If a U.S. hospital has marked you or a family member as deceased, first identify the exact record and ask the hospital’s medical-records office to correct it in writing. Then check separately whether the error reached Social Security, Medicare, an insurer, or another organization: fixing one record does not automatically fix the others.
Start by finding where the error appears
Contact the hospital’s medical-records or health information management office and its privacy office. Ask them to identify the exact entry, where it appears, when it was entered, and whether it was sent to another organization. The problem might be in the clinical chart, billing records, a discharge or eligibility feed, or another system.

Request copies of the relevant records. Under HIPAA, patients generally have a right to access records in a covered entity’s designated record set, which can include medical, billing, payment, claims, and insurance records, subject to limited exceptions. See HHS guidance on accessing medical records.

Send a written amendment request identifying the disputed record and entry. Explain why it is inaccurate, specify the correction you want, and include dates, encounter numbers, or account identifiers that help the hospital locate it. Attach evidence the provider reasonably needs, such as current identification or a current treating-provider record. Keep a copy and proof of delivery. A covered entity may require a written request and supporting reason if it informed patients of that requirement in advance.

Ask the hospital to confirm the change in writing and to say which affected systems or recipients it will notify. When a covered entity accepts an amendment, HIPAA requires reasonable efforts to provide it to people identified by the patient who need the correction, as well as people—including business associates—known to have the information and who may have relied, or could foreseeably rely, on it to the patient’s detriment. Read HHS guidance on requesting an amendment.
If the hospital denies the request
Ask for the denial and its reason in writing. HIPAA permits denial on specified grounds, including when the covered entity considers the information accurate and complete or did not create it, with a limited exception if the originator is unavailable. The entity generally must act within 60 days. It may take one extension of no more than 30 days if it gives written notice and a reason.

You may submit a statement of disagreement for inclusion in the record. This preserves your position alongside the disputed information; it does not itself ensure the hospital changes the entry. The amendment guidance above explains the applicable process.
Escalate a HIPAA complaint if needed
If you believe a covered entity has not followed HIPAA requirements, you can submit a written complaint to the U.S. Department of Health and Human Services Office for Civil Rights (OCR). Describe the entity and the alleged noncompliance. OCR generally requires a complaint within 180 days of when you learned of the act or omission, though it may extend that deadline for good cause. A complaint is an enforcement route, not a guarantee that the record will be amended. See HHS instructions for filing a HIPAA complaint.

Social Security Administration records
A hospital chart and a Social Security Administration (SSA) death record are different records. If SSA also lists the person as deceased, contact a local Social Security office promptly. SSA asks for at least one current, unexpired original identity document or a copy certified by the issuing agency. Examples include a passport, driver’s license, employee ID, school record, health insurance card other than Medicare, or certified medical record.
After correcting the record, ask SSA for an “Erroneous Death Case – Third Party Contact” notice to show banks, doctors, or other organizations. SSA describes its process and acceptable identity evidence in its erroneous death record guidance.

Medicare eligibility
If Medicare eligibility is affected by a death date recorded by SSA or the Railroad Retirement Board, CMS says that the agency maintaining the eligibility record must correct it before Medicare eligibility can be updated. CMS also recommends reviewing Medicare eligibility records for hospice, home health, hospital, or skilled-nursing end dates that match the incorrect death date; those dates may help identify the source of the problem. See CMS guidance on erroneous death information.

Contact other organizations that show the error
Ask each affected insurer, pharmacy, bank, employer, or government program what record it relied on and what evidence or process it accepts to correct its own records. Do not assume that a hospital correction or an SSA correction will update Medicare, private insurance, or every third-party database. SSA’s third-party contact process is consent-based and involves specified organizations; other record holders may require separate follow-up.

What the SSA error figures do—and do not—show
SSA’s Office of the Inspector General reported that 5.6 million death records were posted to the Death Master File in calendar year 2025, and that 12,504 records—0.22 percent of those records—were later determined to be erroneous. Those figures concern SSA records, not hospital charts, and do not estimate how often hospitals incorrectly report a patient as deceased. The OIG said SSA errors can stem from administrative entry mistakes or erroneous reports from other sources; those examples do not establish what caused an individual hospital error. See the SSA OIG release on 2025 Death Master File records.
