Before moving a workload to an Iraq-based data center, verify four things in writing: the laws that apply to your organization and data, the facility’s independently evidenced resilience and security, performance for your actual users and dependencies, and a contract that gives you measurable service levels and a workable exit. Iraq has a developing data-center regulatory framework, but public material does not establish one localization rule for every private workload. Suitability depends on your sector, data classes, target city, architecture, provider, and contract.
Start with the legal question, not the rack
The Communications and Media Commission (CMC) public IT and digital-services page lists a data-center-services regulation dated 20 July 2026. A CMC meeting announcement says commissioners approved the regulation on 14 April 2026. Those announcements do not, by themselves, establish the licensing process, effective date, transition period, or duties imposed on customers. Obtain the complete, current text from the CMC and have Iraqi counsel explain which provisions apply before you rely on a provider’s compliance statement.

Do not treat the announcement of a government project as a blanket private-sector hosting mandate. The Iraqi News Agency reported a Nokia contract for two government data centers in Baghdad. Communications Minister Hiyam Al-Yasiri described the intended government service this way: “This means that the data of Iraqis and all companies benefiting from this service will be stored inside Iraq, at government sites, and by Iraqi hands.” The statement describes that announced government offering; it does not say that every private organization must host in Iraq or that the facilities are generally available to commercial customers.

Determine whether your activity falls within a framework
The CMC’s digital-platform framework covers specified providers operating or supplying digital services or content to users in Iraq, including some providers without a physical presence in the country. Its cloud-regulation definition refers to current or future Iraqi requirements. Whether your company, service, or customer-facing platform falls within those provisions requires a facts-specific legal analysis. Consider your place of establishment, Iraqi users, sector, contractual role, and whether you operate infrastructure for others.

- Ask the provider for its current CMC authorization, license, or approval evidence and the exact services and sites covered.
- Request the complete regulation, not a marketing summary, and record the version and date counsel reviewed.
- For government, financial, health, telecommunications, or other regulated work, obtain written confirmation from the responsible authority where possible.
- Keep legal conclusions separate from a provider’s “local,” “sovereign,” or “compliant” label.
Map every copy of the workload and data
A production database is only one part of the compliance perimeter. Build an inventory that follows information through the application, operations, and recovery processes.
- Classify personal data, payment and financial records, health information, government data, customer content, telemetry, logs, support tickets, and security evidence.
- Identify primary stores, read replicas, snapshots, backup media, disaster-recovery copies, caches, temporary files, and exports.
- Document encryption in transit and at rest, key custody, key-management locations, and who can request or approve key use.
- Trace management planes, monitoring systems, remote-support sessions, and subprocessors that may view or copy data.
- Ask where cross-border transfers occur, including support access and cloud dependencies, and which transfer mechanism is used.
- Specify retention, deletion, legal-hold, and deletion-certification procedures for each copy.
Publicly available material reviewed for Iraq does not establish one comprehensive data-protection rule for every data type or workload. That absence is not permission to export data freely; it means your organization must identify sector rules, contracts, and applicable Iraqi requirements with counsel. Put the resulting data-location map and permitted access paths into the supplier agreement.

Power, generators, and cooling
Request an electrical one-line diagram or equivalent description showing utility feeds, transfer equipment, generators, and UPS topology. Ask for generator capacity, fuel storage and resupply arrangements, maintenance and test history, UPS autonomy under your expected load, and the sequence used during a utility failure. Obtain cooling design and redundancy, environmental sensor coverage, alarm escalation, and recent incident records.

Define “outage” precisely: loss of utility power, loss of conditioned power at your rack, temperature excursion, or inability to reach the service. Tie the definition to measurement, notification, restoration targets, and service credits or other remedies. EarthLink publicly advertises multi-source power, generators, UPS, and redundant environmental control; Ankido advertises redundant power and cooling. Treat those statements as prompts for evidence, not proof of capacity or performance. Ask for test reports, maintenance logs, and a tour or live telemetry where security policy permits.
A customer-owned rack UPS is relevant only when you supply physical equipment, the facility permits it, and the electrical design benefits from it. First establish what the site already provides, the permitted rack power envelope, battery chemistry and fire rules, maintenance responsibility, and how a customer UPS interacts with facility UPS and generator systems.
Connectivity and workload latency
“Carrier-neutral,” “multi-ISP,” or “direct internet” does not demonstrate diverse physical routes. Obtain the names of all carriers and upstreams, the entry paths into the building, peering and transit arrangements, cross-connect lead times and charges, committed and burst bandwidth terms, IPv4 and IPv6 support, and DDoS protections.

Require measurements from the actual user populations and from critical dependencies such as payment gateways, identity services, software-as-a-service systems, and public-cloud regions. Record latency, jitter, packet loss, throughput, and behavior during busy periods. Where feasible, require a route-failure test that demonstrates what remains when a carrier, fiber path, edge router, or cross-connect fails.

T964 advertises SOC monitoring, incident response, segmentation, and IT/OT security, while EarthLink and Ankido describe physical and logical safeguards. Marketing pages do not independently establish certification, control effectiveness, or contract performance. Ask for the underlying reports, a shared-responsibility matrix, and references from customers with comparable regulatory and technical requirements.
Backups, recovery, and site failure
Ask whether backups are immutable, isolated from production credentials, and protected against deletion by a compromised administrator. Establish where replicas and backup media are located, whether a regional incident could affect both copies, and who owns encryption keys. Require contractual recovery-point objective (RPO) and recovery-time objective (RTO) commitments that match your business impact analysis.
Request architecture diagrams and dated test records for database recovery, application failover, and restoration of a complete service. A feature called “disaster recovery” is not evidence that failover works at your required scale. Ankido advertises backup and disaster-recovery options; obtain the exact topology, retention, test frequency, and customer participation expected.

Design the exit at the same time as the backup. Specify export formats, API or physical-transfer options, bandwidth and egress charges, key handover, deletion certification, and how long the provider will support restoration elsewhere after termination.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Turn promises into enforceable contract terms
Have procurement and counsel convert every material requirement into a measurable schedule. The agreement should identify:
- the service components covered by availability calculations and the measurement source;
- planned-maintenance notice, allowed maintenance windows, and exclusions;
- incident severity levels, acknowledgement and restoration targets, escalation contacts, and 24-hour coverage;
- service credits or other remedies, with no wording that quietly nullifies the commitment;
- security-incident notification deadlines, cooperation duties, and evidence access;
- subcontractors, locations, change-control rights, and advance notice of material changes;
- liability caps, indemnities, insurance, and treatment of regulatory penalties;
- price-adjustment rules, remote-hands rates, cross-connect fees, bandwidth overage, backup, and egress charges;
- termination assistance, migration support, export format, return of equipment, and certified deletion.
Advertised uptime is not a contractual SLA until the signed document defines the calculation, exclusions, measurement period, and remedy. Require a named owner for each control in a shared-responsibility matrix; otherwise power, patching, backups, keys, and incident response can fall between teams.
Compare deployment models against your workload
Evaluate Iraq colocation, managed hosting, public-cloud regions outside Iraq, and a hybrid design using the same decision record. Score each option for:
- legal and data-location fit for every data class;
- latency and throughput to users and dependencies;
- power, cooling, network, and geographic resilience;
- security evidence, audit rights, and operational transparency;
- achievable RPO and RTO, including a second site;
- your team’s operating skills and the support available locally;
- provider concentration, portability, and the cost of leaving;
- total cost: space, power, bandwidth, cross-connects, migration, backups, egress, taxes, and support.
There is no like-for-like public comparison of Iraqi facilities’ cost, uptime, certifications, outage history, or route independence. Collect comparable quotes and run the same workload tests; do not rank sites from brochure specifications.
Use a controlled migration plan
- Inventory dependencies. Record applications, databases, queues, identity providers, DNS, certificates, observability, management planes, keys, third-party connections, and every backup location.
- Set a baseline. Measure current latency, throughput, transaction times, error rates, recovery objectives, and the longest interruption the business can tolerate.
- Choose a pilot. Select a low-risk workload with representative traffic. Define rollback triggers, data-validation checks, and who can stop the move before copying production data.
- Test transfer and restore. Time the initial copy and incremental replication; verify checksums, permissions, encryption, backup restoration, and recovery from an isolated account.
- Test the real paths. Run performance and security tests from actual user geographies and dependency networks. Include DNS and routing changes, identity integration, monitoring alerts, and a carrier or link failure where the provider permits it.
- Cut over in stages. Assign owners, communications, go/no-go criteria, maintenance windows, and a tested rollback path. Keep the original environment usable until acceptance criteria are met.
- Verify after migration. Confirm access controls, logs, alerting, costs, backup jobs, recovery procedures, and the provider’s service reports. Update the exit plan with the configuration and export steps you actually used.
Common failure modes to stop early
- Assuming “must stay in Iraq.” The Baghdad government-center announcement is not a universal private-sector localization rule. Obtain a workload- and sector-specific legal opinion.
- Accepting a compliance badge. Ask for the CMC authorization scope, audit evidence, dates, exceptions, and remediation rather than relying on a label.
- Counting carriers instead of routes. Two providers can share one building entry or upstream. Demand physical-path and failover evidence.
- Buying equipment before checking the design. A rack UPS may be prohibited, redundant, or ineffective if the facility already controls the complete power chain.
- Signing an SLA with no remedy. Ensure availability, outage definitions, exclusions, credits, and restoration targets are measurable and signed.
- Testing only a happy path. Include dependency latency, identity, DNS, backup restore, security response, and rollback before production cutover.
A procurement checklist for the decision file
- Current CMC regulation text, provider authorization, and counsel’s applicability analysis.
- Data-flow and location map covering production, replicas, backups, logs, keys, and support access.
- Power single-line, generator and UPS tests, fuel plan, cooling design, telemetry, and incident history.
- Carrier, upstream, route-diversity, DDoS, IPv4/IPv6, bandwidth, and measured-latency evidence.
- Physical-security procedures, cyber-control evidence, audit reports, exceptions, and remediation plans.
- Backup architecture, immutability and isolation controls, RPO/RTO commitments, and failover tests.
- Signed SLA, security and data-processing terms, subcontractor list, pricing schedule, and exit assistance.
- Pilot results, rollback criteria, cutover approvals, and post-migration recovery verification.
The defensible choice is the site and operating model that can prove it meets your legal obligations and workload objectives, not the one with the strongest brochure. Keep the evidence package current and revisit it whenever the CMC rules, your data flows, or the provider’s architecture changes.
