Preserve a restricted record of what appeared, report it privately to the service provider, and alert your organization’s privacy or security contact if the incident involved work. Whether it is legally a data breach—and whether anyone must be notified—depends on the facts and the law that applies.
First, contain the disclosure
- Do not amplify the details. Avoid reposting, forwarding, or quoting the output where others can see the person’s information. If you need to discuss the incident, describe it without repeating the private details.
- Do not assume the output is true. Chatbot text can sound convincing while being inaccurate. The Australian Office of the Australian Information Commissioner (OAIC) describes a case in which a chatbot reproduced identifiable people and details from an ongoing court case in a scenario presented as fictional. The OAIC also warns that inaccurate outputs can have consequences including reputational harm, misinformation, or unfair decisions. OAIC guidance on privacy and commercially available AI products.
- Limit access to evidence. Keep a private record of the exact wording, date, AI service, account context, and conversation link or screenshot. Store it somewhere with restricted access, especially if it contains sensitive information. Do not circulate the screenshot as a way of reporting the problem.
Report the output to the AI provider
Use the service’s privacy, safety, or support channel and explain what appeared, where it appeared, and why it may identify or expose someone. Ask the provider to review the output and, where its process allows, correct, suppress, or remove it. Share only the identifying details needed to locate and assess the issue, and use a private reporting channel.

A request does not guarantee that information will be removed from a model or every related system. If an employee entered customer, patient, staff, or other personal information into a public chatbot—or the disclosure occurred through an organizational AI service—notify the designated privacy, security, or incident-response contact. Follow your organization’s process for preserving evidence and limiting access; don’t independently send sensitive records to additional people or services.

The OAIC notes that submitting personal information to a public chatbot can disclose it to the chatbot owner. Ireland’s Data Protection Commission recommends understanding what data is involved, who provides the AI service, how data is retained or reused, and what rights-handling process applies. Check the specific provider’s terms and privacy information rather than assuming all chatbot services handle data alike. Work out who may be at risk and what rules apply
Whether an AI output amounts to a legally defined personal-data breach is not determined by the label alone. The assessment depends on what information appeared, whether a person can be identified, who controlled the service, how widely the output was accessible or shared, and the applicable jurisdiction and legal roles. Notification duties and deadlines also vary; there is no single worldwide rule for every chatbot disclosure.

For incidents potentially governed by the EU General Data Protection Regulation, the European Data Protection Board’s Guidelines 9/2022 address personal data breach notification. They are guidance for that legal framework, not a universal notification rule. For sensitive, safety-critical, or workplace information, consult the responsible privacy officer or the relevant local regulator’s guidance; seek qualified local advice if the consequences or obligations are unclear. The affected person may have rights to pursue
If you are the person whose information appeared, you can ask the organization responsible for the relevant data or AI service how it obtained and used the information, and whether access, correction, deletion, or another right applies. Which rights are available depends on the law, the organization’s role, and the circumstances. The UK Information Commissioner’s Office says using AI does not by itself remove a controller’s obligations to handle people’s rights requests. ICO guidance on individual rights and AI.

If you are reporting on another person’s behalf, avoid sending more of their information than necessary. The provider or organization may need enough detail to verify the request and locate the relevant output, but the process and possible outcome differ by service and jurisdiction.

Choose the response route by the incident
- Personal account, limited exposure: preserve a restricted record and report the output privately to the provider.
- Work account or organizational data: notify the internal privacy, security, or incident contact and follow the organization’s response process.
- Sensitive or safety-critical information, or potential harm: restrict further access, involve the appropriate privacy or security lead promptly, and use local regulator guidance or qualified advice to assess obligations.
- The affected person wants control over their information: they can contact the responsible organization to ask about access, correction, deletion, or other applicable rights.
