What to Do If a Hiring Freeze or Layoff Puts Your Job at Risk

A hiring freeze is a reason to prepare, not proof that your position will be cut. Find out what is confirmed, organize the employment and benefits information you are allowed to keep, and learn where to get help before you need it. If a layoff happens, act promptly on unemployment, health coverage, and retirement-plan questions; the rules depend on your state, employer, and plan.

What should you do first if you think you might be laid off?

Start with facts and practical preparation rather than treating rumors as a decision. Ask your manager or HR what the freeze means for your team, when decisions may be made, whether internal transfers are possible, and what transition support is available. A hiring freeze alone does not establish that a layoff is planned or that federal notice rules apply.

Prepare while you are still employed

  • Update your resume, work samples, references, and a concise list of accomplishments. Keep only information you are permitted to retain; do not copy confidential employer or client data.
  • Review your employee handbook, health-plan summary, retirement-plan documents, vesting schedule, and leave balances. Keep personal copies of benefits information and note how to contact plan administrators.
  • Check your near-term expenses and obligations so you understand your financial runway. For legal, tax, or investment decisions, seek advice specific to your circumstances rather than relying on a general checklist.
  • Ask whether a state Rapid Response session or American Job Center support is available if a layoff is announced or expected. Services may begin before a layoff, depending on the location and situation.

The U.S. Department of Labor describes Rapid Response as a way to connect workers with information and services that support re-employment. Its worker guidance says, “The sooner this process starts, the more quickly the stress of a traumatic event such as a layoff can be managed, through access to important information and services that will enhance re-employment opportunities.” See the Department’s Rapid Response guidance for workers.

Does a hiring freeze or layoff mean you are entitled to advance notice?

Not necessarily. The federal Worker Adjustment and Retraining Notification (WARN) Act applies only to qualifying plant closings and mass layoffs by covered employers. A hiring freeze by itself does not establish a right to 60 days’ notice.

Under the Department of Labor’s summary, covered employers with 100 or more employees generally must provide at least 60 calendar days’ advance written notice for a plant closing or mass layoff affecting 50 or more employees at a single site. Employer-counting rules and other details matter; government entities are excluded, and exceptions can apply for unforeseeable business circumstances, faltering companies, or natural disasters. The criteria are complex, and state “mini-WARN” laws may add or change requirements. Review the Department of Labor’s WARN overview, then contact your state dislocated worker unit or an employment attorney about your specific facts.

What should you do when a layoff is announced or your job ends?

  1. Get the key details in writing. Ask for your effective separation date, written separation information, final-pay and benefits details, and contact information for benefits administrators. Read any severance or separation agreement carefully and get qualified advice if you need help understanding its effect.
  2. Contact your state unemployment agency. Ask about current eligibility rules and filing steps. The Department of Labor says people unemployed through no fault of their own, as determined under state law, may qualify if they meet other conditions; state agencies decide eligibility. Do not assume you qualify or rely on a universal estimate of payment or timing. Start with the Department of Labor’s termination guidance and its information on unemployment benefit denials.
  3. Record health-coverage end dates. Compare available coverage options and confirm effective dates before choosing. For COBRA, check the actual election notice for the deadline and premium.
  4. Check your retirement-plan documents. Ask the plan administrator about vesting, outstanding loans, distribution rules, and beneficiary and contact details before moving money. A rollover is not automatically the best choice; consider individualized tax or financial advice.
  5. Use public job-search support. Ask about Rapid Response, an American Job Center, and CareerOneStop for job-search help, training information, and related services.

How do you keep health insurance after losing a job?

Compare COBRA, a spouse’s employment-based plan, Marketplace coverage, and Medicaid or CHIP if you may be eligible. These options have different eligibility rules, costs, networks, and effective dates. Compare the premium along with deductibles, out-of-pocket exposure, prescription coverage, provider networks, and whether family members can enroll.

Understand the COBRA deadline and cost

For eligible plans, federal COBRA guidance generally gives you 60 days to elect continuation coverage, measured from the later of the date job-based coverage ends or the date you receive the election notice. After job loss, continuation is usually available for up to 18 months. You generally pay the full premium plus an administrative fee of up to 2%—a total of up to 102% of the plan cost. Check your election notice for your specific deadline, premium, and coverage dates. Read the Department of Labor’s COBRA guidance.
