Contact a lawyer promptly, preserve the exact video and the way it reached you, and ask what specific claim the video is being offered to prove. Do not assume that a video is genuine—or fake—because it looks convincing or because a detector flags it. The applicable process depends on the country, state, court, type of proceeding, and case schedule. The federal rules discussed below apply to most U.S. federal proceedings, not automatically to state courts or other countries.

Contact a lawyer who handles your type of case
Tell your current lawyer, or seek a lawyer qualified in the relevant jurisdiction and proceeding, as soon as you can. If a hearing, filing, interview, disciplinary meeting, or other deadline is approaching, say so when you make contact. The right response and any applicable deadline depend on the forum and circumstances; there is no single deadline or remedy that applies to every case.

Preserve the video and its context
Keep the file in the form you received it, if possible, and retain the message, email, platform post, or other transmission through which it arrived. Do not make an edited, trimmed, converted, or detector-processed version your only copy. If you need to make a working copy, keep the received version unchanged and record which copy you used.

A filename, timestamp, metadata field, or hash by itself does not establish that a video is authentic.

How can the video be challenged?
Pin down exactly what the video is said to show
Ask counsel to identify the precise claim the other side is making. Is the video supposed to show that you were present, said particular words, performed a particular act, or were somewhere at a particular time? Is the offered file claimed to be an original recording or an accurate copy? A challenge may concern who appears in it, whether it was edited, when it was made, or whether it is being presented without important context. “AI-generated” is not the only possibility: a recording may also be clipped, compressed, mislabeled, altered, or genuine but described misleadingly.
Examine how the offering party will authenticate it
In most U.S. federal proceedings, Federal Rule of Evidence 901(a) requires the party offering an item to produce evidence sufficient to support a finding that it is what that party claims it is. Rule 901(b) gives nonexclusive examples, including testimony from someone with knowledge, distinctive characteristics considered in context, and evidence describing a process or system that produces an accurate result.

Authentication is not the same as proving every detail in a recording is true. A video could be authenticated as the file a witness received, for example, without that alone establishing when it was recorded or whether its apparent context is accurate. Nor does Rule 901 mean every video requires a forensic expert. The specific claim and the evidence supporting it matter.
Ask targeted questions about source and handling
Counsel can assess questions such as:
- Where did the file originate, and how, when, and where was it obtained?
- Who possessed it, where was it stored, and how was it transferred?
- Was it edited, clipped, converted, compressed, or otherwise processed?
- Are there earlier copies, an original source, related recordings, or witnesses who can confirm or contradict what it appears to show?
- What metadata or other technical information is available, and what can it establish in context?
- Were forensic tools or methods used, and can a qualified expert explain their limits and how they were applied?
These are investigative questions, not a binding checklist or a guarantee that any particular test will identify fabrication. A general-purpose online deepfake detector should not be treated as a conclusive answer.

When might expert testimony matter?
An expert may be relevant when technical issues about a file, its handling, or a method of analysis need explanation. But an expert cannot be assumed to determine whether every video is fake, and the availability of a test does not guarantee a definitive result.
In a U.S. federal proceeding, Rule 702 governs expert testimony. Among other requirements, the party offering the testimony must show that the expert’s specialized knowledge will help the factfinder, that the testimony rests on sufficient facts or data and reliable methods, and that the expert reliably applied those methods to the case. Whether expert analysis is useful or appropriate depends on the recording and the dispute; it is not an automatic step.

Is there already a special federal rule for deepfake evidence?
U.S. Courts committee material has discussed possible deepfake-specific changes to evidence rules, including a proposed special provision related to Rule 901. A committee discussion or proposal is not itself binding law. The official Federal Rules of Evidence page cited for this topic states that the rules were last amended in 2024; that date does not establish whether a later rulemaking action has occurred. Have counsel check the rules and rulemaking status applicable to the specific court and proceeding.
