For a denial, obtain the lender’s adverse-action notice and specific reasons, check every underlying record—especially your credit reports—dispute inaccuracies with both the reporting company and the information provider, and ask the lender how it handles corrected information. If you suspect discrimination, document the facts and consider a complaint to the Consumer Financial Protection Bureau (CFPB). Servicing problems use a separate written notice-of-error process.
Start by identifying what kind of decision went wrong
“AI mortgage decision” can describe automated underwriting, a scoring model, document-reading software, or a human decision supported by an algorithm. The remedy depends less on the label “AI” than on where the problem occurred.

| Problem | Responsible party | First step |
|---|---|---|
| New mortgage application denied or offered worse terms | The lender or creditor that made the decision | Request the adverse-action notice and specific principal reasons |
| Credit report contains inaccurate or incomplete information | The credit-reporting company and the company that supplied the data | Obtain the report identified in the notice and dispute the item with both parties |
| Possible discrimination | The lender, and potentially federal or state enforcement authorities | Preserve evidence, compare treatment, and consider a CFPB complaint |
| Error on an existing mortgage account | Your mortgage servicer | Send a written notice of error using the servicer’s designated process |
A denial is not automatically proof that an algorithm was defective or discriminatory. You need the decision record and the facts behind it before choosing an escalation route.

Request the adverse-action notice
A creditor that denies credit must provide the reasons for the adverse action or explain how to obtain them. Ask for the complete notice if you received only a phone call, portal message, or generic status update. Keep the envelope or electronic timestamp, the application number, and every attachment.

The reasons should identify the principal factors that drove the decision. “A credit report was obtained” is not, by itself, a specific ECOA reason. The CFPB’s Regulation B guidance distinguishes an explanation of the creditor’s reasons from a disclosure that a consumer report was used under the Fair Credit Reporting Act.
Read the explanation for usable facts
Look for concrete statements such as a debt-to-income calculation, a missed-payment history, unverifiable income, an appraisal issue, or missing documentation. Record the exact wording rather than paraphrasing it. If the notice says you can obtain reasons by asking, make that request in writing and keep proof of delivery.
AI does not reduce the lender’s duty to explain
In Circular 2022-03, the CFPB states: “The adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.” A lender cannot avoid giving specific, accurate reasons by saying that its model is proprietary, too complex, or not interpretable. The obligation applies whether a person, software, or combination of both made the decision.
Check the records used to evaluate you
Obtain the report named in the notice
If the notice identifies a credit-reporting company, follow its instructions to obtain the report. Compare the report with your own records, including account statements, payoff letters, bankruptcy paperwork, court orders, and proof of identity. Check names, addresses, account ownership, balances, limits, payment dates, collection status, and duplicate accounts.

Dispute inaccurate information with both parties
The CFPB advises consumers to dispute inaccurate credit-report information with the reporting company and with the company that supplied the information. State exactly what is wrong, explain why, and attach readable evidence. Send copies rather than originals and retain the complete submission, delivery confirmation, investigation response, and any updated report.
Also check for information that is missing rather than merely incorrect. An account paid through a settlement, a corrected balance, or a court order may not be reflected properly. Do not assume that correcting a report automatically changes an underwriting decision; it creates a corrected record that you can present to the lender.
Build a document file
- Application and preapproval documents, including the version you submitted.
- The adverse-action notice and any follow-up explanation.
- All credit reports and score disclosures you received.
- Dispute letters, supporting documents, delivery proof, and investigation results.
- Emails, portal messages, call notes, names, dates, and promised follow-ups from the lender.
Ask the lender to review corrected or missing information
After identifying an error, contact the lender’s designated underwriting, reconsideration, or escalation channel and ask how it handles corrected records. Provide the corrected report or other evidence, identify the exact adverse-action reason it addresses, and ask whether the application can be reviewed under the lender’s process.

The CFPB materials establish your right to obtain reasons and dispute inaccurate credit-report data; they do not promise that a lender must reverse a decision or use one universal reconsideration procedure. A lender may require a new application, additional documents, or a particular portal. Ask what submission method and deadline, if any, apply, and request confirmation that the material was received.

Do not alter documents, submit conflicting income figures, or repeatedly file applications without understanding the lender’s process. Multiple applications can create additional inquiries or confusion, while a clear evidence package makes it easier to identify what changed.
When the result may involve discrimination
Recognize warning signs without jumping to a conclusion
The CFPB identifies possible warning signs such as being refused credit despite apparently qualifying, being offered less favorable terms than comparable applicants, or receiving discouraging treatment during the application. A disappointing result alone does not establish discrimination. Write down statements, dates, requested documents, quoted terms, and differences between your treatment and that of a similarly situated applicant, if you have reliable evidence.
Use the complaint route
If you believe a lender discriminated, you can submit a complaint through the CFPB. Include the application timeline, the lender’s stated reasons, relevant documents, and a precise description of the suspected unequal treatment. Keep the complaint factual; do not claim a motive you cannot support. You may also need advice about state fair-lending protections or deadlines, which can differ from federal procedures.

Mortgage-discrimination law is subject to regulatory change. The CFPB’s current Regulation B page reports amendments through July 2026, including changes involving disparate-impact analysis, discouragement, and special-purpose credit programs. Older explanations may no longer describe the governing regulation accurately. For a significant claim, review the current official rule and obtain advice from a qualified attorney or housing-rights organization about the law in your state.

Do not confuse a denial with a mortgage-servicing error
If you already have a mortgage and the problem concerns payments, escrow, payoff amounts, account history, or how the servicer applied money, you are dealing with servicing rather than underwriting. Appealing a past denial will not correct an account ledger.
Send a written notice of error
Use the servicer’s specified address and instructions for notices of error or requests for information. Describe the account, the transaction at issue, the date, the amount, and why the servicing is wrong. Include supporting records and clearly label the correspondence as a notice of error when the servicer’s instructions require that wording. Keep proof of delivery and a complete copy.
Track the response and escalate unresolved issues
The CFPB describes a written-response process for servicing-error notices. Compare the servicer’s response with your records and request clarification if it does not address the specific error. If the issue remains unresolved, submit a CFPB complaint with the notice, delivery evidence, and response. This route is separate from asking a lender to reconsider a new-loan underwriting decision.
Get neutral help without surrendering control of the case
A HUD-approved housing counselor can help assess affordability, review readiness, and discuss options after a denial. The CFPB recommends counseling as a resource, but a counselor does not control the lender’s model or guarantee approval. Bring your notice, credit reports, income and debt records, and a list of disputed items so the session can focus on verifiable facts.
Best Value
For legal questions—especially suspected discrimination, identity theft, a threatened foreclosure, or a dispute involving state law—consider individualized advice from a qualified attorney or an appropriate nonprofit legal-service provider. Keep sending required payments on an existing loan unless a qualified professional gives you lawful, case-specific instructions; a dispute about servicing does not automatically suspend payment obligations.
A practical escalation checklist
- Classify the problem. Decide whether it is a new application, a credit-report item, possible discrimination, or an existing-account servicing error.
- Collect the paper trail. Save the application, notice, reports, messages, call notes, and supporting records in one dated folder.
- Demand a specific explanation. Ask for the adverse-action reasons or instructions for obtaining them; challenge a generic credit-report reference that does not state the reasons.
- Verify the underlying facts. Obtain the identified report and check balances, payment history, ownership, identity, income documentation, and other stated factors.
- Dispute report errors correctly. Send a focused dispute to both the reporting company and the information provider, with evidence and delivery proof.
- Request lender review. Ask how to submit corrected or missing information and whether the lender offers reconsideration; do not assume approval or reversal.
- Escalate based on the evidence. Use a CFPB complaint for suspected discrimination or unresolved servicing problems, and seek tailored legal advice when the stakes warrant it.
Common mistakes that weaken a challenge
- Accepting a generic explanation: “The credit report was used” does not identify the principal ECOA reasons.
- Disputing only with the credit bureau: The data furnisher should receive the dispute as well.
- Assuming AI caused the error: The model may have applied accurate information, while the real problem is a data-entry, documentation, or identity error.
- Expecting an automatic reversal: Corrected information supports a review but does not create a guaranteed approval or a universal appeal right.
- Calling the wrong department: Underwriting, complaints, and servicing use different channels; follow the address and process identified for your issue.
- Making unsupported discrimination allegations: Preserve observable facts and comparisons rather than inferring intent from the outcome alone.
- Relying on outdated legal summaries: Verify the current Regulation B text and state protections, particularly after the CFPB’s 2026 amendments.
What documents might you receive?
The CFPB publishes sample ECOA materials, including adverse-action reason notices, credit-score notices, counteroffers, and incomplete-application notices. Samples help you recognize the type of communication, but no single sample controls every lender or situation. Read the actual notice for the lender’s stated reasons and instructions, then preserve it in your records.
What a successful next step looks like
A useful response produces a traceable record: a notice with specific reasons, a report showing the disputed item, a documented dispute sent to both responsible companies, and a clear request for lender review. If the facts point to unequal treatment, the record should show who was treated differently and why you believe the difference relates to a protected characteristic. If the issue is servicing, it should show a properly addressed written notice and the servicer’s response. This evidence lets a counselor, agency, or lawyer evaluate the problem without relying on assumptions about the algorithm.
