The safest approach is to treat the purchase as two separate decisions: first, whether the software license gives you the rights you need; second, whether this seller’s distribution or service is worth its price. The checklist below helps you answer both without assuming that a marketing label proves anything.

Is open-source software supposed to be free?
“Free” has two different meanings in software. It can mean free of charge, or it can describe freedom to use, study, modify, and share software under its license. Open-source licensing addresses the second meaning. The Open Source Initiative (OSI) FAQ, last modified January 21, 2025, says: “All Open Source software can be used for commercial purpose; the Open Source Definition guarantees this.” That commercial-use right does not prohibit a distributor from charging for a particular copy, packaging, installation, hosting, support, warranty, customization, maintenance, or other service.

In practical terms, a license cannot turn ordinary commercial use into a royalty that applies merely because you run the software for business. A seller can still charge for labor, infrastructure, convenience, or additional components. Your first task is therefore to distinguish a price for services or a particular distribution from a claim that you must pay to exercise rights the license already grants.

1. Record exactly what you are being offered
Do not evaluate a vague listing that says only “open-source app.” Save the product name, publisher, version number, platform, seller name, listing URL, and date you checked it. A project may publish several branches or editions with different licenses, bundled components, or support policies. The version in a store listing may not be the same build available from the project’s repository or website.
- Exact application and edition: record the release name, build number, operating system, architecture, and whether the listing is for a desktop app, mobile app, server package, hosted service, or plugin.
- Seller identity: note the legal or trading name shown at checkout, the payment recipient, and any stated relationship with the project.
- Included items: capture the description of binaries, source code, installers, documentation, accounts, cloud storage, support, updates, and proprietary add-ons.
- Payment terms: record the currency, taxes, one-time or recurring nature of the charge, renewal date, cancellation method, refund policy, and any trial conditions.
These details let you compare like with like. A paid hosted account is not the same product as a downloadable package, even when both use the same open-source code.
2. Verify the license for the version you will receive
Look for a named license in the package, source repository, documentation, or legal notice. OSI states that only software under an OSI-approved license should be called open source, and that approved licenses conform to the Open Source Definition. A listing that says “source available” without naming a license has not established open-source rights. Source code being visible is not, by itself, permission to copy, modify, or redistribute it.

Check the license and the version together
- Match the version number in the sale listing to the version identified in the project’s license file or release notes.
- Check whether the license applies to the whole package or only to the core code.
- Look for notices identifying bundled libraries, fonts, models, data, codecs, or other components that may have separate licenses.
- Read conditions that affect redistribution, attribution, source-code offers, patent rights, or distribution of modified versions.
If the seller cannot identify the license governing the offered build, ask for written clarification before paying. If the seller says that an additional payment is required merely to obtain permissions already granted by an OSI-approved license, ask why and request the contractual basis. Do not assume that a paid convenience package changes the underlying license rights.

What the open-source definition tells you
The Open Source Definition covers core freedoms rather than a promise about price or service quality. It requires free redistribution, access to source code, permission to create derived works, and nondiscrimination against fields of endeavor. Those requirements explain why a compliant license can permit commercial use while a distributor still sells a package or service around the code. They do not tell you whether a particular seller will provide updates, answer support requests, protect your data, or refund a purchase.
3. Compare the offer with the project’s official channel
Find the project’s own website, source repository, release page, or app-store listing through a trusted reference. Confirm the official project name, publisher identity, download links, and current version. Be alert to domains and store listings that look similar but are not connected to the project.
The Apache Software Foundation’s “Always free” explanation provides a useful example: its project downloads are free, while third parties may sell the software or related services. That is an example of one foundation’s policy, not a universal rule for every open-source project. The important comparison is whether the third-party offer adds value or simply charges for a copy the project already distributes directly.

| Comparison point | What to verify | Why it matters |
|---|---|---|
| Official availability | Whether the same version and platform build can be downloaded from the project or an identified official store channel | Shows whether the fee is for software access, convenience, or an added service |
| Version and integrity | Release number, publication date, checksums or signatures when the project publishes them | Helps detect stale, altered, or repackaged builds |
| Publisher relationship | Whether the seller is the project, a named contributor, an authorized distributor, or an unrelated reseller | Prevents an implied affiliation that has not been demonstrated |
| Included service | Installation, hosting, support, maintenance, warranty, updates, or customization described in the offer | Identifies what the payment actually buys |
4. Find out what the payment buys
Ask the seller to describe the paid deliverables in concrete terms. OSI identifies several legitimate ways to charge around open-source code, including services, warranties, customization, and maintenance. A fee may also cover compiled binaries, a signed installer, automated deployment, cloud infrastructure, account management, training, or a support response target.

Common chargeable elements
- Packaging: a tested installer, platform-specific build, dependency bundle, or simplified upgrade path.
- Installation and configuration: setup on your devices or servers, migration from another system, and integration with existing tools.
- Hosting: a managed web service, storage, backups, monitoring, bandwidth, or administrator access.
- Support: documented response times, ticket handling, telephone assistance, or access to knowledgeable maintainers.
- Maintenance: backported fixes, security patches, compatibility work, or long-term support for a particular release.
- Customization: features, connectors, reports, branding, or workflow changes delivered for your organization.
- Warranty or indemnity: contractual commitments that are separate from the software license and must be read carefully.
- Proprietary additions: closed-source features or hosted capabilities supplied alongside the open-source component.
Request an itemized description rather than accepting “premium open source” as an explanation. If the seller is charging only for a binary that the project makes freely available, decide whether the convenience, verification, or support is worth the price. If the seller is providing a hosted service, compare its data handling, uptime commitments, export options, and termination process with the effort of running the software yourself.
5. Check seller identity and project affiliation
Do not infer that a seller is an official maintainer because its page uses the project’s name, logo, or screenshots. Look for a statement on the project’s own channels identifying the company, distributor, or service. If no relationship is documented, treat the seller as a third party and evaluate its contract independently.
Verify the checkout entity, business address or jurisdiction where provided, customer-service contact, and terms of sale. A project volunteer, a commercial company, and an app-store intermediary can offer very different accountability. The person or organization receiving your payment should be the party named in the support and refund terms.

6. Inspect support, updates, and maintenance promises
Open-source status does not establish that a project is actively maintained or that a paid seller will keep your copy current. Check where releases, security notices, issue tracking, and support commitments are published. Then match those public signals to the paid contract.

Questions that need written answers
- Which release line does the purchase cover, and for how long?
- Are updates included, and are they automatic, manual, or limited to a defined support period?
- Does support cover installation, bugs in the upstream project, seller-specific packaging, or only billing?
- What response time, severity definitions, and escalation path are promised?
- Will the seller provide fixes for security vulnerabilities discovered after purchase?
- Can you continue using the installed version if the subscription ends?
Do not treat a busy repository, frequent commits, or a high download count as a guarantee of support. Those signals may be useful context, but only the license and the seller’s written terms define your rights and service obligations.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Evaluate privacy and security as separate product questions
Open-source code can be inspected and modified, but that fact alone does not prove that an app is private, secure, or suitable for sensitive data. The risk profile depends on the exact build, dependencies, permissions, update process, hosting arrangement, and operational practices.
For a downloadable app, review requested permissions, telemetry settings, signing or verification information, vulnerability disclosures, and the process for receiving updates. For a hosted offer, identify where data is processed, who can access it, how long it is retained, whether it is used for secondary purposes, how accounts are deleted, and how data can be exported. Ask which components are proprietary and whether the seller publishes security contacts or incident procedures.
These are app-specific checks. No general open-source label can substitute for reading the named project’s privacy notice, security documentation, and vendor terms.
Best Value
8. Read the price, renewal, cancellation, and refund terms
Determine whether the amount is a one-time purchase, a subscription, usage-based billing, or a combination. Check the renewal interval, price changes, taxes, payment-failure handling, cancellation deadline, and what happens to access after cancellation. A listing may show an introductory amount that does not describe later renewals; rely on the checkout terms, not a headline price.
Refund rights depend on the seller’s contract and the law that applies to the transaction. Confirm the refund window, eligibility after downloading or activating the app, and the required method for making a request. Save the receipt, license notice, terms version, and support correspondence. Because these conditions vary by listing and jurisdiction, they cannot be inferred from open-source status.
9. Separate open-source code from proprietary components
A paid app can combine an open-source core with closed-source modules, hosted APIs, commercial data, or a proprietary user interface. Ask which license governs each material component and which features stop working if the paid account ends. The seller should explain whether you receive source code for modifications, redistribution rights for the complete package, and any restrictions imposed by third-party components.
Pay particular attention to claims such as “commercial license required,” “enterprise features,” or “source available on request.” Those phrases may describe a separate proprietary feature, a support agreement, or a different edition rather than the open-source core. Get the distinction in writing before relying on the package for a business workflow.
10. Use a two-offer decision framework
When comparing an official channel with a paid reseller or service, score each offer on the same six axes. Record evidence rather than impressions.
- License and rights: Is the offered version under a named OSI-approved license, and do its terms meet your redistribution and modification needs?
- Seller and affiliation: Who receives payment, and is any relationship with the project documented?
- Included services: What packaging, setup, hosting, support, maintenance, warranty, or customization is included?
- Updates: Which versions and security fixes are covered, and for how long?
- Price structure: Is the charge one-time, recurring, or usage-based, and what are the cancellation and refund rules?
- Proprietary features: Which components use a different license, and what happens if you stop paying?
A higher price can be rational when it buys labor or infrastructure you would otherwise provide yourself. A low price can still be poor value if the package is stale, the seller is unidentifiable, or the service terms are absent. The comparison should end with a documented answer to the question: “What do I receive here that I cannot obtain, operate, or support through the official channel at lower total effort and risk?”
Red flags that justify pausing the purchase
- The listing uses “open source” but names no license.
- The seller refuses to identify the exact version or bundled components.
- The page implies official affiliation without confirmation from the project.
- The paid copy appears identical to a freely available official download, with no stated service or support benefit.
- Renewal, cancellation, refund, or post-cancellation access terms are missing.
- “Commercial use requires payment” is asserted without explaining which proprietary component or contract creates that requirement.
- Privacy, data location, update, or security practices are undisclosed for a hosted or managed offer.
When to obtain professional advice
License obligations can depend on the exact license text, version, modifications, distribution method, and contractual terms. If your organization plans to redistribute a modified package, combine licenses, embed the software in a product, process regulated data, or rely on an indemnity promise, ask a qualified technology lawyer to review the specific materials. This checklist helps you gather the facts; it is not a legal opinion.
