Before you buy, verify both that a legally documented route serves this specific property and that the route is usable under realistic winter conditions. Then check the home, insurance, hazards, association obligations and full carrying costs before your contract contingencies expire.
This guide focuses on U.S. buyer due diligence. Access rights, disclosure rules, resort arrangements and insurance availability vary by location; only a review of the particular property’s records and contracts can establish what applies.

1. Establish the legal route to the ski area
Trace the proposed route from the property to the trail, lift or ski-area boundary. Identify every parcel it crosses and the document that authorizes use. A map, a marketing description or the fact that previous owners used a route does not by itself establish a continuing legal right.
Review title and recorded documents
Ask your title company or local real-estate attorney to review the title commitment, recorded plat, easements, declarations and any applicable resort or community documents. Confirm whether an access right is recorded, whether it benefits this parcel, and whether its location and terms match the route shown to you. If the records are unclear or conflict with the listing, have local counsel resolve the ambiguity before relying on the route.

- The Ultimate Ski Book
A local example illustrates why the recorded documents matter: an excerpt from a Town of Mountain Village planning packet says a developer seeking ski-in/ski-out access “shall secure a ski-in/ski out easement from the current ski resort operator,” with the easement noted on the subdivision plat. That is an example from a particular local development context, not a rule that applies everywhere.
Ask what can limit or change access
- Where exactly does the route begin and end, and which parcels does it cross?
- What recorded instrument authorizes use, and is the right appurtenant to this parcel?
- Does access depend on season, hours, snow conditions, resort operations, user class or membership?
- Who maintains the route and pays for that work?
- Can the resort, association or landowner close, relocate or change it, and which document grants that power?
Do not assume a recorded right guarantees that a resort will operate, that a trail will remain open, or that a particular route will always be skiable. Those matters depend on the relevant property and resort documents and actual operating conditions.
2. Test whether the route works in practice
A legal right and a physically usable route are separate checks. Walk the route with a qualified local professional or inspect it under realistic winter conditions, if possible. Ask whether it is skiable to the property during ordinary operations, whether there is a safe return route to the lift or trail network, and what happens when snow coverage or resort operations change. Find out who clears, grooms or otherwise maintains any access path, and when it is available.

Compare what you observe with the legal description and the seller’s account. If you cannot verify winter usability before closing, treat that uncertainty as unresolved rather than assuming the listing phrase will hold true in every season.
3. Inspect the home, its repair history and local hazards
Request a qualified inspection of the home and review available records for past flooding, wildfire or other disaster damage, insurance claims, repairs and mitigation work. Ask the inspector to examine prior repairs and document findings. Also ask about the water source and quality, utility costs, and any past insurance cancellation or nonrenewal.
Check hazard information without treating a map as a verdict
Review official hazard resources and more than one source, but do not use a map or third-party risk score as a substitute for an inspection or an insurer’s assessment. The Consumer Financial Protection Bureau’s flood and disaster guidance, last reviewed May 22, 2024, says a designated Special Flood Hazard Area has at least a one-in-four chance of flooding over a 30-year mortgage, citing FEMA. That is an area-level probability, not a prediction that a particular house will flood. The CFPB also notes that flooding can occur outside designated areas and that a mortgage on a home in a designated Special Flood Hazard Area generally requires flood insurance.

Preserve your inspection options
Where the contract allows, keep an inspection contingency and have a local attorney or broker explain the applicable deadlines. The CFPB describes an inspection clause as making the offer proceed only if an inspection shows the property is in acceptable condition. Do not let a deadline pass while waiting for unresolved inspection findings, repair documentation or hazard answers.

4. Obtain property-specific insurance answers before contingencies expire
Get written, property-specific insurance quotes early enough to act on them before your contract contingencies expire. Coverage can be difficult or expensive for high-risk properties, so a general estimate for the area is not a substitute for an underwriter’s quote on this home.
Ask the insurer or broker to identify covered perils, deductibles, exclusions, limits, cancellation or nonrenewal history, and any lender requirements. If the property is in a condominium or HOA, determine which coverage comes from the individual policy and which, if any, comes from the association’s master policy; request the master-policy certificate and relevant details. The CFPB advises buyers to ask about FAIR or force-placed coverage where ordinary coverage is unavailable or inadequate. Check separately for lender and association insurance requirements rather than assuming one policy satisfies both.

5. Read the HOA, condominium and resort-community documents
Request the declaration or CC&Rs, bylaws, rules, recorded plat, current budget and financial statements, recent meeting minutes, insurance certificates, available reserve information, management agreements, and details of known projects or assessments. Check what documents are available under the contract and local law.
Identify what you own and what you must maintain
Find the property boundaries and distinguish private property, common elements and any limited common areas. Confirm who is responsible for maintenance, repairs and costs for the home, access route and shared facilities. The Utah Department of Commerce homebuyer checklist emphasizes that these ownership categories carry different responsibilities; its disclosure rules are Utah-specific and should not be assumed to apply in another state.

Review dues, association financial condition, reserve information, pending work, insurance and meeting minutes for signs of planned expenses or possible special assessments. Colorado Division of Real Estate guidance recommends examining financial documents, insurance, dues, maintenance and recent minutes. Colorado also advises buyers to review HOA documents and recent meeting minutes; see the Colorado HOA advisory. These are useful state-specific examples, not universal disclosure rules.

6. Make the decision on the property’s evidence, not its label
Before committing, assess each candidate against the same property-level questions:
- Access rights: Is the route supported by recorded documents that benefit this parcel?
- Practical access: Can you use it under ordinary winter conditions, and are its operating limits and maintenance responsibilities clear?
- Condition and hazards: Are damage history, repairs, inspection findings, water and utilities understood?
- Insurance: Do written quotes and any HOA master-policy information show what is covered, excluded and required?
- Association obligations: Are property boundaries, maintenance assignments, dues, finances and potential projects or assessments clear?
- Total carrying costs: Have you accounted for recurring expenses and foreseeable maintenance using property-specific information rather than an assumed price or premium?
If a material answer depends on an unwritten promise, an unclear easement, an unavailable insurance quote or an unexplained association obligation, resolve it with the relevant records and qualified local professionals before your contractual options run out.
