986, subject to applicable exceptions and instructions. | Often the contractor’s own employing entity or staffing provider; classification and contract terms must be verified. |
| Can the company demand a new I-9? | Not automatically. Obtain counsel and follow the Form I-9 rules consistently; targeted re-verification can create discrimination or document-abuse risk. | Do not treat the person as an employee for I-9 purposes without confirming classification and responsibility. |
| What records matter? | I-9 history, E-Verify notices, payroll, onboarding, access, and HR records. | Contract, invoices, agency records, identity and access controls, and logs held by the company and contracting entity. |
| What can restrict access? | A proportionate, documented security control based on evidence and reviewed with counsel. | The contract and security policy may permit controls, but avoid retaliation or an unlawful misclassification-based action. |
Use a decision framework before choosing a response
Document the answers to these questions and have counsel approve the resulting plan:
- What is the person’s status? Employee, staffing-agency worker, sole proprietor, or another contractor arrangement?
- What is the suspected conduct? A document or account anomaly, a verification mismatch, unauthorized access, or a broader data breach?
- Is there an immediate access risk? Are privileged credentials, payroll controls, customer data, or physical facilities currently exposed?
- Is a mismatch being contested? If yes, maintain the required opportunity to resolve it and avoid adverse action based solely on the mismatch.
- Which duties apply? Federal, state, contractual, insurance, sector-specific, and collective-bargaining requirements?
- What expertise is needed? Employment and immigration counsel, privacy counsel, independent forensics, law enforcement, or an identity-restoration provider?
Common mistakes that increase liability
- Demanding a passport, Social Security card, or other particular document instead of allowing the worker to choose from acceptable documents.
- Running a new I-9 or E-Verify case only for people with foreign-sounding names or accents.
- Treating a tentative nonconfirmation as proof of unauthorized employment or fraud.
- Firing, suspending, cutting hours, or delaying placement before the mismatch-contest process is complete.
- Confronting the worker in front of colleagues or circulating their Social Security number or immigration information.
- Deleting logs, reimaging devices, or changing records before forensic preservation.
- Announcing a breach before determining what data was involved and coordinating with investigators.
- Assuming one federal rule answers every state’s notification, privacy, or employment question.
What to put in the case file
A defensible file should show a consistent process without unnecessary sensitive data. Include the initial report, a chronology, people with access to the matter, preservation steps, system-risk assessment, copies of notices, interview notes, counsel’s instructions, access-control decisions, forensic findings, notification analysis, and the final rationale for any employment action.
Keep copies of identity documents and Social Security numbers only where a lawful business need and retention rule require them. Restrict permissions, encrypt stored files, and set a deletion date consistent with legal holds and applicable retention requirements.

How widespread is identity theft?
The Federal Trade Commission estimated in 2013 guidance that approximately nine million Americans have their identities stolen each year. That estimate illustrates why an organization should take a report seriously, but it does not identify the source of a particular mismatch or prove that a worker committed misconduct. Case-specific conclusions must come from preserved evidence and a fair process.
When to involve outside help
Bring in independent forensic investigators when logs, devices, privileged accounts, or a potential breach require technical reconstruction. Use privacy or data-security counsel when personal information may have been exposed or multiple jurisdictions are involved. Employment and immigration counsel should guide any re-verification, interview, leave, discipline, or termination decision. Coordinate with law enforcement when criminal access, identity theft, or an ongoing threat is plausible and reporting will not compromise the investigation.
The Bottom Line
Handle a suspected stolen identity as a documented security and employment investigation—not as proof of guilt. Preserve evidence, protect systems, follow Form I-9 and E-Verify procedures without demanding special documents, give employees the required chance to contest mismatches, and obtain qualified counsel before discipline or notifications.
