Stop the shipment from moving, confirm who imposed the hold, preserve every record, and involve your export-compliance lead before changing the transaction. A flag may be a carrier or freight-forwarder screening alert, an internal review, or a formal government detention. The correct response, deadline and appeal process depend on that distinction.
This guide uses U.S. export-control terminology and Bureau of Industry and Security (BIS) guidance. It cannot determine whether a particular shipment is legal without facts about the item, parties, route, destination and end use.

First response: keep the cargo and facts under control
Treat the notice as an operational stop signal until its basis is clear. Do not assume that a “compliance hold” means a violation occurred, but do not authorize release, rerouting or return while material questions remain unanswered.

Ask the operational and compliance contacts to confirm in writing whether the cargo is physically on hold, where it is located, who placed the hold and whether storage, demurrage or response deadlines apply.
- Obtain the underlying notice. Request the exact concern, issuing entity, case or reference number, documents required, response channel and deadline. If a government office is named, use the official contact information shown on the notice rather than an unverified phone number in an email.
- Preserve the shipment. Tell staff and service providers not to alter the route, parties, quantity, description or shipping paperwork while the review is open. Ask the carrier to maintain the hold and document any movement that is unavoidable for safety or storage reasons.
- Notify the internal owner and legal team. Escalate to the person responsible for export controls, trade compliance or legal affairs. If the notice is an official detention or seizure, or the facts suggest a possible violation, engage qualified export-control counsel promptly.
- Create a single case file. Assign one owner, record every contact and preserve a chronology so that different teams do not send inconsistent explanations.
There is no single hold procedure that applies to every alert. The notice and the issuing authority control the immediate process.

Identify who flagged the shipment
The source of the flag determines what authority exists and whom you must answer.

BIS’s Export Administration Regulations (EAR) authorize inspection and detention of covered items and conveyances at ports, forwarder premises, warehouses and transportation or storage facilities. That authority does not make every private screening message a government action; the actual notice must be checked.
Preserve the complete record
Make an unaltered copy of the alert and all communications, including email headers, portal messages, call notes and attachments. Preserve the documents that show what was sold, authorized, filed and transported:
- Commercial invoice, purchase order, packing list and shipping instructions.
- Bill of lading or air waybill, booking details, carrier correspondence and every routing change.
- Technical description, origin, export-control classification, ECCN or EAR99 determination and the basis for that determination.
- License, license-exception or “no license required” analysis, including conditions relied upon.
- Electronic Export Information (EEI) or Automated Export System (AES) filing, Internal Transaction Number (ITN), exemption statement and any corrected filing.
- Screening results for the exporter, U.S. principal party in interest, foreign principal party in interest where relevant, purchaser, consignee, ultimate consignee, end user, intermediaries, banks and freight forwarder.
- Records of destination, transit and transshipment points, ultimate destination, stated end use and the customer’s business.
- Written authorizations, powers of attorney and instructions allocating responsibilities among the exporter, forwarder and other agents.
BIS freight-forwarder guidance emphasizes resolving discrepancies, checking EEI accuracy and consistency with any license, and retaining shipping records and communications. Do not “clean up” a document by overwriting the original; preserve the original and label any later correction.

Recheck the entire transaction, not just the name that matched
A screening hit can be a mistaken identity, but a clean result for one person does not clear the transaction. Review the item, authorization, parties, route, end user and end use together.
Item and authorization
- Confirm the product identity, model, technical specifications, country of origin and classification.
- Re-test the ECCN or EAR99 conclusion against the actual configuration, software, components and performance.
- Check whether a license is required for the destination, end user or end use, and whether a license exception’s conditions were met.
- Compare the classification and license information with the invoice, packing list, EEI/AES filing and carrier instructions.
Parties and ownership
Review every relevant party, not only the ultimate end user. BIS guidance notes that restrictions can apply to EAR99 items and can attach to an applicant, purchaser or consignee. Use the U.S. government Consolidated Screening List (CSL) and the underlying list or order to resolve a potential match against identifying information such as address, corporate name, country and business activity. A similar name is an investigation lead, not proof of a match; a different spelling is not proof that the party is clear.
Destination, route and end use
- Compare the declared destination with the ultimate destination and all transit or transshipment points.
- Identify every route change, freight handoff and intermediary added after the original review.
- Read the customer’s stated end use and compare it with the product, customer industry and technical capability.
- Investigate unusual payment paths, third-country routing, addresses that do not fit the customer’s business and requests to conceal the final destination.
End-use and end-user controls can apply even when an item is classified EAR99. A classification alone therefore cannot answer whether the shipment may proceed.

Prepare one timeline from order through the hold. For each event, record the date, person, document and information available at the time. Then compare what was authorized with what was filed and shipped.

- Start with the sales order and technical description.
- Record the classification decision, license or exception analysis and any conditions.
- List every party and the date each was added or changed.
- Capture the original destination, all transit points and every routing amendment.
- Compare the invoice, packing list, shipping instruction, license, EEI/AES data and carrier documents field by field.
- Attach screening results and explain how any potential name match was resolved.
- Note inconsistencies, missing information, late changes and who approved them.
Common discrepancies include an ECCN on one document and EAR99 on another, a license number that does not match the EEI filing, a consignee address that differs from the invoice, a quantity or value changed after filing, or a route that no longer reaches the licensed destination. Do not guess which version is correct; establish the underlying fact and document the correction process.
Know the exporter and forwarder’s responsibilities
A freight forwarder is a U.S. person authorized by a principal party in interest to facilitate export services. Depending on the arrangement, that can include air couriers and carriers. Forwarder and exporter should cooperate, but a forwarder’s reliance on customer instructions does not remove its own EAR responsibilities.
Non-routed transactions
For a non-routed transaction, the exporter or U.S. principal party in interest provides information to its authorized U.S. agent, and the agent prepares and submits EEI. BIS states that both the exporter and agent are responsible for the correctness of each EEI entry.

Routed transactions
For a routed transaction, the foreign principal party in interest authorizes a U.S. agent. The exporter-of-record and licensing roles depend on the written allocation recognized under the EAR. Review the power of attorney and written instructions instead of assuming that hiring a forwarder transferred every export-control duty.

Classify the concern before choosing a response
The compliance owner and counsel should place the case in the category that best fits the evidence. The category determines what can be corrected and what requires formal authorization.

Respond through the correct channel
Use the reference number and factual language from the notice. State what is known, what is being verified and when a complete response will be provided. Attach only accurate documents, keep a copy of every submission and record the recipient and timestamp.
If a carrier or forwarder requests clarification, answer its specific questions without speculating about matters still under review. If a government authority requests records or an interview, route the response through the designated compliance lead and counsel. Do not provide conflicting explanations from sales, logistics and legal teams.
Do not arrange a reroute, re-export, return, release, substitution of consignee or change of end use merely to make the alert disappear. Any such move can create a new export, re-export or transfer that needs its own authorization and may destroy evidence relevant to the original review.
When voluntary self-disclosure may be considered
BIS encourages voluntary self-disclosure when a party believes it may have violated the EAR. Under EAR § 764.5, disclosure can be a mitigating factor, but the weight is discretionary and disclosure does not prevent a criminal referral. It is not automatic immunity.
Have counsel or the senior export-compliance owner assess the facts promptly. A significant suspected violation should be initially notified as soon as possible and then thoroughly reviewed under the current BIS voluntary self-disclosure process. The decision should account for the nature of the conduct, whether it is ongoing, the quality of the records, remedial actions and any other agencies or jurisdictions involved. Do not file a rushed or inaccurate disclosure simply to obtain release of the cargo.
Red flags that deserve extra scrutiny
BIS freight-forwarder guidance identifies warning signs that should trigger investigation:
- No ECCN, EAR99 determination or licensing information for a product that requires it.
- An exporter who cannot explain the product, destination or customer.
- Commercial documents that conflict with shipping instructions or EEI data.
- A consignee whose business does not fit the goods or quantities ordered.
- Unusual or residential addresses without a credible business explanation.
- Unexplained third-country routing, transshipment or payment arrangements.
These indicators are not standalone findings that a violation occurred. They show where the fact review should concentrate.
What to avoid while the case is open
- Do not delete, edit or backdate records.
- Do not ask a carrier to release cargo “just this once” while compliance is checking the alert.
- Do not change the consignee, destination, description, quantity or invoice to bypass screening.
- Do not rely on a verbal assurance that a license is “probably” unnecessary.
- Do not assume a forwarder, broker or customer accepted every export-control responsibility.
- Do not contact a suspected restricted party with an accusation or disclose investigative details beyond what counsel approves.
- Do not promise a release date before the issuing authority confirms the conditions.
When the shipment can move again
Release should follow a documented decision, not a lack of follow-up. The case file should show who reviewed the item, parties, route, end use and authorization; how any match or discrepancy was resolved; what the issuing party required; and who approved the disposition.
If the issue was a data error, retain the corrected filing and written confirmation that the hold is lifted. If the concern involved licensing, obtain the applicable authorization before movement. If the matter remains a formal detention, seizure or potential violation, follow the authority’s process and counsel’s instructions. Where the facts cannot establish lawful movement, keep the shipment stopped.
Bottom line for logistics and compliance teams
A flagged shipment is a controlled investigation, not a routine delivery delay. Confirm the source and deadline, hold the cargo, preserve the complete record, recheck every transaction element and escalate before any consequential change. The decisive question is not simply whether a name appeared on a list; it is whether the item, authorization, parties, destination, route and end use can be supported by consistent evidence under the applicable U.S. rules.
