If you learn that a healthcare organization exposed your personal information, first verify the notice through a contact method you find independently, then find out exactly what data was involved. Keep the notice, watch for unfamiliar medical bills or insurance activity, and use the free government recovery and complaint channels that fit the problem. A breach notice is not a 60-day deadline for you to finish these steps.
Verify the notice and find out what was exposed
Unexpected texts, emails, or calls about a breach can themselves be scams. Contact the provider, health plan, or service using a phone number or website you locate independently, such as through a previous statement or the organization’s known official site. Do not rely only on contact information in an unexpected message.

Ask the organization:
- Which categories of information were involved—for example, contact details, account identifiers, insurance information, or medical records?
- What dates did the incident cover, and when did the organization discover it?
- What steps does it recommend for your specific exposure, and is assistance available?
Save the notice and record when you contacted the organization, whom you spoke with, and what they said. You can also request the organization’s Notice of Privacy Practices, which describes its information practices and your rights; HHS says individuals may request a copy at any time: HHS: Notice of Privacy Practices.

Medical identity theft can involve someone using your name, Social Security number, health insurance account number, or Medicare number to obtain care, prescription drugs, or medical devices—or to submit insurance claims. It can affect bills, insurance benefits, and the accuracy of your medical records. The FTC lists these warning signs:

- Your insurer says you have reached a benefit limit, though you do not recognize the services that used it.
- You find unfamiliar visits, prescriptions, claims, equipment, or other services in billing or insurance records.
A warning sign is a reason to investigate, not proof by itself. Review statements and insurer explanations of benefits for unfamiliar providers, dates, or services. For more FTC guidance, see What To Know About Medical Identity Theft.
Request records and correct anything that is wrong
If you suspect someone used your identity to receive care, contact the doctors, clinics, hospitals, pharmacies, laboratories, and insurers where the information may have been used. Request copies of relevant records and compare them with care you actually received.

If a record is inaccurate, write to the provider. Identify the error, explain what is correct, and include a copy of the relevant record. Use a delivery method that confirms receipt, and keep a copy of your letter and attachments. The FTC says the provider must respond to a correction request within 30 days and notify other providers who may have the same error. If a provider refuses to give you records to protect a thief’s privacy, ask its privacy contact, patient representative, or ombudsman to review the refusal. See the FTC’s step-by-step guidance: What To Do if Someone Is Using Your Medical Information.

Choose the right recovery or complaint channel
If someone used your identity or insurance
Use IdentityTheft.gov to report suspected identity theft and get a personal recovery plan. The site asks about your experience and provides steps tailored to it; Spanish-language guidance is available at RobodeIdentidad.gov.
If you suspect a HIPAA violation
You can submit a complaint to the HHS Office for Civil Rights (OCR) through its health information privacy, security, and breach notification complaint process. OCR investigates reported breaches affecting 500 or more individuals; it may investigate smaller breaches depending on resources and enforcement priorities. A breach appearing in a government portal or being investigated does not establish whether your own information was involved.

If you are an individual trying to recover
Do not confuse personal recovery with the FTC’s Health Breach Notification Rule form. That form is for organizations reporting certain breaches of personal health records, not for an individual’s recovery plan. For suspected identity theft, use IdentityTheft.gov instead.
Understand the notice deadline without treating it as your deadline
For covered entities handling unsecured protected health information, HHS describes the individual notice rule as requiring notice without unreasonable delay and no later than 60 calendar days after discovery. Written notice is generally sent by first-class mail to the person’s last known address, or by email if the person agreed to electronic notice. This is the covered entity’s obligation, not a deadline for you to complete protective steps. See HHS’s 2026 report on breach notification, covering calendar year 2024.

HIPAA generally treats an acquisition, access, use, or disclosure of protected health information not permitted by the Privacy Rule as a breach when it compromises the information’s security or privacy. Not every health-related app or business is covered by HIPAA; some personal health record businesses outside HIPAA may fall under the FTC’s Health Breach Notification Rule. The rules that apply depend on the organization and the incident.
