Read the whole form, ask whether it is a retailer’s sale condition or a government-required certification, and sign only if every statement is true and you are willing to honor it. A retailer’s declaration does not, by itself, determine whether a later export or transfer is lawful.
What prompted the question
On October 2, 2026, Tom’s Hardware reported that a buyer at Micro Center in Tustin, California, was asked to complete an “Advanced Computing Product Purchaser Declaration” while buying a workstation that included an NVIDIA GeForce RTX 5090 Founders Edition. The report attributes the account and an image of the form to a customer post.

According to the report, the form requested the purchaser’s legal name, address, government-issued photo ID, phone number and email, as well as the end user if different, installation location and intended end use. Its reported wording prohibited export, reexport, resale, transfer, or otherwise causing the product to leave the United States, regardless of destination.

Why do I have to sign a no-export form to buy a graphics card?
The available reporting establishes that the form was presented as a condition of a particular sale, but it does not establish the retailer’s reason. Nor does it show that federal law requires this specific declaration. Ask the store directly whether it is imposing its own sale condition or claiming that a government rule requires the form; if it claims the latter, request the legal authority or written policy.
A store’s condition for making a sale and the government’s export-control rules are separate matters. A retailer may decline a sale on its stated terms, but that does not settle whether a particular export would be lawful. Likewise, a buyer should not treat a store form as proof that every export of the product is prohibited by law.

What to check before signing
- Read the exact written terms. Check whether the form restricts only export or also reexport, resale, transfer, or indirectly causing the product to leave the United States. The reported form included the phrase “NO EXPORT – NO EXCEPTIONS” and covered those additional actions, regardless of destination; those are words attributed to the reported form, not to the Bureau of Industry and Security (BIS).
- Clarify the basis for the request. Ask whether signing is the retailer’s condition of sale or a government-required certification. The news report records the form but does not establish the store’s rationale.
- Ask about your personal information. The report lists the information requested but does not establish how the retailer handles it. Ask who can access it, how long it will be retained, and whether it will be shared.
- Check whether you can honestly make the promise. Sign only if each statement is accurate and you are willing to comply. If you expect to export, reexport, resell, transfer, or otherwise cause the card to leave the country in a way the form forbids, decline the purchase rather than signing a promise you do not intend to keep.
- Keep the paperwork. If you sign, retain a copy of the completed form and any written explanation from the retailer. A later move, gift, resale, or shipment could conflict with broad wording even if you believe the destination is allowed under export law.
Export-control rules depend on more than the product name
BIS explains that end-user restrictions can apply to items subject to the Export Administration Regulations (EAR), including EAR99 items, and in situations where a license would not otherwise be required based on classification or destination. End-use controls can also trigger a license requirement even when classification alone would not. So describing a product as a consumer graphics card is not enough to conclude that every relevant restriction is inapplicable.

The applicable classification, destination, end user, end use and transaction details matter. Before an international shipment or transfer, check the rules for the specific item and parties using BIS item-classification resources, its regulations, and its country and end-user guidance. Export controls can change; if the answer for a high-value GPU transaction remains unclear, consult an export-control lawyer or contact BIS.

What BIS’s red-flag guidance means for a buyer
BIS’s Know Your Customer guidance is primarily directed at exporters and firms, rather than written as a checklist for consumers signing a retailer’s form. It tells firms to investigate abnormal circumstances that could indicate an inappropriate end use, end user or destination. If concerns remain unresolved, the guidance says to refrain from the transaction or advise BIS and wait.
“If they can, you may proceed with the transaction. If the ‘red flags’ cannot be explained or justified and you proceed, you run the risk of having had ‘knowledge’ that would make your action a violation of the EAR.”
