What to Do If a Game Company Sends You an Arbitration Notice

If a game company sends you an “arbitration notice,” first identify what kind of document it is and write down its deadline. An opt-out reminder, a company’s pre-arbitration Notice of Dispute, and a formal Demand for Arbitration are different steps with different recipients and consequences. Save the complete notice, check the exact terms for your account and game, and follow the deadline and delivery instructions that apply to your document—not a deadline quoted for another company.

Identify which kind of notice you received

The phrase “arbitration notice” does not identify a single stage of a dispute. Look at the document’s title, who sent it, and whether it names an arbitration administrator or case number.

Document What it means Deadline and delivery details
Opt-out notice or reminder The company is describing a way to reject arbitration terms that may already have been accepted. This is not a response to an active arbitration case. The window and required method depend on the specific agreement. Activision’s Terms of Use and SEGA’s EULA each give a 30-day opt-out example; Activision’s example uses email, while SEGA’s uses written notice by mail. Do not apply either example to another company or contract version.
Company Notice of Dispute A required preliminary step intended to give the company an opportunity to address a dispute informally. It is not the same as an administrator opening an arbitration case. Take-Two’s current terms provide a company-specific example requiring identity and account details, the game or service, a reasonably detailed description of the dispute, and a proposed resolution. Use the instructions in the terms that apply to you.
Demand for Arbitration or administrator case notice A formal proceeding may be underway. The notice may identify the administrator, case number, claimant, and response process. Use the date, recipient, format, and response instructions in the actual notice and applicable rules. Under the American Arbitration Association’s 2025 Consumer Arbitration Rules, Rule R-5(a), a respondent may answer within 14 calendar days after the AAA requests an answer. That is an AAA-rule example, not a universal deadline.

What to do as soon as it arrives

  1. Preserve the complete record. Save the notice and every attachment. Keep the original email with its headers, the envelope if it arrived by mail, delivery information, account notifications, and related communications. Do not alter or delete material that could help establish when or how you received it.
  2. Record the deadline and its trigger. Note the date, whether the days are calendar or business days, and what event starts the clock—for example, receipt of a notice or a request from an administrator. Do not assume the date printed on a document is the only relevant date.
  3. Check that the sender and case are genuine. Find the game company’s legal or terms page and the administrator’s official contact information independently. Do not rely solely on a link, phone number, or payment instruction in an unexpected message. Published administrator rules explain a process; they do not authenticate a particular notice.
  4. Find the agreement that applies to your account and dispute. Check the dispute-resolution section for the administrator, required preliminary notice, delivery address or email, applicable rules, opt-out terms, deadlines, and any stated small-claims exception. The relevant version may depend on the account, game or service, platform, and date.
  5. Organize the facts you may need. Keep your account or user ID, account email, game or service name, purchase or subscription records, relevant screenshots and correspondence, the remedy or amount at issue, and a short chronology together. Share only information requested by the notice or a verified administrator.
  6. Use the specified submission route and keep proof. If a response or notice is due, send it to the right recipient by the required method and retain a copy and evidence of submission or delivery. An opt-out process and a response to a filed case are separate; meeting one does not automatically meet the other.

If an administrator has opened a case

Read the administrator’s notice and the rules it identifies for the exact response deadline, format, delivery recipients, and any process for raising an objection. If the case is with the AAA under its 2025 Consumer Arbitration Rules, Rule R-5(a) says the respondent may submit a written answer within 14 calendar days of being requested by the AAA and should copy the other parties.

Under that AAA rule, if no answer is filed, the case proceeds and the AAA treats the respondent as disagreeing with the claim. The rule does not say that silence accepts the claim. Still, do not rely on that provision as permission to miss a deadline: it applies to the stated AAA process, and your notice and applicable rules govern your situation.

#1 Best Overall

An answer is not an opt-out notice, a company’s preliminary Notice of Dispute, an objection to an administrator’s rule choice, or a court filing. Which other steps are available—and when they must be taken—depends on the agreement, administrator, case stage, and applicable law. A generic response form may not preserve every objection or right.

When to get legal advice

Consider contacting a consumer-arbitration attorney or legal aid promptly if the deadline is close, the amount or consequences are substantial, you dispute whether you agreed to the terms or whether the named administrator can handle the case, or you cannot tell whether the notice is genuine. AAA says representation is not generally required, but its overview describes arbitration as final and binding and advises considering legal advice. The effect of a particular agreement or notice depends on facts and law that cannot be determined from the document title alone; this U.S.-leaning guidance is not individualized legal advice.
