Choose a data-center energy provider only after you establish the facility’s location, electricity-market rules, forecast load, reliability target, and certificate-claim requirements. The right arrangement may be a regulated utility tariff, competitive supply contract, green tariff, on-site project, physical power purchase agreement (PPA), virtual PPA, or separate renewable-energy certificate purchase. These options do not provide the same physical electricity, price exposure, or environmental claim.
Use a site-specific comparison: match each offer’s capacity, energy volume, delivery schedule, balancing and backup responsibilities, rate structure, contract term, interconnection work, and ownership of renewable-energy certificates (RECs) or other energy attribute certificates (EACs). U.S. market rules and commercial availability vary by jurisdiction, so an offer that works in one service territory may not be available at another site.

How do I choose an energy provider for a data center?
Start with the facility’s electricity market and then work outward to load, reliability, cost, contract flexibility, resource mix, and execution risk. A vertically integrated utility may control generation, transmission, and retail supply. In a retail-choice market, a competitive supplier may sell the electricity commodity while the local distribution utility continues to deliver power and maintain the wires. Eligibility, tariffs, community-choice programs, and rules for third-party sales are location-specific.
Confirm the market structure and eligible buyers
- Identify the serving utility, balancing area, transmission operator, and state or local regulator.
- Determine whether the site can choose a competitive supplier or must buy under the utility’s tariff.
- Check whether a green tariff, community-choice aggregation, community solar subscription, or utility green-pricing program is offered to this customer class.
- Verify whether a third party may sell electricity directly at the site; some markets prohibit or restrict those arrangements.
- List permits, credit requirements, metering rules, and interconnection studies that could prevent an otherwise attractive offer from being used.
The U.S. Department of Energy’s Federal Energy Management Program (FEMP) describes these procurement paths and their market limitations in its overview of federal options: Evaluating Electricity Procurement Options for Federal Agencies.

Build a load forecast before requesting prices
Give bidders a forecast for the full contract period, not just today’s utility bill. Include hourly or interval consumption where available, seasonal peaks, power factor, expected equipment additions, phased occupancy, and the date each expansion is expected to energize. Separate three quantities that contracts often treat differently:
- Peak demand: the highest instantaneous or interval demand that drives capacity, delivery, or demand charges.
- Energy consumption: the megawatt-hours (MWh) actually used over time.
- Contracted capacity or volume: the amount reserved, hedged, or made available under the agreement.
A PPA can specify potential peak-demand capacity without requiring the customer to consume all of it. The U.S. Energy Information Administration (EIA) explains this distinction in its market discussion: Data center owners turn to nuclear as potential electricity source. Treat growth assumptions as scenarios—base, accelerated, and delayed—so the contract can address under-use and expansion without forcing an unmanageable liability.
What should a data center look for in an electricity contract?
Use the following axes to compare offers. Require every bidder to state assumptions and pass-through items in the same format; a lower headline energy rate is not comparable when it carries different balancing, capacity, transmission, or certificate obligations.
| Area | Questions to answer | Evidence to request |
|---|---|---|
| Availability and market fit | Is the offer legal and available at this meter and customer class? | Service-territory confirmation, tariff eligibility, regulatory conditions, and program rules |
| Capacity and reliability | What peak demand and energy volume are covered, and who balances deviations? | Firm-supply definition, capacity rights, balancing-area rules, outage procedures, and backup interfaces |
| Cost and risk | What is fixed, indexed, escalated, or passed through? | Complete rate schedule, capacity and transmission charges, fees, credit terms, taxes, and settlement examples |
| Term and flexibility | Can delivery start, scale, or end as the project changes? | Start date, renewal, volume bands, expansion rights, termination charges, and under-delivery treatment |
| Energy and claims | What generates the power, and who owns and retires its certificates? | Generator identity, geography, delivery or settlement method, REC/EAC title, retirement records, and claim language |
| Delivery and execution | What grid work and on-site equipment are required? | Interconnection studies, schedule, permits, construction scope, operating standards, and maintenance responsibility |
| Contracting responsibility | Who actually buys electricity and controls the resource mix? | Corporate, colocation, landlord, and customer obligations written into the service agreement |
Which procurement arrangements are available?
Utility supply, green pricing, and green tariffs
A standard utility tariff is often the default in a vertically integrated territory. Utility green-pricing programs may let a customer pay for renewable attributes or support renewable generation through a utility-administered offering. A utility green tariff can bundle electricity and EACs under a longer agreement. DOE FEMP lists a typical green-tariff term of 10–20 years; that is a range in the cited federal overview, not a universal requirement. Confirm the tariff’s energy rate, adjustment formula, resource eligibility, and whether certificates are transferred or merely used for the program’s aggregate claim.

Competitive suppliers and community programs
Where retail choice exists, a competitive supplier generally provides the commodity while the distribution utility remains responsible for transmission and distribution. DOE FEMP’s federal procurement overview lists 2–5 years as a typical competitive-supplier contract range, although actual offerings vary. Ask who handles load forecasting, imbalance charges, capacity obligations, renewable-content changes, and utility billing disputes.
Community-choice aggregation, community solar, and unbundled REC purchases can add renewable attributes without changing the physical source serving the data center. They may be useful for a portion of the portfolio, but they should not be described as firm physical supply unless the contract actually provides it.
On-site or third-party generation
An on-site solar, fuel, storage, or other generation project can provide a known long-term price while leaving equipment operations and maintenance with the project owner under a third-party contract. DOE describes this model in Federal Off-Site Energy Procurement Options and Federal On-Site Electricity Contracts. Confirm whether the market allows third-party electricity sales, who owns the equipment, who carries performance and outage risk, how excess generation is settled, and what happens when the site load is below the project’s output.

Physical versus virtual PPAs
| Feature | Physical PPA | Virtual PPA |
|---|---|---|
| Electricity delivery | Power from a named generator is delivered through the grid to the buyer’s load or nominated settlement point. | The buyer does not take delivery of the project’s electricity; the agreement is financially settled. |
| Commercial terms | Typically covers commercial operation, delivery schedule, payment, under-delivery penalties, and termination. | Sets a financial contract-for-differences or similar settlement against a market price, plus certificate treatment. |
| Operational purpose | Can be part of a physical supply strategy, subject to local delivery and balancing rules. | Acts primarily as a price hedge and renewable-project financing tool; the facility still buys physical power separately. |
| Key diligence | Confirm scheduling, transmission, congestion, balancing, and REC title. | Model basis risk, settlement-point mismatch, market-price volatility, credit support, and REC retirement. |
The U.S. Environmental Protection Agency explains these distinctions in Customer Power Purchase Agreements. Never treat a virtual PPA as a promise that electrons from the project will power the data center.

How can a data center get reliable renewable power?
Define reliability as an operating requirement
“Renewable” and “firm” describe different attributes. Specify the maximum interruption tolerance, required ride-through, restoration target, voltage and power-quality limits, maintenance windows, and responsibility for emergency generation, batteries, and fuel. Then ask the provider how it maintains supply when wind or solar output is low. A portfolio may combine renewables with storage, firm utility capacity, demand management, or other dispatchable resources.
DOE notes that data-center demand is growing rapidly and varies by region. It identifies solar, land-based wind, battery storage, and efficiency as scalable near-term options, while emphasizing the need for clean firm resources. As the agency states: “Given data centers’ need for clean firm power, scaling other energy technologies, such as next-generation geothermal and nuclear, will also be critically important to meet data center electricity demand.” See Clean Energy Resources to Meet Data Center Electricity Demand. This is a portfolio consideration, not a universal recommendation for one technology or supplier.
Check interconnection feasibility early
For a new campus, expansion, on-site generator, or storage system, request an interconnection screen before signing a supply commitment. Identify the utility study process, available feeder and substation capacity, required network upgrades, protection equipment, construction lead times, outage coordination, and the party paying for each item. Tie the commercial start date to achievable energization milestones rather than an optimistic target date.

Reserve enough capacity for the forecast peak and credible expansion, but avoid paying for capacity that cannot be used or released. Include staged increases, reduction rights, and a process for reconciling forecast and actual load. The EIA’s 2024 examples illustrate why scale and structure must be read together: it reported a 20-year agreement announced to supply Microsoft data centers from Three Mile Island Unit 1, and an AWS agreement with Talen covering up to 960 MW from Susquehanna, with staged increases and an option to cap the commitment at 480 MW. These are dated transactions, not estimates of typical data-center demand, price, or savings.

How do RECs and EACs affect a data center’s renewable claim?
A REC or EAC represents the environmental attributes of one megawatt-hour of renewable generation. Ownership matters: the party that makes a renewable-use claim generally must hold and retire the applicable certificates, and the same certificate cannot support two buyers’ claims. DOE FEMP describes the one-MWh unit and certificate options in Federal Off-Site Energy Procurement Options.
Put certificate rights in the contract
- Name the generating facility or eligible technology and its geographic relationship to the load.
- State whether certificates transfer with delivered electricity or are purchased separately.
- Identify the registry, retirement account, retirement timing, and evidence the buyer will receive.
- Specify who bears the risk if certificates become unavailable, ineligible, double-counted, or changed by regulation.
- Align the contract language with the intended public claim—facility-specific, market-based, technology-specific, or portfolio-level.
A virtual settlement can be financially successful while failing to provide the certificate ownership needed for a particular claim. Ask for the claim wording before approving the procurement structure.
Who buys power in a colocation or cloud facility?
In a colocation arrangement, the landlord or operator may hold the utility account while the server customer pays through a service charge. In another structure, the customer may contract directly for supply or certificates. The service agreement should identify the purchasing party, meter and load boundaries, resource mix, certificate ownership and retirement, pass-through charges, outage obligations, and what information the operator will provide for emissions reporting.
ENERGY STAR states: “In this case, in order to make use of green power, both parties must have a clear understanding through the data center contract as to who is responsible for buying the power and what resources the power will come from (e.g., renewable energy).” Its guidance is available at Renewable Energy.

How should a data center manage price and contract risk?
Request a complete cost schedule
Require an all-in model that separates energy, capacity, transmission, distribution, ancillary services, balancing, taxes, renewable certificates, implementation, metering, and credit costs. Show which items are fixed, indexed to a published market, escalated annually, or passed through without a cap. Ask bidders to price the same load shapes and to provide settlement examples for low-load, forecast-load, and high-load cases.
Negotiate flexibility, not just a rate
Document the delivery start, construction dependencies, scale-up schedule, minimum and maximum volumes, renewal rights, assignment, change-in-law treatment, force majeure, credit support, and termination charges. Define under-delivery and curtailment remedies, including replacement power, liquidated damages, certificate shortfall remedies, and notice periods. A long term can stabilize planning but increase exposure to inaccurate growth forecasts; a short term may preserve flexibility while leaving the site exposed to market volatility.
Allocate operational responsibilities
State who schedules energy, maintains on-site assets, responds to outages, performs compliance reporting, and communicates with the utility and balancing authority. Require service-level reporting and audit rights so actual consumption, renewable attributes, and outages can be verified against the contract.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsData-center energy-provider RFP checklist
- Document the site address, serving utility, market structure, meter configuration, and customer eligibility.
- Provide interval load history and base, accelerated, and delayed growth forecasts, including peak demand and MWh.
- Define reliability, resilience, power-quality, backup, and restoration requirements.
- Ask for firm-supply terms, balancing responsibility, capacity rights, outage procedures, and curtailment rules.
- Require an itemized rate and risk schedule covering energy, capacity, transmission, pass-throughs, escalation, fees, taxes, and credit.
- Specify contract term, start date, expansion and reduction rights, minimum volumes, termination, and under-delivery remedies.
- Describe the proposed resource mix and distinguish physical delivery from financial settlement.
- Require interconnection studies, grid-upgrade scope, permits, schedule, and on-site ownership and maintenance responsibilities.
- State who owns and retires RECs or EACs, which registry is used, and what claims the certificates support.
- For colocation or cloud contracts, name the party responsible for buying electricity and controlling the resource mix.
- Compare only offers legally available to this site and test each against the same load and operating assumptions.
A defensible selection is the arrangement whose physical supply, reliability, price exposure, flexibility, interconnection plan, and renewable claims match the facility’s documented needs—not the offer with the lowest unqualified energy-rate headline.
