Stop, protect people from immediate danger, and call 911 for injuries, fire, blocked lanes, or any other emergency. In a construction zone, follow police, incident responders, flaggers, and other work-zone personnel before moving, photographing, or exchanging information. Move a vehicle only when it is safe, the vehicle can be driven safely, and responders do not direct you otherwise. Reporting deadlines and thresholds depend on the state where the crash occurred.
1. Stop and assess the immediate danger
Bring the vehicle to a stop without creating a second collision. Turn on hazard lights if they work, keep your seat belt fastened, and take a moment to identify the most urgent threat: an injured person, fire, leaking fuel, live traffic, unstable equipment, or a vehicle stopped in a travel lane.

Call 911 when anyone may be injured or when the scene presents an emergency. Give the dispatcher the road or route, direction of travel, nearest exit or intersection, and any visible construction-zone marker. Describe blocked lanes, fire, smoke, spilled fluids, damaged barriers, or people in danger if you can do so without leaving a safe position.

Follow the people controlling the scene
A road work zone is an active traffic environment, not an ordinary roadside. It can contain workers, flaggers, temporary lane shifts, heavy equipment, incident-response vehicles, and traffic moving at high speed. Police officers, fire crews, transportation-agency responders, flaggers, and authorized work-zone personnel may give directions about where to stop, when to move, and where to stand. Follow those directions even if they differ from what you expected.
Do not walk across a live lane, climb over barriers, stand between vehicles, or approach construction equipment to get a better view. Never try to direct traffic yourself. If a responder tells you to remain in the vehicle or move to a particular protected area, comply unless doing so creates an immediate danger.
2. Get yourself and others out of the next hazard
If there is fire, smoke, a risk of another collision, or another immediate threat, move to the safest available location as directed by emergency personnel. Keep away from fuel leaks, downed wires, unstable vehicles, excavations, machinery, and the active roadway.
Do not leave a safe position merely to place a warning device. Oregon DMV emergency guidance discusses warning approaching traffic with flares or reflectors, but deployment is worthwhile only when it can be done without entering a live lane or exposing you to traffic. Whether a particular device is permitted or required depends on local rules and the instructions at the scene.

When you are able to remain in the vehicle
If the vehicle is in a reasonably protected position and no responder directs you out, staying inside with the doors locked and your seat belt on may reduce exposure to passing traffic. Keep watching for instructions. A vehicle that appears protected can become vulnerable when traffic patterns change or a lane is reopened.
3. Decide whether the vehicle should be moved
The answer to “Should I move my car after a crash?” is conditional: move it only when doing so is safe, the vehicle is controllable, and an officer or responder has not told you to leave it where it is.
- Check for danger. Look for injuries, fire, leaking fluids, damaged wheels, hanging parts, a deployed airbag blocking your view, or a position that would require crossing live traffic.
- Check whether it can be driven safely. Do not drive with severe steering or braking problems, a flat or detached wheel, major fluid loss, smoke, a shattered windshield that prevents visibility, or structural damage that makes the vehicle unstable.
- Wait for direction at a controlled scene. A police officer, flagger, or incident responder may need the vehicles left in place for safety or documentation.
- If movement is safe and authorized, move out of the travel lane. Use the nearest safe shoulder, refuge area, or location identified by responders. Avoid stopping where construction equipment, pedestrians, or a lane shift will put you at additional risk.
- If the vehicle is unsafe or disabled, stop trying to move it. Tell 911 or the responding agency that the vehicle cannot be safely driven and wait for instructions or a tow.
Oregon DMV guidance says that when there are no injuries and vehicles can be moved safely, drivers should move them out of travel lanes as soon as possible. California’s Department of Insurance gives the same safety-first principle in its consumer guide: “STOP Immediately and move only if it is safe to do so.” Neither statement authorizes driving a damaged vehicle or overriding an officer’s direction.

Oregon DMV states: “Injured people should never be moved carelessly.” Do not pull someone from a vehicle, make them walk, or reposition them simply to take photographs or clear traffic. Moving an injured person may worsen a spinal or internal injury.
When moving someone may be unavoidable
Oregon guidance identifies danger from fire or another collision as exceptions to the general rule. If an immediate threat makes the current location more dangerous than moving, tell the dispatcher what you see and follow real-time instructions. Do not attempt a complicated rescue when trained responders can reach the scene without delay.
5. Exchange information only from a safe position
Once the scene is controlled and no one needs urgent care, exchange the information needed for an insurance claim and any required report. If the other driver is aggressive, appears impaired, or tries to leave, do not confront or chase them. Tell police what happened and provide the vehicle description and direction of travel if you can do so safely.
Information to collect
- Each driver’s full name and contact information.
- Driver’s-license number and issuing state, when practical and safe to record.
- Vehicle make, model, year, color, and license-plate number.
- Vehicle-registration information if available.
- Insurance company and policy information.
- Names and contact details for passengers.
- Names and contact details for witnesses, including people who saw the traffic control or the moments immediately before impact.
- The responding agency, officer name or badge number, and incident or report number if provided.
Do not argue about fault or sign a statement that you do not understand. Give an accurate account to police and your insurer, but avoid guessing about speed, distance, or another driver’s medical condition.

6. Photograph the scene without entering danger
Photos can preserve details that change when vehicles are moved or crews reopen a lane. Take them only from a protected location or when a responder says it is safe. Never step into a live lane, walk around a blind curve, cross a temporary barrier, or delay emergency work to obtain an image.
Useful subjects to document
- Damage to every involved vehicle, including close-ups and wider views showing vehicle position.
- Lane markings, cones, drums, barricades, arrows, temporary signs, and flagger locations.
- Debris, fluid spills, tire marks, potholes, uneven pavement, or a sudden lane shift.
- Visual obstructions such as equipment, barriers, darkness, glare, or blocked signs.
- The nearest exit, intersection, mile marker, route marker, or work-zone identification sign.
- Weather and lighting conditions, if they are relevant and can be recorded safely.
Record the time and a short factual description while details are fresh. Preserve original files rather than editing them. Do not post photographs or personal information publicly while the crash is being investigated.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Arrange towing or roadside help for an unsafe vehicle
If the vehicle cannot continue, tell the responding agency where it is and ask what pickup location is safe. A tow truck may need to enter or exit through a temporary lane pattern, so do not direct the operator yourself unless responders have cleared the route.
When comparing available towing or roadside options, check:

- Where the vehicle will be taken and whether that destination is acceptable.
- The estimated price, mileage charges, storage fees, and payment terms.
- Whether your auto insurer, roadside plan, or vehicle warranty includes towing.
- How passengers will travel safely after the tow.
Do not get back into a vehicle that has smoke, a fuel leak, unstable damage, or a compromised passenger compartment merely to retrieve belongings. Ask responders or the tow operator when it is safe.
8. Notify your insurer promptly
Contact your insurer as soon as practical after emergency needs are addressed. Provide the date, time, location, vehicles involved, injuries reported, responding agency, and any report number. Ask what photographs, estimates, medical records, receipts, and forms it needs.
Keep copies of the exchange information, tow and storage invoices, medical paperwork, and correspondence. A police report and an insurance claim serve different purposes: the report documents the agency’s response, while the insurer evaluates coverage and claim handling under the policy. Do not promise payment, accept blame, or agree to a settlement at the roadside.
9. Check the reporting deadline where the crash happened
There is no single nationwide reporting threshold or deadline. The state and locality where the collision occurred control the required form, deadline, damage threshold, and whether a police response satisfies any part of the obligation. Check the official state DMV and local police or highway-patrol instructions promptly.
| Jurisdiction and source | Reported requirement | Important limitation |
|---|---|---|
| Oregon DMV, collision-reporting guidance | A driver must file a DMV collision report within 72 hours when listed conditions apply, including an injury or death, more than $2,500 damage to the driver’s vehicle, more than $2,500 damage to another vehicle when any vehicle is towed, or more than $2,500 damage to non-vehicle property. | Oregon DMV says the driver’s filing remains required even if law enforcement filed a report. Confirm the current form and instructions with Oregon DMV. |
| California Department of Insurance consumer guide, revised December 2024 | The guide says California drivers must report to DMV within 10 days when someone is injured or damage exceeds $750. | This is a California-specific statement from that guide, not a nationwide rule. Confirm current California DMV instructions and any local police requirement. |
These examples show why a driver should not rely on another state’s deadline. If you are unsure whether a threshold has been met, ask the relevant DMV or law-enforcement agency rather than waiting for an estimate.
10. What not to do after a work-zone crash
- Do not leave the scene simply because the vehicle appears drivable or the damage looks minor.
- Do not walk through active lanes, equipment areas, or temporary openings to gather evidence.
- Do not move an injured person unless an immediate danger requires it or a dispatcher directs you.
- Do not drive a vehicle with unsafe steering, braking, visibility, wheel, fluid, or structural damage.
- Do not place flares, reflectors, or other warnings if reaching the deployment point requires entering danger.
- Do not admit fault, speculate about injuries, or negotiate compensation at the scene.
- Do not delete photographs, messages, dash-camera files, or receipts related to the crash.
11. Why construction-zone crashes require extra caution
Work zones include more than active building projects. Oregon Department of Transportation describes them as areas involving construction, maintenance, traffic incidents, towing, traffic control, and cleanup. Workers and responders may be close to fast-moving traffic, with lanes narrowed or shifted and normal sightlines changed.
Oregon reported 621 work-zone crashes in 2024, including 14 deaths and 36 serious injuries, according to an Oregon DOT page dated April 20, 2026. The agency states that all deaths and serious injuries in those reported crashes were drivers or passengers. These figures describe Oregon, not the nation, but they illustrate why leaving a protected position or crossing a temporary lane can create a second emergency.
