If a clothing seller appears to have charged the wrong GST, do not rely on an old rate chart or an amount shown on a price tag alone. Save the invoice and transaction evidence, identify the garment classification and supply date, ask the seller for the rate calculation and a corrected invoice, and escalate through the National Consumer Helpline if the seller does not resolve it. A current rate must be checked against the operative notification for that transaction because broad GST changes took effect on 22 September 2025, while some CBIC apparel FAQs still display the earlier threshold.
Why a clothing GST dispute is not settled by the tax percentage alone
The rate printed on an invoice can be wrong, but establishing that requires more than comparing it with a remembered 5% or 12% figure. Four facts normally control the analysis:
As an Amazon Associate I earn from qualifying purchases.
- Garment classification: the item must fit the correct tariff or rate entry. A shirt, made-up accessory, footwear item, fabric length and bundled set may not share the same entry.
- Transaction value: the relevant value may be the taxable transaction value, not the retail price printed on packaging.
- When the supply occurred: a rate change can make the supply date, invoice date, payment date or advance date significant under time-of-supply rules.
- The operative notification: a rate table copied from an old article may no longer apply after a later amendment.
For that reason, treat a suspected error as a documentation and classification question first. You can still ask for a refund or corrected invoice, but avoid asserting a precise rate until those facts are checked.

- Itemised tax invoice, including invoice number and date.

- Payment proof from your bank, card, wallet or cash receipt.
- Delivery record and the date you actually received the goods.
- Emails, chat messages and call summaries exchanged with the seller.
- Any return, replacement or credit-note document.
An invoice is expected to state the taxable value, tax rate and tax amount. Those particulars give you a concrete basis for asking the seller how the charge was calculated. Do not send away the only original receipt; provide copies and retain the originals.
Step 2: Build a short transaction timeline
Write down four dates: when you placed the order, when any advance was paid, when the seller issued the invoice, and when the goods were supplied or delivered. Add the date on which the seller received the balance, if payment was split.
This matters because a later invoice date does not, by itself, decide the applicable rate. If a GST amendment took effect between an advance and delivery, time-of-supply provisions may determine which rate applies. Department of Consumer Affairs guidance says broad changes recommended at the GST Council’s 56th meeting took effect for most goods and services on 22 September 2025. The exact result still depends on the garment, the supply event and the relevant notification.

Step 3: Check the invoice arithmetic
Separate the seller’s calculation into taxable value, GST rate, GST amount and final amount. Recalculate the tax using the displayed rate and check whether the tax is split into CGST and SGST or charged as IGST, as appropriate to the transaction.
| Invoice item to inspect | What to verify |
|---|---|
| Product description | Does it accurately describe the garment, material, set or accessory supplied? |
| Taxable value | Is the value the agreed transaction value after disclosed discounts, rather than an unexplained higher figure? |
| GST rate | Which rate entry and classification did the seller use, and is the cited notification valid for the supply date? |
| Tax amount | Does the amount equal the taxable value multiplied by the stated rate, subject to rounding? |
| Invoice total | Does the total reconcile with the amount charged to your payment method? |
| MRP reference | If an affixed MRP exists, compare the final amount demanded with that MRP separately from the tax line. |
A mismatch in arithmetic is different from a disagreement about the legally applicable rate. Record both issues separately in your complaint.
How to verify the applicable clothing rate without relying on a stale threshold
The older CBIC figures are a historical reference, not an automatic current answer
CBIC’s currently surfaced GST Rates FAQ and associated schedule still display a rule for relevant readymade garments under which a sale value not exceeding ₹1,000 per piece is shown at 5% and a value exceeding ₹1,000 is shown at 12%. Those materials also describe sale value as transaction value rather than retail sale price.

Because official consumer-affairs guidance records broad GST changes effective 22 September 2025, those displayed figures should not be presented as unquestionably current for a later purchase. Use them only to understand what an older invoice or explanation may be referring to. Before claiming that a seller used the wrong percentage, obtain the amended apparel notification applicable to your transaction date and match the garment to its exact entry.
Questions to ask when checking the rate
- What is the product’s tariff or classification description?
- Is the item sold singly, as a set, or bundled with another product?
- What is the taxable transaction value for that item?
- Which rate notification and effective date did the seller rely on?
- Was an advance received before a rate change, and how did the seller apply time-of-supply rules?
- Does the invoice show CGST and SGST or IGST consistently with the place of supply?
If you cannot answer those questions from the invoice and the operative notification, describe the issue as a request for verification rather than as a proven overcharge.
MRP and GST are two different disputes
The GST Council FAQ answers the question “Should a customer pay extra GST on Maximum Retail Price (MRP) affixed on goods?” with “No. MRP is inclusive of GST and is the maximum retail price that can be charged from the consumers.” In practical terms, compare the final amount demanded with the marked MRP. A seller should not add a separate GST amount on top of an affixed MRP to charge more than that maximum. Charging above MRP can attract Legal Metrology Act provisions.

This rule does not automatically prove that the GST percentage printed inside an invoice is wrong. A seller could show a different tax breakdown while still charging no more than the MRP, or could charge above MRP without using the correct tax classification. State which problem occurred: an incorrect tax calculation, an amount above MRP, or both.
Step 4: Ask the seller for a written correction
Use email, the seller’s support portal or a message channel that preserves a copy. Keep the tone factual and give a reasonable opportunity to respond. Ask for the classification and calculation, not just a refund with no explanation.

Subject: Request to verify GST rate and issue corrected invoice – Order [order number]
I purchased [item description] under order/invoice [number] on [date]. The invoice shows taxable value ₹[amount], GST rate [rate] and GST ₹[amount]. The amount charged to my payment method was ₹[total], and the marked MRP is ₹[MRP], if applicable.
Please confirm:
1. the classification and rate entry used;
2. the notification and effective date relied on;
3. how the taxable value and GST were calculated; and
4. whether a corrected invoice and refund or credit will be issued if the charge is incorrect.
Please reply in writing and attach the corrected document, if applicable.
Attach a copy of the invoice and relevant order evidence, but redact unnecessary card numbers, passwords and identity information. Preserve the seller’s response, including a refusal or a claim that the tax is “mandatory” without showing the calculation.

Step 5: Escalate through the National Consumer Helpline
If the seller does not respond or will not correct an apparent error, the National Consumer Helpline (NCH) is the practical first escalation route. Its published contacts are:
- Telephone: 1915 or 1800 11 4000.
- Hours: 08:00–20:00 daily, except national holidays.
- WhatsApp: 8800001915.
- Other channels: the official NCH online portal, SMS, the NCH app and UMANG.
Department of Consumer Affairs material also describes a dedicated GST category on the INGRAM portal following the 2025 rate changes. Select the GST-related category where available so the complaint is routed with the right subject rather than being described only as a general pricing grievance.
Information to include in the complaint
- Your name and a contact method.
- Seller’s legal or trading name, address, website or store location shown on the invoice.
- Order and invoice numbers, purchase and supply dates, and payment method.
- Item description, classification information supplied by the seller, taxable value, stated rate and tax amount.
- Marked MRP and the final amount actually charged, if an MRP is affixed.
- A chronological summary of your written request and the seller’s reply.
- Copies of the invoice, listing, payment proof, MRP photograph and correspondence.
- The outcome you seek: corrected invoice, refund of excess amount, reversal of an amount charged above MRP, or an explanation.
Keep the complaint focused on verifiable facts. The helpline can record and route a grievance, but it does not replace a formal adjudication where the classification or notification is genuinely disputed.
Common situations and the appropriate response
| What happened | What to do |
|---|---|
| The invoice rate and tax amount do not multiply correctly. | Point out the arithmetic, request a corrected invoice and refund of the difference, and attach your calculation. |
| The seller cites the old ₹1,000 apparel threshold. | Ask which notification was operative for the supply date; do not assume the old 5%/12% split remains current after 22 September 2025. |
| The final price exceeds the affixed MRP because GST was added at checkout. | Compare the complete amount charged with the MRP, request reversal of the excess and identify the Legal Metrology concern. |
| An advance was paid before a rate change and delivery occurred later. | Provide all payment and supply dates and ask the seller to explain its time-of-supply treatment. |
| The seller gives only a verbal explanation. | Send a written recap and request the classification, notification, taxable value and corrected document in writing. |
| The seller refuses to engage. | File with NCH using the invoice, timeline, payment proof and copies of your unanswered request. |
Do not confuse a rate error with anti-profiteering
GST Council FAQ material on anti-profiteering addresses a different situation: a business fails to pass on a tax-rate reduction or input-tax-credit benefit through a commensurate price reduction. That concept should not automatically be applied to every invoice where a buyer believes the wrong rate was used. First describe the actual invoice, dates, classification and amount charged so the complaint can be routed appropriately.
A printable checklist
- Save the invoice, order record, payment proof, product description and MRP image.
- Record order, advance, invoice, delivery and balance-payment dates.
- Separate taxable value, rate, tax amount and final amount.
- Identify the garment classification and ask for the notification used.
- Check the operative rate for the transaction date rather than relying on an old threshold.
- Compare the final amount with MRP independently of the tax-line dispute.
- Request a corrected invoice and refund in writing.
- If unresolved, contact NCH at 1915 or 1800 11 4000, or use its listed digital channels.
A definitive finding requires the garment details, invoice, transaction chronology and operative rate notification. The safest path is therefore evidence first, written clarification second and consumer-helpline escalation when the seller will not provide a credible correction.
