The key questions are whether the image is intimate, who owns the original photograph, whether the ad falsely suggests your endorsement, which platform published it, and which state’s law applies.
Start by preserving proof
Do not begin by arguing with the advertiser or deleting your own copies. An ad can be edited, removed, or reposted within minutes. Create an evidence folder and preserve the original material in a way that shows when and where you found it.

- Save the exact ad URL. Copy the full address from your browser, including any path or post identifier.
- Capture the ad itself. Take screenshots showing the image, surrounding text, advertiser name, account handle, product, price, claims, comments, and platform interface. Make a screen recording if the ad is a video, story, livestream, or disappearing post.
- Record timing and identifiers. Note the date and time, your time zone, the account or page name, campaign ID if displayed, and any report or content ID.
- Preserve communications. Keep emails, direct messages, support tickets, automated replies, and every report-confirmation number. Export or download them when the service allows it.
- Keep the original file if you own it. Preserve the unedited photograph, metadata, original upload, and any licensing or commissioning records. Do not overwrite the file while adding annotations; make a separate working copy.
If you use the federal intimate-image process described below, the Federal Trade Commission says to identify the platform and where the image appears, then download a copy of the FTC report after submitting it. Store that report with the rest of your evidence.

Different rights attach to the same pixels. A person may control a photograph’s copyright, a separate interest in commercial use of their identity, or neither. Use this triage to select the first escalation route rather than sending a generic takedown request.

| Is the image intimate, or an AI-generated digital forgery of intimate imagery, shared without consent? | Use the platform’s nonconsensual-intimate-image process and assess the TAKE IT DOWN Act. | The Act creates a specific removal process for covered platforms and qualifying content; it is not a general likeness remedy. |
| Did you take the original photograph, such as a selfie? | You are likely the copyright owner and may have a DMCA route. | Copyright generally follows authorship of the photograph, not simply the person depicted. |
| Did someone else take the photograph? | Ask the photographer or rights holder to act, while using privacy, publicity, impersonation, or platform policies for your own interests. | Being recognizable in a photograph usually does not give you the photographer’s copyright. |
| Does the ad make it appear that you recommended or used the product? | Document the testimonial or endorsement message and consider an advertising-deception report. | An unauthorized likeness can create a misleading endorsement even when the image is not intimate. |
| Is the dispute about commercial use of your identity? | Get advice under the law of the relevant state. | Publicity and privacy rights vary substantially by jurisdiction and by whether the person is a resident, the publisher is located there, or the conduct occurred there. |
Report the ad to the platform
Use the reporting path that matches the harm. A platform may separate impersonation, privacy, intellectual-property, and intimate-image complaints, and selecting the wrong category can delay review.
- Open the ad’s menu and choose the closest option for impersonation, privacy, unauthorized commercial use, intellectual property, or nonconsensual intimate imagery.
- Describe the specific violation in factual terms: identify the image, explain that it depicts you, state whether it is intimate, and identify the advertiser and product.
- Attach screenshots, the exact URL, and any proof of identity or authorship the form requests. Redact unrelated private information.
- Save the confirmation page, case number, and submitted text. If the platform asks follow-up questions, answer consistently and preserve each response.
Report every materially different copy you find. If the advertiser has a business page, an affiliate account, or a separate landing page, record those locations instead of assuming one report reaches all versions.
When the TAKE IT DOWN Act can help
The TAKE IT DOWN Act addresses covered nonconsensual intimate imagery, including qualifying AI-generated digital forgeries. It does not cover every unauthorized advertisement, ordinary face swap, or commercial use of a person’s likeness.

What the federal process requires
For a covered image on a covered platform, submit a valid request through the platform’s designated process and identify where the image appears. The Federal Trade Commission says the platform must remove the qualifying image and known identical copies within 48 hours after receiving a valid request. That is a statutory response period for this specific process, not a promise that every ad dispute will be resolved in two days.
If the platform has no usable request process, the process is broken, or it does not remove the covered image and known identical copies within that period, report the platform to the FTC at TakeItDown.ftc.gov. Download the submitted FTC report and retain the confirmation.
What the Act does not decide
- It does not determine that every AI-generated advertisement is intimate imagery.
- It does not provide a general 48-hour takedown guarantee for a non-intimate ad.
- It does not automatically award money to the person depicted.
- It does not replace state-law advice about publicity, privacy, or other claims.
The FTC’s May 2026 business guidance says platforms that violate the Act may face civil penalties of $53,088 per violation. That figure concerns platform compliance; it is not compensation payable automatically to the person in the ad.

FTC Chairman Andrew Ferguson said in a May 19, 2026 FTC transcript: “If someone shared an intimate photo or video of your child, or of you without your consent, it can be stressful and overwhelming.” The federal process is designed for that defined category, so describe the content accurately rather than labeling every unwanted AI ad as intimate imagery.

Use a DMCA notice only when you own the photograph
The Digital Millennium Copyright Act protects the copyright in a creative work, including a photograph. It does not grant the person whose face appears in someone else’s picture an automatic copyright claim.
If you took the photo
A selfie is the clearest example. The U.S. Copyright Office’s Section 512 guidance states: “If you took the photo—for example, if it is a selfie—then you are likely the copyright owner and can submit a takedown notice under section 512.” Send the notice to the service provider’s designated DMCA agent, not merely to a general customer-service inbox.

A compliant notice generally identifies the copyrighted work, identifies the material to be removed and its location, supplies your contact details, includes a good-faith statement that the use is unauthorized, includes an accuracy-and-authority statement under penalty of perjury, and bears your physical or electronic signature. Use the provider’s published designated-agent instructions and keep a copy of everything submitted.
If someone else took the photo
The photographer usually owns the copyright unless it was assigned or created under an arrangement that changes ownership. Your face, clothing, or identity in the frame does not by itself transfer that copyright to you. Ask the photographer or rights holder whether they will file the copyright notice, and separately pursue impersonation, privacy, publicity, endorsement, or platform-policy remedies available to you.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesAI alteration does not erase ownership questions
An advertiser may have generated a new image rather than copied the original file. That can make a copyright notice more fact-dependent. Preserve the source photograph, the ad, and evidence of how the advertiser used it. A lawyer can assess whether the new work reproduces protected expression, uses an unauthorized edit, or primarily raises a likeness or endorsement issue.
Best Value
If the ad falsely implies that you endorsed the product
Look beyond the face. Save the words, voice, captions, product demonstrations, star ratings, “I use this” statements, before-and-after claims, and any disclosure language. An AI avatar is not automatically an unlawful testimonial. The problem is whether reasonable consumers would think the real person actually gave the favorable recommendation.
FTC guidance explains that the endorsements rule does not categorically prohibit AI avatars, but an unauthorized celebrity avatar used to create a favorable testimonial may violate the rule when it communicates that the celebrity actually endorsed the product. The same logic can matter for non-celebrities when the ad presents the depicted person as a real customer, expert, or spokesperson.
When reporting, identify the precise implied statement rather than merely saying “AI was used.” For example, explain that the ad uses your likeness beside a first-person claim, presents a synthetic voice as yours, or labels you as a customer when you never used the product. Misleading advertising can be reported through relevant consumer-protection channels, while a private claim may depend on state law and the evidence of commercial use.
State privacy and publicity rights may be the main route
Unauthorized commercial use of a person’s identity can implicate a state right of publicity, privacy law, or related unfair-competition theory. The available claim, protected attributes, consent rules, exemptions, damages, and filing deadlines vary. Some jurisdictions protect a person after death; others do not. Some distinguish advertising use from news, parody, or expressive works.
The U.S. Copyright Office’s report on digital replicas identifies possible state and federal frameworks, including state privacy and publicity law, the Copyright Act, the FTC Act, the Lanham Act, and Communications Act provisions. Those are issue-spotting categories, not a conclusion that a particular claim succeeds. A licensed attorney must evaluate the actual ad, source-image ownership, publisher, audience, contracts, location of the parties, and applicable choice-of-law rules.
Prepare for legal advice efficiently
- Bring the evidence folder, original files, URLs, timestamps, and report confirmations.
- List every advertiser, platform, agency, affiliate, and landing page you can identify.
- Write down whether you ever gave permission, signed a release, licensed your image, or accepted compensation.
- Describe any measurable harm, such as lost work, customer confusion, harassment, reputational damage, or unauthorized sales attribution.
- Ask about preservation letters, demand letters, emergency relief, damages, and limitation periods before contacting the advertiser publicly.
Decision guide: which path should you use?
| Situation | First action | Next escalation |
|---|---|---|
| Non-intimate AI ad, you took the photo | Platform report plus a DMCA notice to the designated agent | State-specific publicity or privacy advice if the commercial use continues |
| Non-intimate AI ad, someone else took the photo | Platform impersonation or privacy report; contact the copyright owner | State-specific likeness or endorsement advice |
| Covered nonconsensual intimate image or qualifying digital forgery | Platform intimate-image request | FTC report if the covered process fails or the image is not removed within the statutory period |
| Ad presents you as a customer or spokesperson | Preserve the endorsement claim and report the misleading advertising | Attorney review of publicity, unfair-competition, or other applicable claims |
| Multiple reposts or changing URLs | Capture each location and identifier | Submit separate platform reports and provide the complete list to counsel |
Common mistakes that weaken a complaint
- Sending a DMCA notice because your face appears. Copyright ownership usually belongs to the person who made the photograph, not every person depicted.
- Calling every deepfake intimate. The TAKE IT DOWN Act has a defined scope; an ordinary commercial face swap may require a different route.
- Relying on a single screenshot. A screenshot without the URL, account, date, or surrounding claim may not establish who published the ad or what it communicated.
- Deleting the ad before documenting it. Removal is useful, but lost evidence can make later demands or litigation harder.
- Assuming a platform’s removal proves legal liability. Platforms may remove content under private policies without deciding who owns rights or whether a statute was violated.
- Threatening the advertiser before securing evidence. A public confrontation can prompt edits, account changes, or deletion of records.
- Expecting the federal penalty to be paid to you. The FTC’s stated civil-penalty figure applies to platform violations and is not an automatic personal award.
What a complete escalation record should contain
Keep a chronological log with the first discovery, every URL, every copy, each report, each response, and every change you observe. Include the exact wording that made the ad look like an endorsement, the source of the original photograph, and any release or license you may have signed. If the ad targets a particular state, uses a local business, or causes local customer confusion, note those facts. This organized record lets a platform reviewer, regulator, photographer, or attorney act without reconstructing the incident from memory.
