If a Kickstarter game misses its estimate, disappears, or is canceled, start by preserving every record and identifying the exact status. Kickstarter treats backing as support for creating something new, not a guaranteed retail purchase: an estimated delivery month can change and a project can fail. For a funded campaign, however, the creator—not Kickstarter—is responsible for fulfillment and for honest communication. Contact the creator in writing first, then act quickly with your card issuer, regulators, or a local lawyer when the facts justify escalation.
First, identify what actually happened
Your next step depends on whether the campaign failed before collecting money, was funded and later canceled, is merely late, or shows signs of deception. Do not treat all missed dates as fraud.

What Kickstarter’s terms and rules mean
Kickstarter’s current terms describe a direct contract between creator and backer; Kickstarter is not a party to that contract. A backer supports the creation of a new project rather than buying an already manufactured item, and reward delivery is not guaranteed merely because a campaign reached its goal.
The same terms place fulfillment responsibility entirely on the creator. Kickstarter says it does not hold creator funds on the creator’s behalf and does not offer refunds for collected pledges. Its terms state that if a creator cannot complete the project, the creator should make a reasonable effort to reach the best possible conclusion by explaining work completed, how funds were used, and what prevents completion; working diligently and in good faith on a communicated timeframe; showing appropriate use of funds and reasonable efforts; communicating honestly; and offering remaining funds proportionally to backers who received no reward, or explaining an alternate use of those funds to complete the project. The terms also say a creator who cannot satisfy those obligations may face legal action by backers.

Kickstarter’s rules ask creators to post regular updates, respond to messages in a timely way, make a genuine effort to complete the project, proactively communicate failure, and try to resolve issues directly with backers. Kickstarter may assist in some situations but says it is generally unable to mediate disagreements. That means a support ticket can create a record or clarify a platform policy, but it is not a promise that Kickstarter will obtain a refund for you.
Do these five things before the situation gets harder to prove
- Archive the campaign. Save the project URL, creator name, campaign end date, funding result, reward tier, estimated delivery month, pledge amount, shipping charge, and every update. Print or export pages if possible because project text can change.
- Preserve payment and fulfillment records. Keep the pledge confirmation, card or bank statement, survey completion, address submission, add-on receipt, tracking number, customs notice, and any refund or replacement promise. Record the date each item was received.
- Classify the status. Write down whether the campaign failed to fund, was funded and canceled, is late, or has never communicated. This prevents a card issuer or regulator from receiving an unclear account of events.
- Send one factual written request. Use the creator’s Kickstarter message channel and any official contact address shown on the campaign. Ask for specific answers, set a reasonable reply date, and keep your sent message and the response.
- Check your payment deadline now. If you paid with a U.S. credit card, the Federal Trade Commission describes a general 60-day written-notice period for billing errors, measured from the first statement showing the error. Do not wait for a promised future update before asking your issuer how that rule applies.
Ask the creator questions that can be answered
A useful message is specific enough to expose the real bottleneck without accusing the creator of a crime. Request:
- Which parts of the game are finished, in production, in transit, or still unstarted?
- What exact problem is blocking manufacturing, shipping, fulfillment, or a replacement?
- How have pledge funds been allocated among development, manufacturing, freight, taxes, and other expenses?
- What is the next concrete milestone, who is responsible for it, and what date should backers expect evidence of progress?
- When will the next project update be posted, even if the news is unfavorable?
- If the original reward cannot be delivered, what alternatives, partial fulfillment, or proportional return of remaining funds are being offered?
Keep the tone neutral and the questions in writing. A reply that supplies dates, quantities, vendors, photographs, shipping records, or a candid explanation is more useful than a broad assurance that the game is “almost done.” A missed reply is also evidence to preserve.

If the creator says the game cannot be completed
Ask the creator to address the elements described in Kickstarter’s terms rather than accepting an unexplained cancellation. The update should identify work completed, the use of funds, the barriers to completion, and a good-faith plan for the best possible conclusion on a stated timeline.

For backers who will receive no reward, the terms describe an offer to return remaining funds proportionally. The creator may instead explain an alternate use of remaining funds to complete the project. Neither option guarantees a full pledge refund: money may already have been spent on legitimate development, manufacturing, taxes, or shipping. Ask for the calculation, the total remaining amount, the number of unrewarded backers included, the payment method, and the payment date.
Do not send additional money merely to “unlock” a refund unless you independently verify the request and understand the risk. A new payment does not cure the original non-delivery and can make your records harder to interpret.
Choose the escalation route that matches your evidence

How to dispute a payment in the United States
Credit cards
Federal Trade Commission guidance says a charge for something not delivered as agreed can qualify as a credit-card billing error. The general rule it describes is written notice within 60 days after the first statement containing the error was sent. Contact the issuer immediately, use the billing-dispute address and instructions printed on the statement or issuer website, and ask how it treats a Kickstarter pledge.
Send copies, not originals, of the campaign’s estimated delivery month, pledge receipt, statement line, creator updates, your unanswered or rejected requests, and any tracking information. State the facts plainly: what was promised as a reward, what date was estimated, what was actually delivered, and why the transaction remains unresolved. Keep proof of mailing or electronic submission and continue paying undisputed portions of the account while the issuer investigates.

Debit cards and other payment methods
Debit-card protections differ from credit-card billing-error rules. Call the bank’s fraud or dispute department as soon as you know delivery will not occur and ask for its notice deadline and required form. Bank transfers, digital wallets, and prepaid products can have different procedures. Do not assume the 60-day credit-card rule applies to them.
A dispute is a request for the issuer to apply its rules, not a guaranteed chargeback. Kickstarter backing is not identical to an ordinary retail shipment, so the issuer will evaluate the campaign language, payment record, communications, and applicable protections.
Report suspected deception without calling every delay a scam
Evidence that a game is late, over budget, or poorly managed is not by itself proof of fraud. Stronger warning signs include knowingly false claims about manufacturing, fabricated shipping evidence, collecting money while secretly abandoning the project, refusing a stated refund policy, or spending pledged funds on unrelated personal expenses while misrepresenting progress.

You can report a suspected crowdfunding scam to Kickstarter and, in the United States, to the Federal Trade Commission at ReportFraud.ftc.gov. The FTC also identifies the relevant state attorney general as a possible reporting channel. Include a factual timeline and distinguish what you personally observed from what another backer alleged.

The FTC’s 2015 release about its first crowdfunding case described allegations involving a Kickstarter board-game campaign in which promised rewards and refunds were not provided and much of the money was spent on unrelated personal expenses. The matter ended in a settlement order prohibiting misrepresentations and failures to honor stated refund policies. That enforcement example shows why deceptive conduct can attract government action; it does not mean the FTC resolves an individual refund request or that an ordinary manufacturing delay is criminal.
Outside the United States, use the consumer-protection or law-enforcement agency for your own country and check its current complaint process. Deadlines, jurisdiction, and available remedies are local.

Local legal advice becomes more sensible when the loss is substantial, multiple backers have matching evidence of apparent misuse, the creator has made a clear promise and then refused it, or a payment deadline has passed. Bring the complete archive rather than screenshots of only the most favorable update.

Kickstarter’s terms say a creator unable to meet the stated obligations may be subject to legal action, but they do not guarantee that a lawsuit will succeed or that the creator has recoverable assets. Ask about filing fees, service requirements, limitation periods, and the practical cost of pursuing the claim before committing.
Playbooks for the most common situations
The game is late but updates continue
Compare each new estimate with the previous one, ask for the next verifiable milestone, and preserve every update. A creator-side Kickstarter article published in January 2026 describes about a year from campaign end until the last backer receives a package as a general estimate, while complex products, first-time creators, or tooling can take 18 months or longer. That is not an audited statistic or a promise for your campaign. Use the project’s own manufacturing and shipping evidence to judge whether the delay is being managed.
The campaign was canceled after funding
Save the cancellation notice and ask for the work-completed, funds-used, barrier, and remedy details described in the terms. If no reward will be delivered, request the creator’s calculation of any proportional return of remaining funds or the documented alternate use. Contact your card issuer promptly if the applicable dispute window may expire.
The creator has stopped communicating
Send a concise final written request with a response date, then preserve the absence of a reply. Report the communication failure to Kickstarter, ask your payment provider about its deadline, and report suspected deception to the appropriate regulator only when the evidence supports that characterization.

Request the carrier, tracking number, ship date, destination, and any customs or return-to-sender event. Check whether the address you submitted matches the survey record. If tracking is invalid or contradictory, include that evidence in your written request and any payment dispute.
Keep a file that another person can understand
- A one-page timeline with dates, amounts, promises, updates, and your contacts.
- The original reward description and estimated delivery month.
- Pledge confirmation, statement line, survey, shipping payment, and address record.
- Every creator update, message, refund promise, tracking number, and delivery attempt.
- Copies of complaints to Kickstarter, your issuer, and any government agency, plus confirmation numbers.
- A calculation separating the value of any reward or component you actually received from the amount still unresolved.
Clear records help the creator answer, help an issuer apply its procedures, and let a regulator or lawyer distinguish a difficult project from a deliberate deception.
