If tokens were not released on the date you expected, first establish who controls them, which document sets the release condition, and whether the trigger actually occurred. Then preserve the records, request a written explanation tied to the contract, and use the agreement’s complaint or dispute process. A delay by itself does not prove fraud, insolvency, or a legal violation.
Identify the kind of release that failed
“Token custodian” can describe several legally and technically different arrangements. The remedy depends on whether an issuer still owes delivery, an exchange or institutional custodian is processing a withdrawal, or code is enforcing a vesting rule. The SEC and CFTC’s 2026 interpretation discusses agreements in which an issuer promises to deliver tokens later, as well as custodial staking arrangements; those are not the same as an on-chain vesting contract. Do not treat an issuer promise, a custody agreement, and protocol rules as interchangeable. A missed date can mean the condition was not satisfied, a request is still inside an agreed processing window, a compliance hold applies, or the responsible party has failed to perform.

Collect the documents that control release
Create one folder containing the complete, current record. Start with the document that created your entitlement, then add every later term that could modify timing or eligibility.

- Token purchase, grant, allocation, or future-token agreement.
- Custody agreement, platform terms, staking terms, and the version in force when you deposited or requested withdrawal.
- Vesting schedule, token-generation or launch notice, amendments, side letters, and release instructions.
- Account statements showing the token balance, wallet or sub-account identifier, and any status such as pending, restricted, or under review.
- Required identity, tax, sanctions, accreditation, or other compliance submissions, including proof of completion.
Write down the promised date and time zone, the token quantity, the event that was supposed to trigger release, any business-day convention, notice period, and every condition or exception. If the agreement says “on” a date, check whether another clause permits processing afterward. If it says “within” a period, calculate the final day using the contract’s definition of a business day.
A filed custody agreement illustrates why this detail matters: it allows up to 24 hours between a withdrawal request and submission to the network, notes that offline key storage can delay processing, and says the custodian will notify clients as soon as practicable of anticipated delays beyond 48 hours. Those are terms in that specific agreement, not an industry-wide rule or an entitlement under your contract. See the filed custody terms example.
Build a dated evidence file
Preserve evidence before accounts, support portals, or message histories change. Keep the original files and an unedited copy of each communication.

- Export account records, balance history, deposit and withdrawal requests, wallet addresses, and transaction hashes where applicable.
- Capture screenshots showing the status, error message, promised date, and the time displayed by the platform.
- Record support-ticket numbers, email headers, names or team identifiers, and every response.
- Maintain a timeline with four columns: what was due, when it was due, what you requested, and what response arrived.
Never give a person claiming to “unlock” or “expedite” tokens your seed phrase, private key, password, multi-factor authentication code, or remote-access credentials. A legitimate custodian should not need those secrets to investigate its own account or contract.

Send a precise written request
Use the official support channel and, if the agreement specifies one, its formal notice address. Keep the request factual and ask for an answer that can be checked against the contract.
- Identify the account or beneficiary record without sending secret credentials.
- State the token, quantity, promised release event, date, and time zone.
- Cite the clause or schedule that you believe applies and attach the relevant page.
- Ask whether the tokens are held, pending, subject to a hold, awaiting an on-chain event, or already broadcast in a transaction.
- Request the specific reason for any hold, the exact contractual or legal basis, and every outstanding condition or document.
- Ask for a concrete estimated release date and the next update date, even if the estimate is conditional.
- Request confirmation of whether a transaction exists; if it does, ask for the transaction hash and network.
Submit once through the designated channel, retain the submission receipt, and avoid sending contradictory versions through multiple informal accounts. This is practical correspondence, not a universal statutory notice form; the contract may require different wording, delivery method, or deadlines.
Test the explanation against the agreement
When the custodian replies, map each reason to a clause and to a fact in your evidence file. Filed custody terms show that a custodian may reserve delay or refusal rights for legal process, compliance duties, transaction limits, or perceived fraud risk. Whether any such clause applies depends on the signed agreement and the actual facts. Review another filed custody-agreement example.
If the explanation is a processing delay
Check when your instruction was accepted, whether the agreement measures time in hours or business days, and whether offline signing, batching, network congestion, or a stated review period is involved. Ask the custodian to identify the start and end of the applicable period rather than accepting an open-ended “pending” label.

If the explanation is compliance or legal process
Ask what document or requirement remains outstanding and whether the custodian can describe the category of hold without violating a legal restriction. Supply only the requested information through the official channel. Do not assume that a compliance label is valid, but do not attempt to bypass it by creating duplicate accounts or routing through an unrelated wallet.
If a transaction was already broadcast
Obtain the transaction hash, network, destination address, and confirmation status. A broadcast transaction is a different problem from an internal account balance that never left custody. Check that the destination address is the one you authorized and preserve the network record for any later dispute.
If no transaction exists and no clause is identified
Reply in writing that the promised event has occurred, list the unanswered questions, and give a reasonable deadline for a substantive response. Keep the tone neutral; an unexplained delay is evidence to investigate, not proof of fraud or insolvency.
Use the agreement’s escalation and dispute routes
Locate the complaint-escalation procedure, notice addresses, governing-law clause, arbitration or mediation requirement, court venue, and any limitation period. Follow the specified sequence and delivery method. A CFTC-filed exchange rulebook demonstrates that these provisions can be express and highly context-specific; it does not prescribe one process for every custodian. See the filed rulebook example.

Escalate internally when the first-line response does not identify a contractual basis or date. Send a concise chronology, the clause you rely on, the requested remedy, and copies of prior correspondence. If the agreement requires a formal notice before arbitration or court action, missing that step can affect your rights.
Consider advice from a lawyer experienced in digital-asset custody or contract disputes when the deadline is material, a hold is prolonged, a large amount is involved, or a limitation period may expire. The useful jurisdiction is usually determined by the agreement, the parties, and the location of the relevant conduct—not by where you happen to live.

A regulator may be relevant depending on the firm, product, conduct alleged, and jurisdiction. A complaint is not a substitute for checking contractual deadlines, and a regulator may not recover assets or decide a private contract dispute for you. The CFTC’s consumer advisory emphasizes research and states:

Read the CFTC consumer advisory. If you file, provide the agreement, timeline, account identifiers, transaction data, and the custodian’s written response. Avoid speculation and distinguish an unanswered request from an actual refusal, misrepresentation, or unauthorized transfer.
When the problem is an issuer, custodian, or smart contract
Issuer did not deliver under a future-token agreement
Confirm that the issuer’s delivery obligation was unconditional and that launch, registration, geographic, identity, or other conditions were met. The SEC/CFTC interpretation explains that a future-token agreement can involve an issuer agreeing to deliver tokens at a later date, but it does not decide whether your issuer breached your contract. Exchange or institutional custodian has not processed withdrawal
Separate an account hold from a network transaction. Ask for the governing clause, the hold category, the review owner or escalation team, and a dated estimate. Check whether the terms permit limits, legal holds, or fraud-prevention delays and whether they require notice.

Verify the contract address and published vesting parameters, the beneficiary wallet, the cliff and interval, and whether an authorized transaction is required to claim. Compare the blockchain timestamp and transaction history with the schedule. If the code or administrator role appears inconsistent with the written promise, preserve the technical record and seek advice before signing a transaction or granting a new permission.
What a delay does—and does not—establish
Without the agreement, parties, facts, and governing jurisdiction, no outside source can determine whether you are entitled to immediate release, whether the custodian is in breach, which regulator has authority, or whether arbitration or litigation is available. The sources above also provide no reliable statistic for how often token releases are late, how long delays usually last, or how disputes end. Treat the missed date as a trigger for document review, written clarification, and timely escalation—not as a conclusion about the custodian’s solvency, intent, or legality.
