Before signing, identify exactly what will be captured or built, every use you are authorizing, how long and where it can be used, whether it can be transferred, how reuse is paid, and what controls protect you from unwanted or harmful depictions. Ask for vague or unlimited language to be narrowed in writing.
A release can cover a scan, voice recording, facial or body model, performance data, edited footage, or a replica generated from earlier recordings. The document’s definitions and grants control, not its title. If you belong to a union or work under a collective bargaining agreement, have your union or professional representative review it before you agree.

Start by mapping what the company will capture and create
Read the definitions section before reading the promises. A contract may use terms such as digital replica, synthetic performance, likeness, voice model, or performance data differently. SAG-AFTRA describes a digital replica as a replica of a person’s voice and/or likeness created with digital technology, including artificial intelligence. That description is useful context, but the release you receive may define the term more broadly or narrowly.

List each source asset
Make an inventory of everything the company will receive or generate. Mark each item separately rather than assuming one consent covers all of them.

- Photographs, video, motion-capture data, scans, measurements, or facial and body geometry.
- Voice recordings, transcripts, pronunciation data, emotional or performance directions, and isolated vocal tracks.
- Edited footage, outtakes, rehearsal material, scripts, gestures, mannerisms, or other performance data.
- A model, embedding, dataset, or other technical representation derived from your recordings.
- Outputs generated from the model, including altered scenes, new dialogue, advertising copy, or translated performances.
Then identify who owns or controls each item after delivery. A clause granting a license to a recording is not automatically a grant to train a model from it, and permission to make a scan does not by itself explain how the resulting model may be used.
Separate the permission stages
Look for distinct language covering each stage. A clear agreement should let you tell whether you are consenting to:

Do not rely on a heading such as AI consent. Read every operative verb and definition. A release can authorize capture while leaving use subject to another clause, schedule, or collective agreement.

For each proposed use, write down the project, medium, platform, purpose, territory, audience, and whether the use is commercial. If a detail is missing, the company may later argue that a broad grant fills the gap.
Use a scope worksheet
- Project: Name the production, campaign, game, episode, or other identified work.
- Medium and platform: Specify theatrical, television, streaming, social media, games, virtual reality, live events, internal training, or other channels.
- Purpose: Distinguish storytelling from advertising, endorsements, merchandising, publicity, political messaging, or product demonstrations.
- Audience: Note whether the content is public, age-restricted, internal, or directed to a defined market.
- Territory: State the countries or regions, and whether online distribution makes the grant worldwide.
- Versions: Address dubbing, translation, edits, trailers, short-form clips, and localization.
Watch for phrases such as all media now known or later developed, any purpose, in perpetuity, or including without limitation. Such wording may authorize unrelated productions, advertising, endorsements, or technologies that were never discussed. Ask the other party to explain each broad phrase and replace it with a defined list or an approval mechanism.

Check prominence and signing mechanics
In SAG-AFTRA’s covered television and theatrical guidance, consent for a digital replica must be clear and conspicuous, describe the intended use, identify the specific medium, and be separately signed or initialed. Those requirements arise from particular union agreements; they are not a universal rule for every contract or jurisdiction. Even outside those agreements, a separate, prominent consent page makes it easier to prove what you actually accepted.
Ask what happens when the use changes
A release should say whether the first approval covers later projects or materially different contexts. Ask these questions in writing:
- Can the same replica appear in a different production, campaign, game, or client project?
- Can the company change a dramatic performance into an advertisement or endorsement?
- Can it generate new dialogue, actions, languages, or scenes that were not recorded?
- Does a sequel, remake, spin-off, trailer, or interactive version count as the same project?
- Will you be contacted for fresh approval before each new use?
For covered SAG-AFTRA television and theatrical work, the union materials state that a different project or a materially different use requires renewed consent, and the applicable agreement provides payment rules. A background-actor FAQ describes renewed consent and payment for different uses under its relevant contract. Those protections should not be generalized to a nonunion release; if they matter to you, put an equivalent obligation directly in the document.
Separate every payment trigger
Do not assume the fee for a recording or scan pays for all future exploitation. Ask the contract to identify whether compensation is due for:
- The initial capture, session, or performance.
- Creating, training, or maintaining the model.
- Each production or period in which the replica is used.
- New media, territories, languages, campaigns, or clients.
- Reuse, extensions, renewals, sequels, and substantial edits.
- Sublicensing or assignment to another company.
Check for residuals, minimums, repeat-use fees, and deadlines for payment. A clause that says payment is inclusive of all rights can erase later compensation unless an attachment creates specific exceptions. Union agreements may establish minimum compensation and additional payments, but the cited materials do not establish a single rate for all performers, jurisdictions, or releases. Never infer a market price from the existence of a union minimum.

Connect payment to approval
Ask whether payment is owed when the replica is generated, when content is released, when it is viewed, or when a licensee pays the company. If payment depends on a third party, require the company to remain responsible for accounting and payment. Clarify whether a project that is produced but never released still triggers the agreed capture or model fee.
Read the term, territory, and exit provisions together
A short term can become indefinite if the company may renew automatically, retain copies after termination, or transfer the model to a successor. Mark each of these items:
- Initial term and renewals: Identify the end date, renewal notice, and any new fee.
- Termination: Ask whether you can end consent for breach, nonpayment, harmful use, or a material change in the project.
- Revocation: Determine whether stopping future generation is possible and what exceptions apply to already released content.
- Transfer: Check assignment to affiliates, buyers, successors, distributors, vendors, and licensees.
- Post-term handling: Specify whether scans, recordings, models, backups, and derived datasets must be returned or deleted.
- Geography: Distinguish a defined territory from worldwide online access, and address regional restrictions where relevant.
Ask what happens if the company is sold, closes, or stops operating. The U.S. Copyright Office’s 2024 report discusses policy and legal approaches to digital replicas, including post-mortem concerns, but it does not create one rule that governs every release. Your practical protection is the language you obtain and the law applicable to your contract.
Build safeguards against harmful or misleading outputs
A technically valid model can still create economic, emotional, or reputational harm. Request explicit limits rather than relying on a general promise to act responsibly.
Uses that deserve express treatment
- False or misleading endorsements, testimonials, or brand associations.
- Political advertising, fundraising, or advocacy.
- Sexualized, violent, hateful, defamatory, or illegal depictions.
- Statements or conduct that could damage your reputation or professional relationships.
- Medical, financial, legal, or other sensitive claims presented as if you made them.
- Impersonation of private communications, news, or emergency messages.
Ask who decides whether a proposed output falls within the approved use and whether you receive notice before release. If synthetic content will be labeled, specify the form, placement, duration, and whether the label survives edits and reposting. The Federal Trade Commission’s 2024 discussion of voice-cloning harms and authenticity approaches provides policy context, not a substitute for contract safeguards.

Security and access controls
The agreement should identify the people and vendors permitted to access source files and models, require reasonable security measures, and prohibit employees or contractors from using the material for unrelated experiments. Seek records of access, incident-notification deadlines, and a process for investigating a suspected leak. Specify retention periods and deletion of production copies, backups, and derived files when the term ends or consent is withdrawn.
Reserve approval, correction, and remedy rights
Approval language should describe what you can review and when. Decide whether you approve a script, a generated performance, a final edit, or only uses outside the original description. A right to object is weak if the company can ignore it without consequence, so ask what happens after a rejection.
- Require a reasonable review window before public release.
- Define objective reasons for withholding approval, such as an unapproved purpose or harmful depiction.
- Provide a correction or takedown process for an unauthorized output.
- State who pays for removal, re-editing, or replacement after a breach.
- Preserve your ability to seek contractual damages or other remedies where permitted by law.
Do not promise that every copy can be erased from the internet. Instead, require the company to stop generating new copies, delete controlled files, notify licensees, and use commercially reasonable efforts to remove material it controls.

If your work is covered by a collective bargaining agreement, read the current agreement and contact the union before signing a release or voucher. SAG-AFTRA identifies digital-replica provisions as a mandatory subject of bargaining and states that conflicting voucher language may not validly obtain consent under its agreement. The union also advises performers to understand their image and voice rights and speak with professional representatives.

Coverage depends on the work, employer, jurisdiction, and agreement in force. A union rule is not automatically a protection for a nonunion job, and a production’s claim that a release is standard does not override a governing collective agreement. Give your representative the complete contract, schedules, side letters, and any technical brief describing the capture.
Compare a proposed revision with a narrow alternative
When negotiating, compare the actual text rather than labels such as limited or perpetual. This framework highlights the trade-offs without assuming that every contract offers each option.

If the company rejects a narrower term, ask it to explain the operational need and offer a payment or approval mechanism that addresses the added risk.
A practical review process before you sign
- Collect the complete package. Obtain the release, rider, rate sheet, technical brief, privacy notice, collective agreement, and any referenced policies. Do not review a page in isolation.
- Highlight definitions. Mark every term covering your voice, likeness, performance, recordings, scans, models, outputs, affiliates, successors, and future technologies.
- Create a permission matrix. For capture, creation, training, storage, distribution, and use, write who may act, for which project, in which media, for what purpose, and for how long.
- Trace reuse. Locate the clause governing a different project, new campaign, sequel, translation, interactive version, or materially changed performance. Confirm whether fresh consent and payment are required.
- Calculate payment triggers. List every initial fee, reuse fee, residual, minimum, renewal payment, and sublicense accounting obligation. Identify the payer and due date.
- Test the exit path. Follow termination, revocation, deletion, backup, assignment, sale, and closure provisions to see what remains after the relationship ends.
- Add safeguards. Put sensitive-use restrictions, labeling, access controls, incident notice, approval, correction, and takedown procedures in the agreement itself.
- Get changes in the signed document. An email or verbal assurance may not amend an integrated contract. Initial or separately sign material consent language where appropriate and keep a final copy.
- Obtain professional review. Use a qualified lawyer for jurisdiction-specific advice and contact your union or representative when a collective agreement may apply.
Red flags that justify pausing
- The release never defines what is captured, modeled, or generated.
- One sentence grants every medium, purpose, territory, and future technology forever.
- Payment is described only as a single fee with no reuse, renewal, or sublicense terms.
- The company can transfer the model but does not bind recipients to the same limits.
- There is no deletion, security, incident, or access language.
- You cannot object to political, sexualized, defamatory, or misleading uses.
- Consent appears only in a voucher or buried paragraph despite a governing collective agreement.
- The company refuses to identify the project, medium, or audience while asking for irrevocable permission.
Pause and request written clarification when any of these appears. If the other party will not explain or narrow the grant, understand that you are being asked to accept the uncertainty as part of the deal.
What the law does and does not settle
Rights in a digital replica can involve contract, publicity, privacy, copyright, labor agreements, consumer protection, and other laws. Rules differ by jurisdiction and by the type of work. The cited SAG-AFTRA requirements apply to covered agreements; the FTC material addresses voice-cloning harms and authenticity; and the U.S. Copyright Office report surveys legal and policy approaches rather than setting a universal release rule.
No general source establishes a single payment rate, a universal right to revoke consent, or an automatic deletion requirement for every signer. A qualified lawyer or your union representative can assess the governing law, bargaining coverage, and the exact language you received. Until that review is complete, treat an undefined or perpetual grant as a material business and reputational decision, not an administrative formality.
